They discuss potential reasons for these delays and what they mean for providers in terms of time and cost; how a 2023 case from the Fifth Circuit, United States ex rel. Aldridge v. Corporate Management, Inc., illustrated excessive DOJ delays; whether Congress intended for these kinds of delays when it passed the modern FCA; and possible ways to improve the system.
