It's 5pm and court has just finished for the day, bringing the fifth week of Diddy's trial to an end. Now it has been absolutely, absolutely manic here today, but not because of Diddy, because of a different rapper. That's right, Kanye or Yay west decided to make an appearance and go and sit in the overflow and watch a bit of Diddy's trial. But before we get into things, a reminder, Diddy is charged with sex trafficking, transportation for prostitution and racketeering with conspiracy, all of which he has consistently denied. I'm here with Isabella Gomez Sarmiento, the music reporter for National Public Radio. Isabella, come on. Yay. He dominated the day.

Yeah, absolutely. You know, it was a really chaotic day in the courthouse, but it somehow wasn't really related to the testimony. Around mid morning after the first witness got off the stand, there was a break and all of a sudden there was a flurry of reporters running up and downstairs from the main courtroom to the overflow rooms. There was rumors that Kanye or ye was spotted coming into the building. Those were later confirmed. There's photos and videos of him arriving. Lots of reporters saw him. We think he didn't make it into the actual courtroom. What court security officers told us was that he watched in an overflow room for a while before leaving and that he was with Charlucci, one of Combs associates, his godbrother, who's been at the trial since the very beginning. But, yeah, I mean, the big headline of the day was Kanye was here. We know that he is very much in support of Combs. Has been making a lot of advocacy on behalf of Combs being innocent and saying this is a conspiracy against powerful black men. So it's not surprising he showed up, but it is also not surprising that that took over the whole headline for the day.

We'd heard rumors that he tried to turn up the day before, and then he actually made it in this time. Now he's tweeted also at Donald Trump, I believe, in the past, asking him to use his presidential powers to overturn if there is a conviction.

Yeah, we know that he's been advocating heavily for Combs. He did some live streams of them talking on the phone after Combs arrest an indictment. You know, he's made it very clear where he stands on this case. So, again, it's not surprising that he turned up. I think people were more so surprised that he came on a day where there weren't really any big witnesses and on a day immediately after we had heard so many rumors that he might be here. I don't think it comes as a surprise to anyone who's been following where he stands on the issue and who knows how unpredictable he can be.

And what took up the bulk of the rest of the day is we had Jonathan on the stand, who is an assistant. We'd heard about Jonathan first through Jane's testimony. She spoke about talking to him, sort of planning nights with him, helping set up date night in particular. What did Jonathan say when he got on the stand?

Yeah, Jonathan said he worked as a personal assistant for COMBS from December 2021 up until September 2024, which is when Combs was arrested and indicted. He said during cross examination that he actually still feels great about Combs and feels the same way about him than he did during his employment. And really during both questioning from the government and Combs defense, he talked about his job duties. He said that he would sometimes help set up these hotel nights. He called them king nights. Other people have called them freak offs. You know, these sexual performances with Combs and the women and the escorts. He said that he would sometimes obtain drugs or carry drugs for Combs. The same thing with cash. He said sometimes he would go with Jane, in particular, sometimes he would go to sex stores and help her pick out lingerie and heels to wear for these nights. And there was lots of text messages shown between Jonathan and Jane where Jane is actively helping plan these nights. Jonathan said he felt that Jane was a willing participant. From what he could see. He never saw her looking upset when he entered a room before a hotel night or after a hotel night, although he didn't seem to really know what went on in the interim. He said that was Mr. Combs private personal time. And he considered all of these things personal errands, although during redirect, the government declaring that he was being paid to do these things as part of his job.

And he also spoke about discovery of a video on an iPad.

Yes. So he said that at some point, like about a year into his employment, that some of the staff found a video of Jane, an entertainer, and Combs that was on an iPad that was routinely used by staff for business purposes. He said that he immediately flagged it to Mr. Combs, and he immediately flagged it to Christina Coram, who was the chief of staff or personal assistant that he reported to. And he said that he was just surprised to see the video here because he considered it a personal matter. And then months later, months after this incident, he had a conversation with Christina, who pulled him aside and said someone outside of the Combs Enterprises or Combs Global had gotten word of the video and she was trying to go step by step and figure out what had happened. He didn't know that conversation was being recorded. And the prosecution did play recordings that were obtained from Christina's phones. She was recording that conversation secretly, where she was just asking him to say who was there. Run me through everything. We need to understand how people found out about this video.

And so when he spoke specifically about Jane, we've just seen, I mean, tons of text messages from her to Diddy during her direct and her cross examination, where she expressed that she didn't want to perform. Her words, quote, perform in these sexual hotel nights. But Jonathan speaks specifically when he's buying lingerie with her and setting up for these nights. She never seemed reluctant.

Right. He said that he never interpreted her as seeming reluctant or seeming like she didn't want to participate. And that likewise, whenever these hotel nights were over and he was interacting with Jane, either via text or if he came into the room to help them get set up with IV fluids or food or anything, that she would just seem really tired, but that she didn't necessarily seem upset. And then during cross examination, they did show very loving text messages of Jane, asking Jonathan to do certain favors for her. And they called each other my love and used lots of emojis. They were clearly comfortable with one another and had somewhat of a relationship during the time that Jane was seeing Combs and that Jonathan was working for Combs.

And then, of course, ending on the fact that he still feels pretty positive towards Diddy.

Yeah, he ended his employment with combs around September 2024, which was the time of the arrest and indictment. And he said that at that time, there were so many legal issues, civil lawsuits, a federal investigation mounting against Combs, and he thought it was best to leave because he wanted to avoid the. This scenario of being called to testify in a criminal trial of his former boss.

And then for the rest of the day, I mean, we had Jonathan.

Okay.

We had Kanye. But sitting in the court at the end of the day, a lot of the conversation is about juror number six. If you haven't been following along, there has been a motion to dismiss juror number six.
Isabella Gomez Sarmiento
Right. So the judge and the prosecution were concerned about inconsistencies in this juror's answers about where they live. And they said that the bigger issue is not just where the juror actually lives, but. But whether the juror is also not telling the truth in regards to other questions, or whether the juror was purposely lying or hiding information in an attempt to remain on the jury. That this juror could possibly have some kind of agenda that would not make him qualified to be a juror on the trial. So initially, the judge did request to dismiss the juror. Once this was all discussed, then defense attorney Xavier Donaldson said that this is a juror of color, and the court has a lot to lose if this jury becomes less diverse. He said that he's been working in this district for 25 to 30 years, and diversity on juries has always been an issue. He said he was very proud to see that in this case, they managed to get a significantly diverse jury, and that he felt that dismissing this juror based on race could be problematic for the integrity of the system.

And anyone who's been following along with the podcast and listening to stuff that our resident criminal defense attorney, Sean Kent, says that jurors of color, jurors from an ethnically diverse background, tend to offer less convictions than white jurors.

One of the prosecution's arguments was also that there is data showing that black and Latino jurors tend to answer calls to serve on juries less, and that's part of their reason the juries are less diverse. They were saying that this wasn't really a concern to them about race as much as it was a concern about truthfulness. And, you know, the judge tended to agree. He said that this is exactly what alternates are for so that when issues like this come up, someone who's been attentive can jump in. But Donaldson was pretty insistent on his grounds that race and diversity is very key to this case. Obviously, this is a trial of a very prominent, powerful black man and cultural icon. And then the judge seemed to reconsider. The courtroom was sealed. So we don't really know what the discussions that were had about it were we don't know what the ultimate decision is. But your number six continues to be a hot topic issue.
