I'm DailyMail.com journalist Marjorie Hernandez, and over the last six months I've been investigating this incredible story and speaking to the people in the eye of the storm. Welcome to the trial of Diddy.
Kayla Brantley
Hey, I'm Kayla Brantley, reporter at large for the Daily Mail in Manhattan.
Marjorie Hernandez
And I'm Marjorie Hernandez, DailyMail.com's West coast news editor.
Kayla Brantley
And welcome back to episode 22. Zero of the trial of Diddy. I cannot believe we are five months into this story and it just does not let up. Just this week we've seen the release of Investigation Discoveries, the Fall of Diddy documentary. And there were some major allegations in there, including actor Kat Pasion claiming she had a non consensual sexual encounter with Combs in 2021.
Marjorie Hernandez
That's right. And there's also an interview with Thalia Graves, who back in September 2024 filed a lawsuit which alleged that Sean Combs drugged, bound and violently raped her at a bad boy Studios back in 1999. She went on to claim Diddy distributed a video of the attack, even quote, selling it as pornography.
Kayla Brantley
Marge, ever since this came out, I know you've been watching it nonstop. So as someone who studied this case and talked to so many people connected to it, was what did you think?
Marjorie Hernandez
Yes, Kayla, the documentary was very interesting. And to the interviews that stood out to me was one with Phil Pines, who was Combs personal assistant. And he also has sued Diddy for sexual battery, sexual harassment, and he had other claims as well. And the other was model and actress Kat Pasion, who had a relationship and shortly after Kim Porter's death back in 2018. And she claimed that Diddy Also sexually assaulted her. Now, according to Kat, Diddy forced himself onto her while he was under the influence of what she said was a recreational drug called Tusi, which was actually mentioned in Combs's indictment. Now, tusi is also known as pink cocaine, which is obviously a type of psychedelic. Kat was very emotional, but she didn't get into specific details of what Diddy allegedly did to her. But she said it was, quote, wasn't consensual. She also claimed that after that incident, weeks later, Diddy threatened her to get deported to Canada, where she's from. And so she also detailed these experiences in her journal and called Diddy, quote, a demon. And the other one that I thought that was interesting was Phil Pines. In his interview, he also got very emotional and he broke down in tears. Now, he was Combs senior executive assistant from 2019 to 2021. And he actually had a cache of ev, mostly voice recordings and text messages from Diddy and his former chief of staff, Christina Karam. And in these text messages, Karam and Diddy would tell Pines what Diddy would need for his, quote, Wild King Knights parties. So that's what he would call those, those big parties. But Pine said he didn't know them as freak offs, which is what the federal prosecutors had called them.
Kayla Brantley
A lot of these allegations, like the two things that you said, just really stood out for you. It sounds like everything that we've already heard before. So was there anything in this documentary that while it's new information, was there anything that was shocking that, you know, maybe seemed kind of left field?
Marjorie Hernandez
Again, like you mentioned, these are details that we've heard before, but I think seeing it straight from the alleged victim's experience, that was very interesting to see how emotional they got. And also the text messages from Phil that was, you know, actual evidence, alleged evidence that Christina Karam was there telling him to do these things, get these drugs for Diddy, get prepared for this Big King Wild night parties, which again, have been described as, quote, unquote, freak offs. But just seeing it described and obviously the pain that these alleged victims still feel years later, that was very evident. But again, these are all allegations and we'll see how it shakes out.
Kayla Brantley
During the trial, in the documentary, did Kat Pasion say whether or not she was one of the Jane does in the civil suits against Diddy?
Marjorie Hernandez
You know, Kayla, I wasn't clear on that because she doesn't say that she is suing Diddy. So whether or not she is one of the Jane Doe's not quite clear. But she does go into a lot of detail. Just like other victims allege, him forcing himself onto her and her being in fear, and she's still in fear for her life.
Kayla Brantley
And Marjorie, watching this documentary, what was the feeling that you were left with? Like, what was the overall view of Diddy that these documentary filmmakers kind of left you with?
Marjorie Hernandez
Well, it definitely painted him in a bad light. It did go through his history of how he came up, which we explored in our earlier episodes. But towards the end, you know, they painted a picture of somebody who was power hungry, who held that power and influence over other people, and that he was unstoppable, and that they felt that they had to do what he wanted them to do in order to stay in the industry or, frankly, be safe, because they are in fear of their lives. Again, these are all allegations. We don't know yet whether or not some of these folks will be called as witnesses doing his criminal trial. But it is interesting to note that they've shown a pattern, and at least Kat and Mr. Pines, they actually have some evidence. Phil, again, got very emotional. One of the quotes that I found very shocking. Going to quote this now. He said, quote, we usually had a laundry list of items including lights, alcohol, marijuana, ketamine, Molly, you have mushrooms on the top there. Baby oil and astroglide are very important. Candles, incense, Apple TVs, electronics, computers, iPads. Obviously, there was, you know, male libido supplements, so stuff like that. So essentially, he was saying these are kind of the. The list of things that Diddy needed in these king night parties, which, again, prosecutors call them as freak offs.
