I'm DailyMail.com journalist Marjorie Hernandez, and over the last six months I've been investigating this incredible story and speaking to the people in the eye of the storm. Welcome to the trial of Diddy.
Kayla Brantley
Hey, I'm Kayla Brantley, reporter at large for the Daily Mail in Manhattan.
Marjorie Hernandez
And I'm Marjorie Hernandez, west coast news editor for DailyMail.com in Los Angeles.
Kayla Brantley
And welcome to episode 10 of the trial of Diddy. It's a quick update this week as the case quite naturally has gone a little quiet ahead of the May 5 court date. But we also want to dig into some of your comments and thoughts that have come through. So stick around for that later on in the show. But now let's get to what's happening in the news. What do you have for us, Marjorie?
Marjorie Hernandez
Thanks, Kayla. Well, this week Sean Combs legal team has asked the court for him to be released from jail in order to prepare for his trial beginning May 5, 2025. The reason for this his team have put forward is quote, changed circumstances and they say new evidence. So his lawyers have filed this latest request for bail in a Manhattan federal court.
Kayla Brantley
And it's always important to say that Combs has pleaded not guilty to all of these charges.
Marjorie Hernandez
Of course, and in their court filing, his attorneys have proposed a quote for far more robust bail package that would involve Diddy surrendering to a strict around the clock security monitoring and almost 100% restrictions on his ability to contact anybody but his lawyers. And also in his bail request, it comes with a cash package attached as all of his other previous ones have. And it's actually the same amount of $50 million or nearly £39 million. So if we dive into the document, we can see that there's a memo filed by Diddy's attorneys for his bond motion, which actually will be discussed next Friday on November 22nd. Other documents filed by the defense alleged the prosecutors actually have been leaking information to the media. They're actually asking the judge to do something about, quote, the leaks and claim this is actually endangering Diddy's right to a fair trial. So the defense also provided their reasons why the prosecution should disclose names of the alleged victims. They're arguing that there's no way to prepare for Diddy's defense if they don't know exactly who will be called to testify against him.
Kayla Brantley
Yeah, and Marjorie, I want to read this directly from the document. It says, quote, given the incredibly broad nature of the alleged conspiracy here, the government's response, which boils down to, you know, what you did is wholly unpersuasive. That is especially true given the wild and ever expanding allegations appearing in the press from both government agents and civil attorneys, unquote. The lawyers then go on to say, quote, against this backdrop, a never ending circus of salacious and baseless allegations, Mr. Combs is entitled to know the basic nature of the government's actual case against him, Unquote.
Marjorie Hernandez
That's right. And what's interesting is that his lawyers have said this case is, quote, sui generis, meaning in US Law, that it's unique and it doesn't fit into any existing legal category or precedent. The lawyers are also saying that Combs has, quote, no way of knowing whose claims the government is crediting. And they go on to say that it's impossible to prepare for his defense in such a circumstance. So I think the November 22nd hearing will just be about the bail motion, but the issues concerning the press leaks and defense requests to name the alleged victims will also probably argued in a future date.
Kayla Brantley
Yeah, and Marjorie, Diddy's lawyers have pointed toward new evidence that they say, quote, makes clear the government's case is thin. And as we said earlier, there's been a very natural slowing down of claims and counterclaims in this case recently. For the past few weeks, it felt like there were new allegations coming out all the time. But recently, things have slowed down. So it'll be really interesting to see how this develops. And it's important to be clear that Diddy and his attorneys have always maintained the rapper's innocence. And they provided DailyMail.com with a statement that Sean Combs has never sexually assaulted or trafficked anyone, whether they be, quote, man or Woman, adult or minor.
Marjorie Hernandez
And that's it for today's news update. But as Kayla said earlier, we wanted to get into some of your thoughts and comments that we've received, and there's some great ones. These are from Spotify listeners. Missy Holland Chamberlain wrote, less music, please. It's kind of annoying. Sorry. But it is.
Kayla Brantley
Sorry, Missy.
Marjorie Hernandez
Sorry, Missy. But that one was from one of the earlier episodes. But you know what? We love music, so I guess we're sorry, but not sorry.
Kayla Brantley
Okay, well, this one is from Bainbridge nz, who says you keep going over old ground. Please give more details. And honestly, Bainbridge nz, this is a really good point, but it's important to say that the trial hasn't started yet, so there's only a certain amount of verified information that's out there. And much of the other material washing around is, as you can imagine, legally untouchable. We have our lawyers go through every episode to make sure that everything we say is factual. So we don't want to just, you know, throw out different theories just because we can. So we want to be clear and concise, but we also have to make sure that what we're talking about is appropriate.
