It's funny how whenever you're setting something up. And I just have a little tripod for the microphone. I don't have. I don't have my boom arm. It's always, you know, whenever you're looking for something to build the studio with in a hotel room, it's always the trash can. For some reason. The trash can is always the perfect. The perfect device, you know. So I got. I got it on top of the trash can, exactly the right height. So, yeah, I'm here in San Francisco and we were here for John Memorial yesterday. But first of all, man, there were memorials all over the world, the meetups that were taking place. Horowitz did a big thing in Fort Lauderdale and. And he was doing like John trivia and he had prizes and all kinds of stuff. And we have. What do we have, Darren? Like five or six meetup reports already.

Which. Which I know you guys will. Will play later. I'm. I'm just. I'm literally so tired that I. I wish I could be here for the whole show, but I. This was yesterday. It just all came out, you know, it was like just the weeks, honestly, months because of John's earlier medical stuff and, you know, just dragging the cart along. But, you know, with. With lots of help from everybody and just really not know. It was closure. It was big closure for me personally, but it was. So, I mean, maybe let's just do it chronologically. We got in, we flew out Friday from Austin. So that by itself is just such a hassle, man. It's like an hour and 45 drive for us. And then, you know, Southwest was delayed and just all. So anyway, we get in, we get into the hotel and we come in. We're in like 7:30. And Dana Brunetti, who doesn't know him, Hollywood producer of the biggest movies in the world, and his beautiful wife Alex, they said, well, we'll come to the hotel, we'll grab some dinner. So I mean, we had great, great dinner with, with Brunetti. What? He and his wife. I never met him in person. Just a lovely, lovely guy. So no agenda. So anti Hollywood. He is one of us, man. I'll tell you that. He is one of us. And then the next day, everybody was coming in. We had Sir Mark and Dame Astrid flew in from Tokyo, which is just, you know, they are the Archduke and archduchess of Japan and the Japan Sea and all the disputed islands. And I mean, these people, they've been listening since episode one.

They've been with the show. And for people who don't know them. You should just look up Dytham Klein, Dytham Architects in Tokyo. They have done some of the most amazing buildings. I think they've probably done like 20, 25% of Tokyo's most beautiful buildings. Like the Emperor's Library. They did the. I think they did the Fender guitar building. The Fender guitar building. Yeah. Sony building. They've just done such amazing projects and they're just lovely, lovely people. He's British, she's Swiss, but they've both been in Japan forever. Also flying in for this occasion was void 0mark coming in from the Netherlands. Wow. He, I mean just. It was. I haven't seen him in 12 years. Last time since I saw him in person. Sir Patrick Coble. Of course. Sir Patrick Coble is everywhere. Every single place, anywhere there's something good, a meet up. Sir Patrick Coble is always there. So we hung out with them for a little bit, had a kind of a lunch. I really couldn't eat much. I knew I was going to be speaking. They had me on the lineup for this gig

so we all went to the chapel in Oakland. Beautiful. Just thing is like, I don't know, must be over 100 years old. Probably about 70 people there. And as you know. So Mimi said a few words. Eric the Shill came up with his wife Janelle from South Dakota. People know Eric the Shill. He used to do the back office before Jay came in to do that. And he was master of ceremonies. Then Marty Higgins, who wrote many of the jokes for John. And throughout the years he's been friends with Mimi, I think first for, I don't know, 40 years. He did the eulogy. It was kind of cool because he came to me later and he says, you know, I have something. And most of these people were as old as wood. I mean, they're all like in their 70s and 80s. I'll just be honest about it. And Marty's like, you know, do you remember when John was doing the Confucius stuff? I'm like, yeah, I remember that. Do you remember that, Darren or Larry, when John would open the show and he would do a Confucius says, I gotta find out he was doing this for maybe a month and they would be okay. You know, I think a Confucius says maybe is not the best thing for an opening. But anyway, so Marty comes up to me, he says, do you remember the Confucius says stuff? I said, yeah. I said, well, I wrote those. Uh huh. He said, you gotta understand the backstory. John called me up one Day and said, I got a great idea for a book. I got a great idea for a book. It's a comedy book, and it's just filled with Confucius says. And so. And Marty says, but I guess you didn't like it or something. I never knew it was supposed to be a book. John just was throwing this stuff at me. I'm like, okay. He gives me a list of 250 Confucius says that he wrote for that book. And they are so. So they're. Most of them. I can't even read on the air. I mean, when it starts with lesbian who curl hair. I mean, no, I'm just gonna leave that one where it is. But, you know, so that's.

