
“Jane” tells court Diddy is still picking up the bill

We've got one more week of the prosecution and then we're into the defense. Now a reminder, Diddy is on trial for charges of sex trafficking, transportation for prostitution, and racketeering with conspiracy. He denies them all. A warning. This episode contains graphic descriptions of sex. Yesterday, the woman who's testifying under the pseudonym Jane took the stand for the first time. She told us about the romantic start to her relationship with Diddy before he introduced the idea of sexual sessions in hotel rooms. Today, she was back in court. Okay, it's 5:00. Court is over. There is thunder crackling in the sky. So we've ducked into the bar on the corner of the street that is Refuge whenever it starts to chuck it down in New York, I'm here with the BBC's New York digital reporter, Sakshi Venkatraman. She's going to fill us in on what happened today in court with Jane Sakshi. The beginning of the day, a lot of what Jane was saying, it spoke to the RICO charge, like quite heavily.

Yeah. So today's testimony was very intense. You know, Jane's testimony has obviously been some of the most anticipated of this trial. And today we definitely saw that it spoke to the racketeering conspiracy charge. So one of the biggest things she spoke to was how drugs were transported to Sean Combs during the course of their relationship, whether that be to hotels for their sex parties or whether that just be to his different homes. She talked about one instance where she was made to pack a package of drugs in her check in luggage. And she phoned Christina Khorram Combs, current chief of staff at the time, and asked her if this was safe. And she said, Kharam said, I've done this before several times, like it's fine. So she eventually packed the luggage, got it from a security staff member and took it across state lines from LA to Miami to deliver the drugs to Diddy.

And that's really interesting because Christina is employed by Combs Enterprises. Right. Well, what Jane's telling the court is that Kristina is persuading Jane that it's okay to do that and it's safe and she's done it before.

Yeah. So we've heard Kristina Krom's name come up several times over the course of this trial from various staff members.

But then Jane's testimony Moved on to familiar territory, I guess you could say, talking about these days long drug fueled orgies with male commercial sex workers. Now, Jane referred to these as hotel nights. Cassie called them freak offs. What did Jane have to say about her experience with hotel nights?
Sakshi Venkatraman
So a lot of what Jane said mirrored what we've heard in Cassie's testimony about, about these male entertainers called by Diddy into these hotels and these marathon hours and days long sex parties where though she testified that she was uncomfortable, she was on her period, she sometimes had UTIs or cramps or other painful issues, she was made to carry on with having sex with these escorts. She said over the course of their relationship, which was only three years as compared to Cassie's 11 years, there were several different men, I think she named like three or four pretty explicitly and kept circling back to their names today. And they would repeatedly come over to different hotels, sometimes be flown across state lines, be flown across country lines. For example, on one instance, an escort was flown to Turks and Caicos from the United States, which also speaks to the RICO charge.

Yeah. And of course there's the transportation for prostitution charge that, that speaks directly to where they speak about foreign and interstate transportation. So she talks about these hotel nights. And Jane says that she didn't want to have sex with other men. She wanted to have sex with Diddy. But when it came to communicating that to him, she said that she put on a face, she put on a good performance, and she kind of made out like she was up for it.

Jane basically said there were times when she didn't want to participate, but she didn't say no. She put on a good face and made it seem like she was really enjoying it. She mentioned a couple of instances where she even organized these hotel nights herself in order to flee combs. And she still maintains that she didn't want to do it, but she says that she was doing it to make Shawn happy and she felt that's what he wanted.

The prosecution were asking her, you say you didn't want to do it. What were there physical reasons as to why you didn't want to do it? And she said she really laid out. I'd have to hold certain positions for hours. I would have to do certain sex acts for hours. And she spoke about soreness and back pain. And she went into that in some detail.
Sakshi Venkatraman
She said she experienced a lot of different physical issues from these and she felt that she needed to push through and keep having sex. She said that she experienced vaginal soreness, especially after these marathon two to three day hotel nights. She also said that she got UTIs every week, and sometimes she wouldn't be fully recovered from a UTI before she would be expected to have sex again. She also described the comedown from the drugs that she had been on. The ecstasy, she said was the main drug that her and Combs did during these sex parties. And she said the comedown would be depressing and he would often leave her alone. So overall, she described them as physically and mentally not very pleasant experiences.

A lot of the evidence that was presented to the court today was text evidence. And Jane said at the beginning I would communicate with him that I didn't want to do this mostly on text. What was some of those texts that she would send?
Sakshi Venkatraman
So she communicated pretty clearly in some of the texts that were read out in court today that she felt used by Diddy, that she felt that he only wanted to see her when he wanted to do hotel nights where he would see other girls he was dating for trips and dates and the gym and things like that. One text that she sent him that was read out in court today was, well, I don't want to do drugs for days and days and have you use me to fulfill your freaky, wild desires. I'm done being used by you.

Yeah. And we also had some of the responses from Diddy, actually a couple of audio messages that he would leave her on text, and they were played out, and we got a taste of some of the tone, some of the language that was being used.
Sakshi Venkatraman
So in his audio message, he pretty much shut down what she was saying. Said things like, stop comparing yourself to other girls. Don't talk to me this way. Don't disrespect me.

