She was denied parole in December 2008 and again in December 2010; her next hearing is set for 2021.[1] Contents 1 Early life 2 Shootings 2.1 Prosecution 3 Aftermath 4 Parole hearing 5 See also 6 References Early life Diane Downs was born in Phoenix, Arizona, on August 7, 1955, to parents Wesley Linden (1930–2017) and Willadene (Engle) Frederickson.[2] She has testified that her father sexually abused her when she was 12 years old.[3] Diane graduated from Moon Valley High School in Phoenix where she met her husband, Steve Downs.[2] After high school, she enrolled at Pacific Coast Baptist Bible College in Orange, California, but was expelled after one year for promiscuous behavior, and soon returned to her parents' home in Arizona.[2] On November 13, 1973, Diane married Steve Downs after running away from home.[2][3] Their first child, Christie Ann, was born in 1974. Cheryl Lynn followed in 1976, with Stephen Daniel being born in 1979. The couple divorced in 1980 because Steve thought Stephen Daniel, known as Danny, was the result of an affair Diane had.[4] On May 8, 1982, Downs gave birth to a daughter through surrogacy. She named the child Jennifer before turning her over to her intended parents.[3] Prior to her arrest, Downs was employed by the United States Postal Service, assigned to the mail routes in the city of Cottage Grove, Oregon. Cheryl Lynn, shortly before her death, reportedly told a neighbor of her grandparents that she was afraid of her mother.[5] Shootings Downs with her three children On May 19, 1983, Downs shot her three children and drove them in a blood-spattered car to McKenzie-Willamette Hospital.[6][7] Upon arrival, Cheryl (aged 7) was already dead, Danny (aged 3) was paralyzed from the waist down, and Christie (aged 8) had suffered a disabling stroke.[8] Downs herself had been shot in the left forearm. She claimed she was carjacked on a rural road near Springfield, Oregon, by a strange man who shot her and the children. However, investigators and hospital workers became suspicious because they decided her manner was too calm for a person who had experienced such a traumatic event. She also made a number of statements that both police and hospital workers considered highly inappropriate.[3] Suspicions heightened when Downs, upon arrival at the hospital to visit her children, phoned Robert Knickerbocker, a married man and former coworker in Arizona with whom she had been having an extramarital affair.[9] The forensic evidence did not match her story; there was no blood spatter on the driver's side of the car, nor was there any gunpowder residue on the driver's door or on the interior door panel. Knickerbocker also reported to police that Downs had stalked him and seemed willing to kill his wife if it meant that she could have him to herself; he stated that he was relieved that she had left for Oregon and that he was able to reconcile with his wife.[10] Downs did not disclose to police that she owned a .22 caliber handgun, but both Steve Downs and Knickerbocker informed them that she did. Investigators later discovered Downs bought the handgun in Arizona. While they were unable to find the actual weapon, they found unfired casings in her home with extractor markings from the murder weapon. Most damaging, witnesses saw her car being driven very slowly toward the hospital at an estimated speed of 5–7 mph (8–11 km/h), contradicting her claim that she drove to the hospital at high speed after the shooting. Based on this and additional evidence, Downs was arrested on February 28, 1984, nine months after the shooting, and charged with one count of murder and two counts each of attempted murder and criminal assault.[11] Prosecution Prosecutors argued that Downs shot her children to be free of them so she could continue her affair with Knickerbocker, as she claimed that he let it be known that he did not want children in his life.[3] Much of the case against her rested on the testimony of her surviving daughter, Christie, who, once she recovered her ability to speak, described how her mother shot all three children while parked at the side of the road and then shot herself in the arm.[3] Downs was convicted on all charges on June 17, 1984, and sentenced to life in prison plus 50 years. She was required to serve 25 years before being considered for parole. Psychiatrists diagnosed her with narcissistic, histrionic, and antisocial personality disorders.[12] Most of her sentence is to be served consecutively. The judge made it clear that he did not intend for Downs to ever be free again.[13] Aftermath Downs' two surviving children eventually went to live with the lead prosecutor on the case, Fred Hugi. He and his wife Joanne adopted them in 1986.[13] Prior to her arrest, Downs became pregnant with a fourth child and gave birth to a girl, whom she named Amy Elizabeth, a month after her 1984 trial. Ten days before Downs' sentencing, Amy was seized by the State of Oregon and adopted by Chris and Jackie Babcock, who named her Rebecca. As an adult, Rebecca appeared on The Oprah Winfrey Show[14] and ABC's 20/20[15] discussing how she feels about her biological mother. She wrote to Downs in her younger years and has stated that she regrets it, regarding her mother as "a monster."