Did he do it with a Chinese accent?

Just. Just. John did it. John did. Tried to do it with the Chinese accent. That may have been part of the problem, now that I think about it.

Yeah. And anyway, so Marty does the eulogy. Funny. He's a. He used to be Marty in the morning. You know, he did radio. Morning radio back in the late 70s. So these are all just really interesting people. Then Brandon J's husband spoke, and he just had a lovely bit about, you know, how he asked John if he could marry Jay twice. And you can only imagine how hilarious that situation went both times. Then I did my piece, and then they had kind of an open mic, which was appropriate because there were comedians and there were just wild and wacky people there. So Voyage Zero was phenomenal. You know, the sysadmin who's always quiet and doesn't say much, and he just kind of sits there and makes everything run. Yeah, man. Void Zero. We almost had to give him the hook. He wouldn't stop yet. He had written 10,000 words, but it was all so. It was. Oh, but it was all so beautiful. And. And, you know, you could just tell how everyone had been affected by John. And then you got like the old PC Mag publishing days, which Mimi doesn't even know them, that predated her and John's relationship. There were stories about how John had ghostwritten the first book by Adam Osborne. I mean, this is going back, right? Guys who were. Than the original deck Day of Computing. And everybody kind of had the same basic story about John where he'd call you up and go, hey, that was how John called you on the phone and never called me. But the one time he did. Hey, D. And everybody had very similar stories. Some people were just like, wow, that these guys exist. You know, that they really. They're from these old computer days. And they had stories about just like, you know, devices and peripherals that you'd recognize and how John was, you know, just always all on top of this. And a common theme. You know, people might often get the. And I've always known this. But it was said so perfectly by one of the speakers that John. It always sounded like he was just crapping on everything. You know, like the mouse and the. And the iPad and the Apple watch and all this stuff. The point was made that John actually, because of how he wrote about these things, drove people to make better products.

And I think that's true that, you know, the. Just the way he would just. Just drive a wedge into anything that people were trying to make that was cool. Including myself, by the way, when I would be so proud of the Howard Stern interview I did. And he said sucked. It sucked. You didn't mention the show. Didn't mention the show enough. I don't think he even mentioned me. You know, just on it. But. And it made me better. And that was a very, very clear message from everybody. There was a. Oh, yeah, a couple of older comedians.

Even with the art stuff. I mean, Dvorak was great. If he liked my stuff, it wasn't any. Anywhere near as fun.

Exactly. And, and, and I, I guess I knew that inherently, but it's not until people started saying it that he was so. You know, John could have been a multi, multi, multi millionaire because he had inside dirt on all products. He could have gone to work for any company, told him how to do it, but that wasn't what he did. He wrote about how these products sucked because he felt they could be better. Now he didn't necessarily always say it would be better if. But that was. That really was a big part of his role in the world. And I really came to appreciate that hearing that yesterday. Oh, yeah.

You think about the world that he actually molded with his words at the back of those PC magazines and elsewhere. Yeah, it is quite amazing.