Yeah. And when they asked Jane to speak about these audio messages that she'd received from him, she said she found them dismissive or belittling of the concerns that she was raising or the fact that she just didn't want to participate in these hotel nights anymore. Now, she spoke a lot about being under the influence of drugs when she did these hotel nights and not helping her get through the experience. But she did say there were two times when she wasn't on drugs when she did these hotel nights. And she spoke about one in 2023. She wanted Diddy to stop using as many drugs. She was trying to get him off drugs and get her off drugs. And he said, let's do a sobriety party. But Jane detailed to the court that that was not an enjoyable experience for her at all.

Right. So Jane said that during this sobriety party experience. In fact, Holmes said he was using drugs. She said he took ecstasy and cocaine. And she was entirely sober. And she said it was a thoroughly unenjoyable experience. She felt like it was too real. That was her quote. And she didn't want to be doing it. Another interesting thing about the drugs at the hotel nights that kind of circles back to the racketeering charge is the description of the network of assistants and employees that would supply the drugs to them. She said that oftentimes if they ran out of drugs, he would just make a call to one of his assistants and a little while later, those assistants would show up at the door of the hotel with the drugs that he requested.

Yeah, at this sobriety night, she said after she was having sex with the second escort, she got sick and she threw up in the bathroom. And Diddy's response, at least in Jane's recollection of events, does directly speak to the coercive element of the sex trafficking charge.
Sakshi Venkatraman
So, yes, Jane told the court that Diddy came to the bathroom, saw that she had thrown up, and said something to the effect of, it's good that you're, that you've thrown up. You'll feel better now. Let's get back out there. The third guy is coming. And then they had a third escort join them at the hotel.

And we hear a lot of back and forth between Jane and Diddy throughout her testimony today. There were lots of text messages referenced saying she was unhappy, that she wasn't getting the romantic, deep connection side of their relationship and she was seeing him have that with other women on Instagram and voicing the fact that she wasn't overly thrilled to be participating in these hotel nights, but towards the latter stages of the relationship, they come up with this love contract. What exactly was that?

So what had happened was a month prior to this love contract, Jane had a birthday and Diddy took her out to dinner. And then afterwards she expected to be spending some alone time with him. And she says that he made her participate in a three day long hotel night with various different escorts. And she said that afterwards she was alone, coming down from drugs, and he left. And he left actually to go on a different birthday trip with a different girl who she says that she was watching alone on this girl's Instagram story as Diddy took her on a private jet to a private island and treated all her friends to this birthday experience that she, Jane, feels that she never got. So she actually cut off Diddy for about a month and they didn't speak to each other and they made up. They took a trip together to Turks and Caicos where she again was expecting to spend alone time with him. And again he flew in an escort from the US to have another hotel night. She said that really upset her. So after this trip, they came back to Miami and Diddy suggested this love contract. And that's how she phrased it, a love contract where he said, I'll give you an allowance every month for a period of a year. And she requested $50,000 a month. He came down to $10,000. They decided that he would actually do it for two years, and he ended up financing a new house. She said immediately after this love contract was decided upon, she went and got a huge, expensive house for her and her child.

Yeah. And there was an audio message played where Diddy refers to him being on his job and Jane needing to be on her job. And the prosecution prompted her to explain what she thought that audio message meant. What did Jane have to say about that?
Sakshi Venkatraman
Well, the love contract was supposed to be this resolution in their relationship, something that both of them were happy with. She even described at the beginning of making their relationship feel more equal, given the work that she was doing with the hotel nights. It actually ended up, from her perspective, causing a lot of issues. She said that there were many times where she. She felt that if she didn't do what he wanted her to do, the fact that he was paying her rent over her head in subtle ways, even going as far as saying in a message, look at the roof over your head. When she was expressing hesitancy about a hotel night.

Then the prosecution asked her a question. They said, who was paying your rent during this time? She said, did he? And they said, are you still living in this house now? And she said, yes. And then they said, well, who's paying your rent now?
Sakshi Venkatraman
And she said, did he? She said that Diddy is still paying her rent. And I think that's definitely something that's going to be coming up when the defense does her cross questioning. It's a pretty significant thing that, you know, while she is taking the stand for the prosecution testifying against him, she is still to some extent financially dependent on him.

And then finally she spoke a little bit about how this arrangement was working towards the end of their relationship. She told the court when she was on drugs, she'd promised him an all star meet up, meaning four of the different commercial male sex workers who were potentially their favorites would come. And she doing a hotel night with all of them. And she's trying to plan this and organize it, but it isn't going to plan and this causes some massive issues.

She said that she'd kind of been delaying on the promise to have that night. She said she wasn't feeling very well. She also said that she was on her period. She physically wasn't feeling well because of that. And in order to prove that, she actually sent pictures to Diddy of a toilet paper with blood on it of her bloody tampon to prove that she was physically uncomfortable. And he still responded in text messages that were shown to the jury and with some anger. He was upset that she had made this promise and she had basically not delivered on her promise to have this hotel night. And once again, the question of who's financing her came into her mind.