[16] Downs was incarcerated at the Oregon Women's Correctional Center in Salem. She escaped from her cell in Oregon on July 11, 1988 by scaling an 18-foot razor wire fence. For ten days Downs managed to escape despite a 14-state manhunt before she was recaptured.[17] She received an additional five-year sentence for the escape. After her recapture, Downs was transferred to the New Jersey Department of Corrections Clinton Correctional Facility for Women after heavy lobbying from Hugi.[18] The Salem prison was located 66 miles from Hugi's home in Springfield; during her ten days of freedom, Hugi had feared that Downs would attempt to travel there in hopes of contacting Christie and Danny. Despite significant security upgrades at the women's facility after the escape, state officials accepted Hugi's argument that the risk of harm to Christie and Danny in the event of another escape was too great for Downs to remain incarcerated in Oregon. In 1994, after serving ten years, Downs was transferred to the California Department of Corrections and Rehabilitation.[19] While in prison, she has earned an associate degree in General Studies.[19] In 2010, she was located in the Valley State Prison for Women in Chowchilla, California,[18] but transferred out when the facility was converted to an all-male institution in 2013.[20] Author Ann Rule wrote the book Small Sacrifices (1987) detailing Downs' life and murder trial.[21] The book documents accounts by friends, acquaintances, neighbors, and her surviving daughter Christie, who question the quality of her parenting.[22] A made-for-TV movie also titled Small Sacrifices, starring Farrah Fawcett as Downs, aired on ABC in 1989. Parole hearing Downs' sentence meant she could not be considered for parole until 2009. Under Oregon law at the time, as a dangerous offender, Downs would have been eligible for a parole hearing every two years until she is released or dies in prison.[23] In her first application for parole in 2008, Downs reaffirmed her innocence. "Over the years," she said, "I have told you and the rest of the world that a man shot me and my children. The Marmite of the pandemic' CREDIT: GETTY There’s a startling lack of evidence to suggest face masks stop the spread of respiratory illnesses in the community, with the latest study from Denmark – the most comprehensive random control trial of its kind – concluding: “The recommendation to wear a surgical mask when outside the home among others did not reduce, at conventional levels of statistical significance, the incidence of SARS-CoV-2 infection in mask wearers.” No pandemic plan put forward by health authorities – until 2020 – contained the advice: “Make everyone, even the healthy, cover their face.” (Nor did any advise governments to lock up their citizens, but that’s another story). Until less than six months ago, both the World Health Organisation and Public Health England did not recommend them, with Jenny Harries, deputy chief medical officer, even warning that they could increase the risk of infection (something seen in a 2015 Vietnamese study). In March, chief medical officer Chris Whitty summed up the stance of most rational public health bodies around the world: “In terms of wearing a mask, our advice is clear: that wearing a mask if you don’t have an infection reduces the risk almost not at all. So we do not advise that.” Since March, no new scientific studies have emerged that warrant abandoning decades of scientific consensus. We’ve seen drawings of men urinating on one another, and videos showing particles moving around a person’s head, but nothing in the realm of properly conducted clinical trials. And yet... Masks are everywhere. In Spain, France and Italy, to name but a few, masks are obligatory whenever people leave their home (or hotel) – even in an empty park. In New York, such is their devotion to the cult, the “liberal” residents have taken to verbally abusing those who walk the streets bare-faced. A nationwide mask obsession doesn’t seem to do much when it comes to tackling the spread of the disease. Spain, France and Italy have battled with some of the highest infection rates in Europe, despite the mask mandates. Furthermore, draconian mask rules turn once pleasant streets into a dystopian nightmare. When I’m on holiday, I don’t want muffled conversations and a sweaty rag glued to my face. I want to be greeted with smiles, not rows of fearful eyes. So where can I go (after lockdown, that is)? Where are things relatively, dare I say, “normal”? Short-haul Sweden Normal rating 8/10 Can I go? Yes, but you will need to self-isolate when you return to Britain. Ah, Sweden. The Marmite of the pandemic. Some think it is the only sane country in the world. Others think it is conducting some dastardly