It all kind of came together for me when Sir Patrick Coble and many of the no Agenda producers and artists were in on this and they helped crowdfund it and helped find the different knickknacks. I posted it on X. Sir Patrick Cole made two shadow boxes. You know, shadow boxes. But I guess typically, like, you get one if you served in the armed forces or you had a child who was killed somewhere in the armed forces. You get this beautiful wooden box with glass in front and has the flag and their medals and their picture, et cetera. And Neil Patrick's an ex Marine and these things. You've got to zoom in on this picture. It had just all these different artifacts of John and of me and of no agenda, including a, an ho scale model of the Zephyr that had one of the, you know, a mouse in there. It had MTV patch, it had a first gen iPod. You know, back in the day when John was taking digital pictures and always saying, your camera, your camera, your phone's camera sucks, why do you use that? Of course he was trying to make that better. And it did get better over time, you know, little handheld digital camera, one of his Dvorak speaking typing tutor software packages. I mean, just, it's such a lovely, I mean I, I couldn't hold it together, man. When he gave that to me, it's like. And he even had it custom made for a suitcase because it had to fit in the suitcase for us to take it back.

There really is nothing like it in the world. Let me see if I got everybody in here. Well, so what was I. There was something, another point I was gonna. Oh yes, the Victoria Rokanye. I don't know if you know who she is, she's like the CBS CBS LA entertainment reporter. And I actually had forgotten this, but the one time I went to John's house, the one time I was invited and not allowed to go see the studio was a Thanksgiving and he'd invited Victoria as well. She's this really cute Asian LA reporter and she's like an undercover Republican. Catholic, of course, could never let on about that doing her job. But John knew all about her and she and several other people, I mean, would just stand up and say, you know, people don't understand how John helped me in my career. He would give me same thing that he's doing for the PC industry. He would critique my work, tell me what to do. But he would also make connections like, oh, call this person now, they're waiting for you. He helps so many people further their careers that people don't even know about. So just, I mean, just unbelievably beautiful to hear all of that. We've had a slideshow, you know, there's the little urn sitting there, which I always find creepy. You know, John's in there. There's no way he fits in there. His kids were there, of course, and then we all walked down the street to Kona Bar Kona, which is like a tiki bar. The lovely folks from Violetta Pizza, who have a place right across the street, they brought in pizza. You know, everybody was just hanging out and. And just. Just having a very, very, very good time. Dame Rita from Sparks, Nevada, showed up. I mean, just. It was mind blowing how much love there was for John. And I think it was really good that we all just got to have some closure at this point. And, you know, at a certain point, Tina looks at me and she says, am I going to have to carry you to the car? I say, yeah. So we just had to go home. And like, now I'm staying here today. There's a lot of paperwork I've got to help Mimi with, because you can imagine not everything was all set up for this, for this moment in time. So we have some, you know, bank. Bank stuff to do. She can't act as bank accounts.

We got the passwords. We got. Because, you know, she had always said, john, well, what if. And John said, nah, you'll figure it out. Well, we're figuring it out. We are literally figuring it out. I mean, can you believe that?

Yeah, we're figuring it out. So it was just great. And I'm so looking forward to hearing the meetup, the meet up reports from everybody from around Gitmo Nation. And without exception, everybody says, hey, I really like this combo of Darren and Larry and Adam coming in. So there's something going on here that, like, Sir Patrick Cobal had a. I thought an interesting idea that, you know, if people. We have so many boots on the ground, it's one of the secrets of no agenda is we have somebody who's an expert in whatever the story of the day is. And it's so easy for everybody to just record something. Maybe if there's something going on, you can send it in. There might be a way to work that into the show, I think. Darren, you already got three or four different new openings for. For the show.

It was Just pure talent in the way he played.

And I had to laugh, laugh like hell, because a couple of times during the show, the hotel is located in a little dinky town called Uncasville, Connecticut. Right. And a couple of times he was doing songs and he would shoehorn in the words Uncasville, Connecticut. And so when we left, I turned to my wife, I said, I. I said. I said to her, why the hell did he keep saying, I can spell Connecticut?

In the early days, you actually could take the gold or platinum record out of the case and you could play it. However, you had to play it backwards because it was a gold or platinum plated version of. I guess they call it the mother.