Kayla Brantley
Yeah.
Marjorie Hernandez
And he also said he witnessed Diddy hit a female and he was forced to drive her back home. And one of the most shocking things was he described a time when Diddy actually allegedly told him to have sex with a woman while he watched. And he got very emotional about that. Pine said Diddy told him that he had to have sex with this woman to, quote, prove his loyalty to Diddy. And he described that encounter as very traumatic for him and that he still has not recovered from that.
Kayla Brantley
And if you're the prosecution watching this, you absolutely will want Pines taking the stand, testifying against Diddy. Like, these are such strong claims and such a strong testimony that I can only imagine that this is somebody that will be seeing in court.
Marjorie Hernandez
Yeah, he actually did the ID interview, I think, a few days before he testified to the grand jury. So there's a strong likelihood that he will be called to the stand.
Kayla Brantley
So in response to this, of course, Diddy's team came out with a statement, and this one's regarding Phil Pine's claims. Quote, no matter how many lawsuits are filed, it won't change the fact that Mr. Combs has never sexually assaulted or sex trafficked anyone, man or woman, adult or minor. We live in a world where anyone can file a lawsuit for any reason. Fortunately, a fair and impartial judicial process exists to find the truth, and Mr. Combs is confident he will prevail in court.
Marjorie Hernandez
We also received a statement concerning the documentary series from Sean Combs's attorneys and quote, these documentaries are rushing to cash in on the media circus surrounding Mr. Combs. The producers failed to provide sufficient time or details for his representatives to address unsubstantiated claims, many from unidentified participants whose allegations lack context. By withholding this information, they made it impossible for Mr. Combs to present facts to counter these fabricated accusations. This production is clearly intended to present a one sided and prejudicial narrative. As we've said before, Mr. Combs cannot respond to every publicity stunt or factually ridiculous claim. He has full confidence in the facts and the judicial process where the truth will prevail. The accusations against him are pure fiction.
Kayla Brantley
From this documentary, you see a lot of people speaking out about the alleged abuse that they experienced from Diddy. But nowhere in that documentary did you see anyone coming to his defense, Anyone on Diddy's side? No one really defending him.
Marjorie Hernandez
Yeah, they did not have anyone from Diddy's legal team on, so I thought that was interesting. But they did include the blanket statement that his lawyers have provided all media, which is he denies all the allegations.
Kayla Brantley
We have so much more coming up, but for now, let's pause for a break.
Marjorie Hernandez
Welcome back to the trial of Diddy.
Kayla Brantley
Let's get into these brand new rulings from Judge Aaron Sabermanian. On Thursday, the trial judge, Judge Aaron Subramanian, actually ruled to leave the protective order regarding the sex tapes and therefore denied Diddy's request for access. If you guys remember, Diddy's lawyers were basically saying that these tapes would absolve him of any wrongdoing and show the world that this was, quote, private sexual activity between himself and Cassie Ventura. And what was striking in that letter from Diddy's team is that they said, quote, any fair minded viewer of the videos will quickly conclude that the prosecution of Mr. Combs is both sexist and puritanical. And they said it's sexist because the government's theory perpetuates stereotypes of female victimhood and lack of agency. So that was A few weeks ago. Now we have a ruling from the judge. He's completely denied Diddy's request. And I'll read part of that ruling. So it was a memorandum, a letter motion as to Sean Combs. And I'll just read a little part of it. It says, quote, defendants motion to amend the protective order is denied without prejudice. While the government objects to handing the videos over, they provide several options for defendant to consider that would permit the defense to view the videos, access the information they're looking for, and even allow them to manipulate the videos as they see fit. To the extent these options are insufficient, the defense may propose other options to the government. It doesn't appear that the defense did this before raising the issue with the court. Also, the judge ruled that Diddy and his team can't share the contents of the videos or whatever they have access to with anyone. So these videos, the judge is saying they absolutely cannot be shared like they're sex tapes. They should not be shared with anyone. Of course, if they're not two consenting adults who want it to be shared, which I highly doubt, Cassie Ventura wants these tapes out there. I will read part of the letter from the judge. It says, quote, the party should have these discussions, and then if they really reach an impasse, the defense can come back to the court. If that happens, they should be prepared to clearly articulate why they need possession of the videos despite the options furnished by the government. So the judge is giving them options. They're saying, look, if you can't come to an agreement, the defense can come back to the court and they can argue their case, articulate why they need possession of these videos. But for now, the judge is not having it. So obviously, there's a lot of legal jargon in these memorandums, and I think next week would be great to have one of our legal friends come on and discuss what's going on here. It is pretty straightforward, but, you know, we always love to have one of our friends of the show on and give their legal expertise. So for now, that's it. The Trial of Diddy: Episode Summary – "Defendant's Motion is DENIED"
Release Date: January 31, 2025
Introduction
In episode 22 of The Trial of Diddy, titled "Defendant's Motion is DENIED," hosts Kayla Brantley and Marjorie Hernandez delve deep into the ongoing legal battle surrounding Sean "Diddy" Combs. Once a revered music mogul known for producing hits for top artists like Biggie, Mary J. Blige, and Jennifer Lopez, Diddy's reputation has been marred by severe allegations that have captivated the public and media alike.
