We got a full house tonight, so let's get into it. Here's a story from the Minnesota Star Tribune. Woman who hurled racial slurs at boy found guilty in Rochester trial. So here's what. She gets $1,000 fine. A stayed 90 day jail sentence means she's not going to go to jail. She's ordered to perform 200 hours of community service. Now here's the thing. She's raised $860,000 after this. Now a lot of people are saying she. She deserves more. What's scary about this is here's the story. She's at a playground, her kid, she's. I think she was like 36 at the time. She's 37 now, a. An 8 year old black child starts going through her purse and steals a. A b baby food. She then run chase after the kid. Apparently the kid's dad chased after the kid and she allegedly. I don't know exact because there's no video of this. Called the. Called the kid a racial slur as he was stealing the baby food from her.

Yeah, well, I read all about it, but you know, I think it, you know, and I don't want to get all, you know, macro about this. If you look at this, she got very lucky. She got a, what, a thousand dollar fine, 90 day jail since stayed. You look at Chud the builder, a guy that was assaulted outside of a courtroom or whatever, you know, and then he shot the guy and now the guy can't get a bail bond. And there's people like Carmelo Anthony that actually killed somebody on a high school campus and was able to get a bail bond. But a guy that said the NW and that was attacked. So it seems like the N word is like the third rail. It's like the most powerful thing you can say and the most penalized thing that you can do. And they give it a lot of power.

It's more than that because if a white person is perceived to aggress against a black person, like it can be any, any number of things, right? Like, I mean, you look at the officer that was convicted of killing George Floyd, right?

Yeah, but so black people don't always get, get acquitted of crimes because if they commit them against white people. But if you're a white person and you commit some kind of transgression, it doesn't even actually have to be a real crime because I don't think calling someone a name should ever be considered a crime. Right. Even if it's offensive or whatever, there should never be any circumstance in which it's considered a crime. You know, that's just, that's ridiculous. We don't, we don't have the thought police.

And then like those guys, you're not, you're not familiar with any of those, those Locales. Well, long story short, there's a guy by the name of Daniel Larson that is mentally challenged. He's very famous. You can look him up and he's like kind of like World of T shirts where World of T shirts is bigger. He gets drun and like New York and has a big social media following. My point is he's mentally challenged and he went on his live stream on Tik Tok was like, I'm going to bomb the White House. I'm going to bomb. And he was, he was held in federal prison for two years and was just let out this week for saying that. And it's like, where does free speech draw the line? Well that's, it's like, is that, I mean, but technically, really, if we're allowed to say whatever we want, let's say we're under tyranny. Let's say, let's say the government is being.

Well, that was my first thought was look, if a kid's stealing from you at any age and you scream profanities at the kid, okay, carte bl. It's over. Done. You're not getting shot. Like if you walk up to an 8 year old and you start screaming profanities in the kid's face, you might get arrested for assault or some sort of aggravated claim.

You have. You have hateful thoughts and you express them and that means it's a thought crime. So it's about the fact that you are allowed to have bad thoughts.

Would have been a moral action to slap her. The distinction is because it goes to court and you have the government doing it. That's the distinction. It's not that, oh, she was fine to do it. It's that. It's that the government has a prohibition here in the United States. The government has a prohibition from enfor laws about thought or, or what.

So it's not reasonable. Insulting someone is just bad manners and morals.

I don't, I don't know what the, the hate, how they, how hate crimes are are actually adjud throughout the whole country. But generally the federal government or the government isn't supposed to be able to say you had bad, you had, you had hateful intentions. So we're going to go.

But Phil, let me, let me just say this. And this is a personal experience. I don't want to go in a long thing. So I had this First Amendment lawsuit that went all the way to federal court. I sued the county judge of Dallas and I brought up this Dallas Morning News article about how when he was in college, he got arrested for doing a panty raid. It went all the way to federal court. Like, you know, we just. I paid a lot of money in front of the jury. They even admitted they didn't follow the rules or procedure of their own meeting. They had one of the county commissioners kick me out and they had to take a vote if they want to kick me out unless the county judge does it. The county judge did not kick me out. They kept on talking about the Constitution. My attorney that I paid all this money went on this First Amendment. The federal government gives us the right to say this. My jury was four black women, one Hispanic woman and one white guy. You and I have different perspectives. We respect the Constitution. A lot of people do not respect the Constitution. They believe that that was written during the time of slavery. So they actually hate the Constitution. So they interpret the government exactly the opposite of basically how the majority of us interpret the Constitution.