Marjorie Hernandez
That's right. And fan, again on Spotify, said rather cryptically, I woke up with Diddy. Now, there's different ways to interpret that. One is simply this person, on some unspecified morning, just woke up with Diddy. Nice. No problem. Another is that their consciousness was awoken by the allegations in the case.
Kayla Brantley
Maybe it's actually that their consciousness was awoken by Diddy's music and business empire. I don't know.
Marjorie Hernandez
That's an interesting idea. We really need to. We really need some more details from N Fan to fully understand and to get to the heart of what's going on there.
Kayla Brantley
Yeah, but N Fan, if you know some things, you know where to reach us. But here's what you might enjoy, Marjorie. Christine writes, I'm really enjoying listening to this podcast. Marjorie has done a great job.
Marjorie Hernandez
Oh, well, thank you so much, Christine. My family are very supportive of my work. Thank you, fam.
Kayla Brantley
Christine goes on to write, maybe now Mr. Combs is going to prison. It'll be the end of all this noise. Well, the trial hasn't started yet, so there's no reason to believe Diddy is or should be facing prison. As for his noise, well, a lot of people kind of like it now. Yeah, he was pretty big. Is pretty big.
Marjorie Hernandez
Also, there's some. There are some harsh words from HD again on Spotify. Quote, really disappointed with this podcast. It's overproduced. Music competes too much with the voices and the host speaks in a slow and condescending way.
Kayla Brantley
Oh, gosh, everyone's a critic, Marge.
Marjorie Hernandez
Ouch. Well, HD continues. This is more akin to an entertainment show than just reporting facts. While we are an entertainment show, hd, but we also report facts. So thank you for listening.
Kayla Brantley
Also, AP writes, so far this podcast sounds like an old VH1 documentary rerun. Honestly, I loved the VH1 documentary reruns.
Marjorie Hernandez
Oh yeah, I used to watch those all the time. Yeah, it's hard to see whether that's a good or bad thing. I mean, I also, I would always watch those behind the Music show. So.
Kayla Brantley
Yeah, Kimberly says too many commercials to stay interested. Well, Kimberly, this is just how we fund the show. Okay? Also, our sponsors are angels, so there's that too.
Marjorie Hernandez
Thank you, sponsor. Shout Out. After listening to why now episode, Wendy 007 wrote a long comment, some of which reads, quote, good. The prison conditions are less than ideal. Amen. They go on to mention Sam Beckman freed and a recording studio in Tampa, Florida. And an alleged encounter with Diddy on the no Way out tour. And again, recording this person, windy007, everything these people are saying is true, alleges Wendy. We will naturally let the courts decide.
Kayla Brantley
Yeah. And after that same episode, Beck writes, quote, why so much focus on an abusive man's well being and achievement? Which honestly is a good question. But to that my answer would be because he's not been convicted of anything yet. And everyone deserves a fair trial. And all incarcerated people deserve decent living conditions, don't they? Also his achievements. Yes, he was huge for the culture, is huge for the culture. So we have to point that out. You can't ignore that.
Marjorie Hernandez
Can't ignore his. His big contribution to hip hop and the culture.
Kayla Brantley
Yeah.
Marjorie Hernandez
And in similar veins, Sophia Gabini wrote, this episode seems pretty tone deaf. Diddy is rich and a powerful man who can do as he pleases and will get more than a fair trial. But Scala just said, you know, everybody deserves a fair trial and all incarcerated people deserve decent living conditions. To which, you know, I would add, whatever you think of Diddy, due to him standing trial, they are still and he is still innocent until proven guilty.
Kayla Brantley
After listening to the Precious Muir episode, someone called mom writes, please do a question and answer episode, but then doesn't ask a question. Mom and anyone else, we are totally ready to do a Q and A episode. Leave your questions in the comments. Wrote about Precious. She kept going into these parties. She's taken no responsibility. It's because of people like her that did nothing. I don't know, Manmon, that feels very victim blaming. Don't you agree?
Marjorie Hernandez
Yeah, I agree. Precious was very clear about how little power influence she had during those situations. And the responsibility really rests on the alleged perpetrators, not the alleged victims. So I also like this comment from Murray Profini, who, after listening to our Larry Levine episode code wrote, quote, don't think this guy was a great addition to the podcast. I actually would disagree, respectfully, Murray. Larry. Larry was a tremendously insightful guest. You know, he's had a lot of experience inside and out of prison. But it's just a shame that we had to cut so much of his interview because he went all in. He went all in on that topic.
Kayla Brantley
Yeah, he sure did. And the person called mom actually commented again, saying, this is an excellent podcast. You both do such professional and excellent work. Mom. Thank you. Now just write some questions for us. We're ready to do the Q and A.