Allegations Against Diddy
The episode opens with an overview of the serious charges Diddy faces, including sex trafficking, racketeering, and transportation to engage in prostitution. Marjorie Hernandez emphasizes the gravity of the situation:
"At the height of his career, Sean Diddy Combs had it all. It seemed like everything Diddy touched turned to gold. Now the once untouchable hip hop mogul is fighting for his life..." (00:25).
Recent lawsuits have surfaced, accusing Diddy of multiple instances of sexual assault. Notably, the documentary Investigation Discoveries: The Fall of Diddy has reignited the case by presenting harrowing testimonies from alleged victims.
Key Testimonies and Evidence
Kat Pasion's Allegation:
Actress Kat Pasion claims she experienced a non-consensual sexual encounter with Diddy in 2021. Hernandez recounts Kat’s emotional testimony:
"...she said it was, quote, wasn't consensual. She also claimed that after that incident, weeks later, Diddy threatened her to get deported to Canada..." (02:18).
Kat further described grappling with fear for her life and labeled Diddy as a "demon," highlighting the profound psychological impact of the alleged assault.
Thalia Graves' Lawsuit:
Thalia Graves alleges that in September 2024, Diddy drugged, bound, and violently raped her at Bad Boy Studios in 1999. She accuses Diddy of distributing a video of the assault as pornography, adding a layer of criminal misconduct to his actions.
Phil Pines' Testimony:
A pivotal moment in the documentary is the testimony of Phil Pines, Diddy's former personal assistant. Pines revealed:
"...these are kind of the. The list of things that Diddy needed in these king night parties, which, again, prosecutors call them as freak offs." (06:07).
Pines disclosed intimate details about the production of Diddy's extravagant parties, including procurement of various drugs and witnessing Diddy's violent behavior towards women.
Perhaps the most shocking revelation was Pines' account of being forced to participate in non-consensual sexual activities:
"He told me that I had to have sex with this woman to, quote, prove his loyalty to Diddy. And he described that encounter as very traumatic for me..." (07:39).
Diddy's Response and Legal Maneuvers
In reaction to the mounting allegations, Diddy's legal team issued a strong rebuttal:
"...no matter how many lawsuits are filed, it won't change the fact that Mr. Combs has never sexually assaulted or sex trafficked anyone..." (08:29).
His attorneys further criticized the documentary as a biased attempt to tarnish his reputation, labeling the accusations as "pure fiction" and emphasizing his trust in the judicial process to exonerate him.
Judicial Proceedings: Denial of Defendant's Motion
A significant focus of this episode is Judge Aaron Subramanian's recent ruling denying Diddy's motion to amend the protective order concerning the controversial sex tapes. Initially, Diddy's defense argued that the tapes would exonerate him by showcasing consensual activity between him and Cassie Ventura, labeling the prosecution's case as "sexist and puritanical."
However, the judge's memorandum stated:
"Defendant's motion to amend the protective order is denied without prejudice. ... the defense may propose other options to the government." (11:01).
Importantly, the judge prohibited any sharing of the tapes, ensuring they remain confidential and cannot be distributed as purported sex footage. This ruling underscores the court's stance on maintaining the integrity of the evidence and preventing potential prejudicial narratives.
Future Implications and Conclusion
As Diddy's trial approaches in May, the denial of his motion marks a crucial setback for his defense strategy. The episode closes with hosts encouraging listeners to stay engaged and informed, highlighting the podcast's commitment to providing in-depth coverage of high-profile trials.
Marjorie Hernandez reflects on the emotional weight of the testimonies and the potential impact of key witnesses like Phil Pines:
"He described a time when Diddy actually allegedly told him to have sex with a woman while he watched. ... Pine said Diddy told him that he had to have sex with this woman to, quote, prove his loyalty to Diddy." (07:39).
With mounting evidence and powerful testimonies, the episode paints a bleak picture of Diddy's current standing, emphasizing the serious nature of the charges and the legal challenges he faces.