You know, the left interpretation of the Constitution is that hate speech is not protected under the First Amendment.

And the right's interpretation is that it is. And the left's interpretation is rooted in the fact that blasphemy used to be illegal and that things that are considered objectionable or obscene can be. You can be criminally.

To Tim's point, like the left will, they don't care about the Constitution at all. They don't really believe any of it, but they will use things that have happened when they're functional because their goal is to exert power.

There is a, a generality on the left to do this and a tendency on the right to do it, meaning you see it a lot on the left and you see it often on the right. So they both do it. And I make this point all the time that I talk to conservatives and they're like, I believe in the Constitution. And then I say, oh, so you think blasphemy should be illegal? And then to be fair, some conservatives go, yes, absolutely. But many will say, no, no, of course not. We shouldn't be arresting. Well, the Founding Fathers thought if you blasphemed, you should go to jail. And they draft this free speech, but at the same time would lock you up if you insulted, if you were like, even Catholics didn't have rights in a lot of places. So they were serious. And for that matter, the Second Amendment, according to the Founding Fathers, did not grant you the right under state's laws to have weapons or protect you from it. If Virginia wanted to ban guns, they were allowed to do it. The federal government, the Constitution, Second Amendment barred the federal government from passing laws on guns, not from states. We've completely changed how we view the Constitution, even on the right. So conservatives will come out and they'll say, I believe in the Constitution, I'm an originalist, and then give you a textualist interpretation.

No, and I do agree with you, Tim, though. It is like an interpretation of what our Bill of Rights are. And people, like I said, they don't even believe in them. Right. Like they think the whole foundation of our government was built on the backs of slaves. Like, they hate our government. And I can almost understand their perspective a little bit, and I can almost empathize.

I can empathize if my great great grandmother was a slave, why I'd hate America. You know, I'm not.

That's my entire. That's my, that's to my point to what I was saying to Tim is like, they hate the Constitution. They don't like the America. And so when they say, oh, well, you know, the Constitution says, this Constitution says that it's not because they have any kind of love for the government or, I'm sorry, love for the country or for the Constitution. It's because it is a functional argument and a way to, and a way to win the debate.

But I have to, I have to point out that it, all of it only ever is a functional argument. It's just a question of how, how willing are, how willing are you in various situations to apply a functional argument? Right. My point is conservatives arguments on the Constitution apply to an America of the 1960s to the 1990s. And so it seems broad, but outside of the context of our past couple of generations, I would argue that they are as. They're as functional arguments as the lefts are. It's just a question of what we want to be in this country and what powers we are willing to use to enforce it. So, you know, it's fascinating because I was actually just talking with Lily Tang Williams about this. She said that in communist China, she goes to law school as a teenager and she's very much like the party, very excited. And then she was told by her professor that we are not a nation ruled by laws, we are a nation ruled by men. And that struck her when she began to understand what that meant, that the laws were just tools that could be used whenever they needed to control a population.

And at the end of the day, that. That is basically how all governments work.

Indeed, the question is how, how. What is the right willing to do to get the country they want? And the only really thing, real thing we're arguing is less so than the left is. The left is willing to exercise whatever power and argument they need to to win and gain power. And the right sometimes does.

And the reason I say it depends is because with the United States initiating it, you can lay, you can lay all the blame at the feet of the United States and say, well, you're the one that started it. So the, you downstream effects of you doing, you know, initiating this invasion is what started, is what caused all these death.

You have just created a Democrat district by doing so. This is what they're doing with illegal immigration in major cities, so that in Texas, you get more. Now, here's the crazy part. We don't choose our president by popular vote. We choose them by electoral college. So if California is getting extra congressional seats because they have illegal immigrants being counted in the census, California gets extra votes for the President. Indeed. Now, Alex's point, New Jersey just found 35,000 non citizens registered to vote, and they found 400 of them voting voted. The reason why. And I apologize for getting mad. I apologize to everybody.

The state in the late 80s, early 90s said we are no longer going to allow illegal immigrants to get access to public welfare. The illegal immigrants children revolted and voted to give welfare to non citizens. So this is the problem with mass migration. All of these people we see coming in illegally, they're going, they can't vote, but what they can do is take US dollars and send them back to other countries, stripping the economy.