But I have a lot of the old school platinum and gold records, and they all have a little cassette stuck to the right hand, bottom corner, you know. Cause it also sold on cassette back in the day. And those, of course, over the years have, you know, come unglued and dropped and they're kind of loose in the case. And it's just. No, it's.

You know what's crazy? You know how Spotify. Spotify is in a very difficult position with podcasts because they are also, you know, owned by Major. I mean, it's public company, but a lot of the insiders who own shares early on were the publishing companies and the record companies who own the rights to all this music, which is why, you know, artists, you know, really don't get paid very well because they don't own their publishing. You know, SoundExchange came in, and so there is some money, but that whole. The whole system is screwy because they just put it into a big pot and then they divide it up by plays. So the whole thing is corrupt and no good. But we were never on Spotify with this show because they. They had an early contract that said, first of all, signing a contract with basically a podcast app. I'm like, no, that's not gonna do that. And they'd put us on and they could play in front of our podcast. Like, no, I don't want that. So I went through all kinds of hoops to get us taken off. And we finally got taken off. Then I guess it was like a year ago or something, and we were talking about, I'll put us back on Spotify. Which of course couldn't happen because somewhere in their database it said, never import this feed because those guys are dicks. So you don't want them. They got that undone. But then we've had episode after episode taken off because of a violation of music copyrights. You cannot have any music in your podcast on Spotify. And at first I thought it was, you know, just any music that was detecting something. I know that we. We have some songs that are technically completely legal because it's parody of an existing song and it's within the context of the show. So we're not releasing it as a separate entity. But the other day I got two, and I'm like, what is going on? What are they striking us off? You know, you can appeal it. Yeah, I'm going to click that link. No, whatever. You should use a real podcast app. What's happening is people who do end of show mixes are also submitting their songs to Spotify for people to enjoy them. So now we're in the Spotify music database. They see that we're playing that on our show. Boom, violation, you're out.

See, I would have thought it was Sir Chris Wilson, because he's done a few parodies that are, you know, again, songs that everybody would know, but putting his spin on it, which that I kind of understand getting clipped for. But, yeah, not. Not. AI had to.

I had to research, and I'm like, oh, I see what's happening. But, you know, again, if Spotify were. Were doing the right thing, then, you know, not just doing algorithmic detection, you know, we have. It is completely within the fair use clause of the copyright law to do a parody of an existing song within the context, you know, not releasing it ourselves, but within the context of a. The guy lived in Philly, I think. And, you know, so he'd be. For a week, he'd be at Z100 and. And when he wasn't doing his little shtick, he'd call these other 15 stations and the next week he'd be in San Diego or wherever. I mean, the guy had an unbelievable gig just, you know, being this one character on all these radio stations. Back when radio stations were local, you know, when you just had a local station, you had your local guys. Now it's like Elvis Durant in the morning, Good morning, San Francisco, Good morning, Dallas, Good morning, Philadelphia. You know, become so homogenized and crappy that I'm glad that we have a podcast like ours.

I mean, Willie Nelson out there in his 90s now. Playing it's like it's a dying breed. That's for hope. I'm hoping it comes back because you can't replace it with. I saw Willie again many years late, many years later in LA in a little club 20 miles north of my house called. I forget what that was called. And Willie was much. Obviously we were all much, much older by then. And he did his show like he was under sniper fire. I mean, he didn't even wait for the applause between songs. It was like. So it must have been like a la. Cause it wasn't announced. It was suddenly a last minute thing. I'm driving down the Ventura Freeway and I see appearing tonight, Willie Nelson. I'm a Willie fan. I'd had known of that if there was advance notice, but there was. So somebody must have dropped out. Willie was in the neighborhood and they said, do you want a gig? That's probably how it went down. And he's probably. He was probably pushing 80 by then, you know, and he's not Billy Idol. He didn't quite look that good. And so at the end of the show, it's swarmed by chicks who are, you know, 21 to 30, leaping up on stage, handing him sharpies and pulling down their tops so he can autograph their boobs.