Marjorie Hernandez
Yes. Yes. Then we have Danielle, who, after listening to the Dion Best interview, wrote, I don't see relevance of this episode. Dion would not speak on any of the allegations that Diddy is waiting trial for. Well, that's true. And, you know, Dion had his own reasons for not doing so. But on our podcast, he did reveal exclusively to us that he is preparing to launch his own lawsuit. So again, Diddy has not been convicted of anything yet, and he deserves a fair trial.
Kayla Brantley
Then we have the comments online and on Instagram, which focus, perhaps understandably, on the more salacious and less verifiable aspects of the story here. Main comments coming up again and again are about which other celebs are involved alongside demands for them to be named and shamed, which, bearing in mind there's literally zero evidence they did anything wrong. Just, you know, a picture at a party does not prove guilt, so it seems a little presumptuous.
Marjorie Hernandez
Right. And back in those days, everybody, all the A listers, went to these parties, so. And also the alleged Epstein connection came up a few times with questions. Yeah, with questions asking if we could do an episode based on the comparisons on how they were linked. You know, my suspicion is no. And we would definitely not want to get into some of the wilder conspiracies around the celebrities, especially those who have passed away from pneumonia, like Brittany Murphy and Kim Porter.
Kayla Brantley
Yeah, we're gonna try to stay clear of the conspiracy theories. If there's no actual facts. Again, we are reporters. We will report facts, not just theories. Parents of individuals who attended Freak offs or were involved with Diddy. There's demands for them to be held accountable. Specifically about speculations about Diddy's sexuality. You know, it questions the credibility of the victims. You know, witnesses are being debated in the comments. There's a lot of suspicion about people, and especially, you know, some people who aren't of high status, I guess, coming forward after all this time that some people are really, you know, victim blaming and saying that they're cashing in and looking for fame. And then there also are calls for people who witnessed abuse at the sex parties and said nothing until now to be held accountable. So there's, you know, a lot of comments saying that people should be locked up for only speaking out now. And then there's some comments asking if Diddy's just the scapegoat. And like some of our previous episodes, we have spoken about how this is an issue with the industry as a whole, that this isn't just a Diddy issue.
Marjorie Hernandez
Right. And a lot of the victims who have spoken to us before have also said it took them years to have the courage to come forward on these alleged allegations. So we'll see how it unfolds during the trial.
Kayla Brantley
Marjorie, I feel like I really appreciate the Spotify comments because, you know, it's pretty constructive feedback. They're asking us questions, they're commenting on our delivery and reporting, which, look, I'm happy to take some constructive criticism that'll just make us better. But what's funny is that all the comments on Instagram and, you know, TikTok, it's like they haven't even listened to the show. They just go straight for the conspiracy theories.
Marjorie Hernandez
Yeah, I mean, obviously a lot of the. A lot of these theories have been out there, some for years and seems like in those other social media platforms it's gone a little bit wild. But it's interesting nonetheless to. To read all the comments on there as well.
Kayla Brantley
Yeah, we love reading the comments. However, we can't respond to all of them again. We have lawyers and we do not want to get sued.
Marjorie Hernandez
This has been great. We love receiving and reading your thoughts and comments, so please do keep them coming. And we are here for any questions that you might have. What would you like us to cover? What other trials are you interested in? Let us know by email. It's the trialailmetromedia.co.uk or you can WhatsApp us on/4477966, 5-7512 and start your message with trial.
Kayla Brantley
And as ever, thank you for listening Please share all your comments, suggestions and thoughts on the Trial of Diddy podcast on Apple or Spotify and follow us on TikTok at DailyMailCrime.
Marjorie Hernandez
Finally, a quick bit of housekeeping. We will, like the case itself, be going a little quieter soon, ahead of Diddy's trial in May. But please keep following the Trial of Diddy as we will for sure be dropping shows when new information appears. But in the meantime, we will be back next week with a full episode and a special guest.
Kayla Brantley
Goodbye Sam.
Podcast Title: The Trial of Diddy
Hosted By: Kayla Brantley, Germania Rodriguez & Marjorie Hernandez
Episode Title: Your thoughts! Questions! Theories!
Release Date: November 15, 2024
In this episode of "The Trial of Diddy," hosts Kayla Brantley and Marjorie Hernandez provide an in-depth update on the legal battle facing Sean 'Diddy' Combs. They discuss recent developments in his case, address listener feedback, and explore various theories circulating among the audience.