experiment in herd immunity. Its status as Covid hero/pariah has taken a hit recently, with PM Stefan Lofven overruling state epidemiologist Anders Tegnell and introducing new stricter guidelines. Its health authority says: “The most important measure to avoid transmission is to keep a distance to others, maintain good hand hygiene and stay at home if you are ill.” Masks are only required on public transport and at the airport, and polling suggests 70% of Norwegians wear them rarely or never. Finland’s mask policy mirrors Norway’s; they are required on public transport and in airports, but nowhere else. Polling also shows it has one of the lowest mask wearing rates in Europe, with 58% using them rarely or not at all. King horseback In all the directions death is waiting. In all the places death is waiting. I have heard a very famous story, a Sufi story: A king dreamt. In the night in his dream he saw Death. He became afraid. He asked, “What is the matter? Why are you making me so frightened?” Death said, “I have come to tell you that tomorrow, by sunset, I am coming, so get ready. It is just out of compassion so that you can prepare.” The king was so shocked, his sleep was broken. It was the middle of the night; he called his ministers and he said, “Find people who can interpret the dream, because time is short. Maybe it is true!” Then the interpreters came, but as interpreters always have been, they were great scholars. They brought many big books and they started discussing and disputing and arguing. And the sun started rising, and it was morning. And an old man, who was a very trusted servant to the king, he came to the king and he whispered in his ear, “Don’t be foolish! These people will quarrel for ever and ever, and they will never come to any conclusion.” Now, everybody was trying that his interpretation was right, and the king was more confused than ever. Han sido cerca de tres mil asesinatos, perpetrados sistemáticamente desde el mismo momento en que la UP hizo su aparición en el escenario político, en 1986. Entre las víctimas, dos candidatos a la Presidencia, cientos de líderes regionales y locales, y muchos, muchísimos partidarios de esa agrupación. Como si fuera poco, la UP ha tenido que soportar, además de la política de aniquilamiento, una dolorosa indiferencia por parte de la sociedad y una escandalosa inoperancia por parte de la justicia colombiana. Para utilizar términos muy de actualidad, en el caso de la UP –tampoco– ha habido “justicia”, “verdad” ni “reparación”. ¿Cómo explicar lo que ha sucedido? ¿De dónde han salido las órdenes para “acallar” a voceros y seguidores de un partido político? ¿Por qué la sociedad y el Estado se han mostrado tan indolentes, cuando no molestos, ante lo ocurrido? La UP surgió de los acuerdos de paz entre las Farc y el gobierno de Belisario Betancur. Los dirigentes guerrilleros tenían la intención de contar con un brazo político propio, una estrategia nefasta, encaminada a multiplicar los frentes de acción de la insurgencia. En pocas palabras, la lucha no debía desarrollarse exclusivamente desde la ilegalidad –la guerra–; había también que aprovechar los espacios que ofrecía la vilipendiada democracia. Desde un comienzo, la gran prensa, la Iglesia, los gremios, los partidos tradicionales, el Ejército, se apresuraron a condenar a la UP por sus inocultables vínculos con las Farc. Razón no les faltaba, pues el brazo armado de la guerrilla pervertía el juego democrático allí donde la insurgencia tenía poder. Pero esos mismos sectores se mostraron mucho menos escandalizados frente a la política de aniquilamiento desatada por la extrema derecha contra la UP. Su indiferencia tampoco cambió cuando el partido, bajo la conducción de nuevos líderes que buscaban una mayor independencia con respecto a las Farc, empezó a criticar no sólo la “combinación de todas las formas de lucha”, sino la violencia como mecanismo para impulsar los cambios que el país necesitaba. Es decir, la guerra contra la UP no obedecía a sus vínculos con las Farc, como sostenían sus enemigos. Para amplios sectores de la clase dirigente, la creación y, peor aún, la consolidación de un partido de izquierda constituía una amenaza para sus intereses. En una alianza siniestra, miembros del Ejército, terratenientes, políticos locales, paramilitares, etc., recurrieron al terror para arrasar con todo lo que oliera a izquierda. Algunos periodistas, políticos y académicos han denunciado el doble discurso que la izquierda utilizó durante un buen tiempo. Pero también han sacado a la luz la guerra a muerte que libraron los sectores más reaccionarios contra la UP. Sin embargo, pese a todo tipo de evidencias, todavía son muchos los que se empecinan en negar los hechos. Ahora, a raíz de un libro sobre estos temas (Steven Dudley, Armas y urnas. Historia de un genocidio político, Planeta, 2008), en el que se analiza cuidadosamente una realidad bastante compleja, resulta, según algunos defensores a ultranza del Estado, que los únicos culpables son las Farc.