Says he raised millions of pounds for various charities, overcame a brain tumor while completing his PhD. Then they found out that there were hundreds of passages in his dissertation that were plagiarized. Right. So he didn't dispute being a plagiarist. But what he did say, he defended himself by saying that he had not received adequate supervision during his PhD given his autism and learning disabilities.

But a recent National Park Service assessment points out the structure would change the views of dozens of historic sites like the ballroom. There's a lawsuit aimed at blocking the architecture. President Trump is also having a new helipad built for Marine One to land on the South Lawn. And there are reports he's already changed his mind a few times on that. Shannon. After construction has already gotten underway. No. When Donald Trump would never change his mind about anything. Whatever. No, it would look better there.

But they are pointing out one thing that's starting to come out with this story, which is there seems to be a much different take legally based upon if what's being built is above ground or underground. The courts are seemingly pointing now like he can do whatever he wants underground because it's security, blah, blah, blah.

The above ground is where the real problem comes into. Some people don't want the ballroom. And the the report here is correct. There is no other point in history where this kind of massive change was enacted by the president without having some congressional approval. But the difference is, and this is where the courts are going to come in, because I'm not a lawyer like Rob the constitutional lawyer. I have no idea if it was because Trump needed the funding from Congress to build it. And since he got the funding privately, he has the ability or if he still needs somebody else's approval even if he's got the money but this, of course, same story. This is the very Trump unfriendly. ABC President Trump's White House ballroom project is hitting its biggest roadblock yet. Appeals court today issuing a new ruling blocking further construction of the that $400 million ballroom saying only Congress has the authority to approve changes to the historic structure. Our Stephen Portnoy has been tracking this for us. And Stephen, I want to start with this. What is the essence of the judge's ruling here? What is the essence? Yeah, it's kind of like what do you make of it, isn't it?

Basically this 2 to 1 ruling from the D.C. circuit Appeals Court was that the White House does not belong to the President, that he is not the owner of the Executive Mansion, that he's merely a tenant. And in this two to one ruling, the Obama and Biden appointed judges who ruled against the President said that quote, whether or not a massive ballroom should be constructed is for Congress to decide and is not a matter for executive self help. And so the bottom line is the judges are saying that but for security or safety related things, the injunction that was imposed earlier this year by a lower court has to go into effect now. The ruling itself is paused for two weeks and that's to allow for the President, if he decides to do it, to appeal, which he said today he's going to do.

Well, and Stephen, where does that leave this construction project?

Well, it's important to point out a couple of things. One, as I mentioned, the appeals court itself put in place a two week stay, a pause to allow for the President to appeal, which he says on social media today this unjust decision must be overturned by the Supreme Court in its entirety. The President says he's going to immediately appeal it to the Supreme Court. There's another step he could take if he wanted to, and that's called en banc review, which would have all the judges of the D.C.

Appeal it to the Supreme Court. There's another step he could take if he wanted to, and that's called en banc. Review, which would have all the Judges of the D.C. circuit looking at it. But the presidency is going to go right to the Supreme Court. And he also pointed to what his own appointee, Naomi Rao, said in her dissenting opinion today, which is that the National Trust for Historic Preservation, which brought this lawsuit, doesn't have standing to sue. That was an argument that the administration has been making throughout this litigation, but was rejected by the majority, which said that the Congress has to vote to authorize this project, which the President has not really directly asked lawmakers to do.

Yeah, which is a very good point as well. I hate to agree with abc, but there's been a lot of things under this second Trump term that the easy answer seems to have been go and get it passed in Congress. You control the House, you control the Senate.

This really gets at the security and safety exception. And you know, Judge Richard Leon of the District Court, who looked at this earlier this year, said the President is making an argument that this ballroom is necessary for national security. The President demolished the east wing of the White House that historically had a bunker underneath it that dated back to World War II, FDR's time. Well, now the argument is that bunker needs to be replaced. And so the judge earlier this year said, all right, we will allow you to continue building those parts of this project that are necessary to the security and safety of the President. The appeals court judges today affirmed that one of the things that Naomi Rao, the dissenting judge, said in her opinion is the idea that now the district court judge, Judge Richard Leon, is going to be required to review various parts of the plan and discern for himself what is or is not security related, which essentially would have the court micromanaging those decisions. That's what Naomi Ra believes. And the administration, I think, believes it's going to have a strong argument in that respect going to the Supreme Court on it.