Marjorie Hernandez opens the discussion by detailing Diddy's legal team's recent actions. At [01:51], she explains that Diddy’s attorneys have requested his release from jail to prepare for his upcoming trial scheduled for May 5, 2025. They argue for his bail based on "changed circumstances" and "new evidence." The proposed bail package remains at $50 million (£39 million) and includes stringent conditions such as 24/7 security monitoring and severe restrictions on his communications, limiting contact solely to his lawyers.
Kayla Brantley reads a critical excerpt from the defense's court filing at [03:34], highlighting their dissatisfaction with the prosecution's handling of the case. The defense accuses the prosecution of leaking information to the media, which they claim jeopardizes Diddy's right to a fair trial. They emphasize the uniqueness of the case ("sui generis") and argue that without knowing the identities of the alleged victims, it is impossible to prepare an effective defense.
At [04:51], Kayla discusses the defense’s assertion that the government's case against Diddy is weak and lacks substantial evidence. She notes that while there has been a flurry of allegations in recent weeks, the volume has subsided, potentially indicating a strategic slowdown by the prosecution. The hosts underline that despite the seriousness of the charges, Diddy and his legal team steadfastly maintain his innocence, with a statement confirming that he has "never sexually assaulted or trafficked anyone" ([05:30]).
The hosts delve into the intricacies of the legal strategies being employed. Marjorie Hernandez points out the defense's argument that the case's broad and undefined nature makes it difficult to mount a robust defense. They describe the allegations as "salacious and baseless," seeking to undermine the prosecution's position and cast doubt on the validity of the charges ([03:34]).
Kayla adds that the defense is pushing for greater transparency from the prosecution, insisting that without knowing the specific details and names of the alleged victims, Diddy cannot effectively prepare his defense ([04:10]).
The hosts address several listener comments, beginning with supportive remarks. Christine praises the podcast, saying, "I'm really enjoying listening to this podcast. Marjorie has done a great job" ([07:21]). The hosts express their gratitude for such positive feedback, reinforcing their commitment to delivering thorough and factual reporting.
Some listeners have offered constructive criticism:
Missy Holland Chamberlain expresses frustration with the inclusion of music, stating, "Less music, please. It's kind of annoying. Sorry, but it is" ([05:30]). The hosts acknowledge this feedback humorously, balancing the need to maintain engagement with factual content.
Bainbridge nz complains about the podcast revisiting old topics without providing new insights, urging, "Please give more details" ([05:52]). Marjorie responds by emphasizing the importance of sticking to verified information, especially as the trial approaches, and avoiding unfounded theories.
HD criticizes the podcast for being "overproduced" and too entertainment-focused, claiming it speaks in a "slow and condescending way" ([07:57]). The hosts defend their balanced approach, highlighting their dedication to factual reporting alongside engaging presentation.
Some listeners have propagated conspiracy theories and victim-blaming sentiments:
Comments speculate on links between Diddy and other high-profile cases, such as Epstein, and question the credibility of the victims. The hosts firmly steer the conversation back to verifiable facts, avoiding engagement with unfounded conspiracies.
Sophia Gabini remarks that the episode seems "pretty tone deaf," suggesting that Diddy, being wealthy and powerful, will receive preferential treatment. The hosts counter by reiterating that Diddy remains innocent until proven guilty and that everyone deserves a fair trial, regardless of their status ([10:20]).
Marjorie emphasizes the importance of not blaming victims, stating, "The responsibility really rests on the alleged perpetrators, not the alleged victims" ([10:52]).
Listeners have also shared various theories and questions about the case:
Wendy 007 connects Diddy to other figures and incidents, mentioning "Sam Beckman freed and a recording studio in Tampa, Florida," and an "encounter with Diddy on the No Way Out tour" ([08:31]). The hosts acknowledge these remarks but emphasize that such claims need to be substantiated by evidence and will be addressed accordingly if they arise during the trial.
Mom requests a Q&A episode but also criticizes previous content, stating, "She kept going into these parties. She's taken no responsibility." The hosts address this by clarifying their role in reporting facts without victim-blaming.
Danielle questions the relevance of certain episodes, noting that guests like Dion may not directly comment on the allegations against Diddy. The hosts explain that while some guests may not address specific charges, their insights contribute to understanding the broader context of the case ([12:22]).
As the episode concludes, the hosts inform listeners that the podcast will maintain a quieter presence as the trial date approaches but will resume regular updates when new information becomes available ([17:06]). They encourage listeners to submit questions and suggestions for future episodes through email or WhatsApp, fostering continued engagement and community participation.
Kayla signs off with gratitude, urging listeners to share their thoughts on platforms like Apple and Spotify and to follow their social media accounts for the latest updates ([17:06]). Marjorie adds a final note about upcoming episodes featuring special guests, promising deeper insights into the case as it unfolds.
