Now she's using a pseudonym to protect her identity. She's one of the prosecution's witnesses in Diddy's trial for charges of sex trafficking, racketeering with conspiracy and transportation for prostitution. These are charges he's consistently denied.

So it's 4 o' clock. We're outside court. It finished a little bit earlier than we thought because it was going to end at 5, they said yesterday. I'm here with Isabella Gomez Sarmiento, the music reporter for npr. Isabella, the day started talking about not Jane, but the jury.

Yeah. So there's a motion to have one of the jurors dismissed for, quote, lack of candor. The defense is not in favor of having this juror dismissed. There was just early discussions between the judge and both of the legal parties.

Yes. I've been seeing a lot of stuff on social media and getting a lot of questions saying that one has already been dismissed. That's not true. But there has been ongoing discussion about a particular juror.

We'Re interpreting that to mean not disclosing all the information that may have tied them to the case or stuff they're posting liking, et cetera.

There's been reports on social media and in some news outlets that there was a juror in the courtroom who was reacting during some of the cross examination also reports that, you know, Combs was trying to interact with the jury. So there's a lot of speculation that that might be related to this motion to dismiss a particular juror. We're not sure. We think lack of candor probably means that there was something that the juror did not disclose that the prosecution just became aware of. And they think that that's grounds for having them removed from the jury.

Yeah, but they haven't made a decision yet. So the day started like that, and they went back into Jane. Jane's using a pseudonym to protect her identity. She's a former romantic partner of Diddy. The day picked up similarly to how it left off yesterday.

Yeah. So we started off going through the timeline of the relationship. Early on, we heard about Jane's birthday in February of 2022. She and Combs had a hotel night on that occasion, which she was not happy about. And then Jane's birthday was very close to the birthday of Caresha Brownlee, the rapper known as Yung Miami, who was also dating. Com. Jane saw that Combs had a much more extravagant birthday celebration for Caresha, took her on an island vacation, and she testified that she became very upset. And she said that was the first time she ever used the hotel night card. She threatened to not have any more hotel nights with him if he did not come back from that trip. So apparently Combs ended up coming back from the island vacation with Caresha a day early, and then Jane planned a big, extravagant hotel night for him for Valentine's Day. The defense showed photos. Obviously, the press and the public can't see the photos, but they had Jane describe photos of balloons and candles and all these lovely decorations. And then she said that she suggested having two entertainers at the same time for that particular Valentine's Day 2022 Hotel Night with Combs.

Now, that's really interesting, because if we remember back to her direct testimony, the messages she sends Diddy after reading Cassie's lawsuit is directly about two of her birthdays. And she said, you made me have hotel nights on two of my birthdays. So this directly undermines that assertion.

She had sent text messages after her birthday saying that she didn't want to have this hotel night. But what the defense tried to do was show that there was some going back and forth. Even though she would express that she didn't want to have these hotel nights or she wasn't happy, she would still go through with them in the future. And a lot of times she was helping plan out the details or Showing preferences in which entertainers they hired. And she said that that was because she felt like her options were either to go through with it or to face agitation and then still end up doing the hotel night. And she wanted to pick men that she felt safer with. But that was a big point that kept coming up in the cross examination today.

And another key moment is their next birthday, where she says she did a hotel night as well, which she also expressed was an issue for her. That came up again today.

That did come up again today. So her birthday, 2023. First, she had had a birthday dinner in Los Angeles with 13 of her closest friends. Tenny Garagos asked if Combs paid the bill, and he did. It was a $15,000 dinner. And then she flew out to Miami to spend her birthday with Combs. And she was staying at a hotel with a Nobu in it. And there were text messages of her asking Combs if they could eat somewhere other than Nobu. She suggested carbone or poppy steak. And she was saying, she told the court that she was trying to imply that she needed to be romanced out of hotel rooms. And Tenny Garrigo said, well, that's not what's written here. You're just suggesting other restaurants. And she asked Jane to describe the nature of the restaurants, that they're very expensive, luxurious restaurants, but they ended up eating at Nobu. There was photos that the defense showed. Combs had a photographer come and take photos of them together at Nobu. So I think trying to establish that he was trying to do something special for her birthday. They were spending time together, but it did ultimately end in a hotel night.

So similarly to yesterday, tell me how much a Bottega bag costs or tell me how expensive a Van Cleef necklace is. We have described Nobu's a high end restaurant, and he'd already paid a $15,000 bill for her and her friends. So that's undermining the idea that she said he never did anything nice for her.

Yeah, and that's what a lot of the testimony today was focused on. It was on looking at gifts that Combs gave her. It was on focused on times when they spent time together without a hotel night, times when they went on a trip, or, you know, videos of them spending quality time together. The defense was really trying to show examples that Jane was spending time with Combs outside of the context of these hotel nights and that he was sending her messages and telling her that he needed her.

Hotel nights and booking some of the male entertainers, she was also giving them performance enhancing drugs.

Right. So two things we learned today about her involvement in the planning of the hotel nights was that she would buy matching shorts at sex stores for combs and the entertainers to wear. And she said that that was because she was turned off by them coming in in their regular attire. And she also said that she would buy them performance enhancement drugs because she felt like that accelerated the action and she wanted to get things over with faster. She said she didn't enjoy the process of having to sort of turn these men on, for lack of a better term, and that she gave them these drugs in hopes that it just made the entire process go by a little bit faster because she just wanted to get it over with.

That lines up with her direct testimony. But the buying shorts is new, and then the planning it and then the booking specific people lends itself to the idea that she was an active participant. Obviously, with the sex trafficking charge, it.

Should have known or could have known.

That she did not want to participate or that she was participating as a direct consequence of force, fraud, or coercion. So that's what they're trying to establish.

It seems like that's definitely the intent. And again, Jane kept reiterating that she felt like she was choosing within the options that were given to her, and that she felt like there was no option other than to end up participating in a hotel night, Whether she just went along with it when it was first adjusted, or she kept saying she would have to face agitation and then still probably end up in a hotel night. But, yeah, the defense is trying to show that she was, you know, making decisions when it came to how these nights were executed, and that that means that she was perhaps a willing participant in all of this.

And we had Cassie's name pop back up again and a narrative introduced about who his feelings for Cassie during these hotel nights.

Yeah, so they talked a lot about jealousy throughout the cross examination, how Jane felt about Gina and about Carisha Brownlee and some of the other women that Combs dated when it came to Cassie, what they said. Tenney asked if it was true that Combs would write love letters to Cassie while he was taking drugs with Jane. And Jane sort of skirted around giving a definite answer on that. But what she did say is that Combs told her that Cassie was one of the greatest loves of his life. And Jane responded that he should not have let Gina torment his relationship with Cassie, and that that was a toxic pattern that he was prone to falling into. We know that Jane had a lot of issues with Gina during her relationship with Combs as well.

So they also showed messages similarly to how they did yesterday of her asking for material things and receiving them.

Yeah, they talked about how at one point he gave her a diamond bracelet and Tenny Garagos asked, because you wanted diamonds. Right. And Jane responded, I wanted Sean. But then Tenny Garagos pulled up a text message or a notes app entry where Jane had expressed that she wanted diamonds. So again, I think in the eyes of the jury, trying to establish that Jane was asking for things of value from Combs as well, and that it wasn't just a one way expectation.

And we covered the fact that there were breaks throughout their relationship. It was a stop start kind of timeline throughout the direct testimony as well. What narrative were they offering about how Combs would treat her during these breaks?

Yeah, I mean, I think they really tried to establish the narrative that once she expressed she was not ready to keep doing this, she no longer wanted to participate in these things, that Combs would offer breaking up and that she's the one that didn't want to leave the relationship, or that when they took breaks, that Combs left her alone, that she had an out, that she was able to walk away. Although at one point she did say that he was just saying that in theory, because at the end of the day, whenever they tried to take a break, that a week later he would be blowing up her phone or someone else would be blowing up her phone for him. And she said, you know, he would be back in my face and then I would be back in his love. So really describing this sort of cycle of being in and out of contact that could potentially serve the defense's narrative that this was just a toxic relationship and she could have walked away if she wanted to.

So we know that the cross examination is still going on. They think they're going to finish by Thursday morning, and then we'll have redirect and then Jane's got to get on a flight, an international flight. What have they said about who's coming next?

Yeah, we know the next witnesses are someone named Jonathan Perez and someone named Andre Lamond.

And then the prosecution is saying by Wednesday, next week at the earliest, they could be wrapped up. So we really are nearly there with the prosecution side of the story.

Yeah, that's right. They said that they're going to have a summary witness on Friday to help tie some of these things together for the jury, but that they're going to be ready to rest their case as soon as Wednesday, Thursday's a holiday, or on Friday. So we'll be hearing the defense's version of events pretty soon and then we should have a verdict within a few weeks.