So it seems if you really finally go through all of these reports and there's still one from cbs, you're going to understand that, that the Trump people are just going to say, and they pointed out in the ABC report, the bunker is World War II or previous. Yeah, I'm guessing it needed some upgrading, I would think.

The President didn't have the authority to do this on his own. Congress has full oversight of federal property and how money is spent on it. This is in essence, remember, a national park and Congress oversees the National Park Service.

And this priest who is like, you know, very gay, started his sermon, and the sermon was Jesus is my Lover. He never got graphic, but he described sort of the things he wanted to do with the king of kings.

On average they're spending between 2000 and 2100 hours a year on their screen. It is just, we just haven't seen the like of it before. How were they able to, to survive? That's. Yeah, well, there's what the story says. There's a woman, you know, they interviewed this woman named Kendall something and she remembers a moment, she swapped her smartphone for a flip phone. She said, quote, for me, the second that my iPhone was gone, it was just like heaven on earth. She's a 23 year old Washington, Washington D.C. resident. This is with CBS News and it says she's among a growing number of young people. Okay, I don't like my smartphone. I was thinking of doing what Adam did. Young people are ditching their smartphones in favor of stripped down dumb phones in an effort to unplug from social media, et cetera, et cetera. Some feel nostalgic for an era they never knew before the advent of mobile devices. So then what Mike said is buttress by the American Psychological association which showed that the US teens spending nearly five hours a day on social media. And yeah, you're right. She, this chick got her flip phone from Dumb Co, if you heard of that one.

Isn't that good? Dumb Co, a startup that sells devices loaded with practical tools like Uber Maps and Spotify, but no social media. And this Dumb, Dumb Co, it's got more than than 5,000 active users and it's. Now this is the, you know, this, this deserves fanfare. Its typical Customer is a 24 year old woman. How about that?

So if you want to use something like Signal or Telegram, they'll allow that. But then they don't allow. Although you could probably hack it. I mean all these things are hackable, but they'll allegedly don't allow Facebook and Instagram and all of the social media because the social media is where people start going down those rabbit holes that are not beneficial. And it's. No, I mean, again, I know we're the old guys, we're the boomers. When we were kids, we used to hop on our bike and go to a friend's house without even calling first.

And I'm. I'm sorry, I shouldn't say, of course, in this case, because there's some Republican attorney generals going after the exact same thing. You're probably going to have to use your smartphone to take a photo of your driver's license with, you know, and here in the US on the back, you've got the barcode. It's very worrisome that when they compared sunscreen users to non sunscreen users, the sunscreen users faced increased risks of all the major skin cancers. Melanoma, squamous cell carcinoma, and basal cell carcinoma. So all of these cancers were up. But the most worrisome finding was that invasive melanoma was 300% higher risk in the sunscreen users.

If you really have to use it, if you'll be out in the sun for, you know, six hours, mid summer day, you. You still want to use something I would use zinc based sunscreen, not Oxybenzone, none of those hormone disrupting. Wow.

All of their contracts have gone up. They're all making more money, but they hate her because she doesn't look like them. Because she doesn't share the same, you know, sexual preference that they do. It is insane.

And it's funny, but for somebody like Ariana Grande, I mean, the negativity might actually cause a problem. And you know, oh no, I gotta, I gotta be, I gotta be perfect. I gotta achieve whatever the goal is in this social media with kids that do nothing but sit at home on their screens rather than going out and having conversations with their friends and not worried about what anybody outside of their little group cared about. I mean, that's. I didn't have the ability to see that until the Internet rolled around. And by the time the Internet rolled around, I mean, it really became prevalent. You know, I was already in my 30s, so by that point you have a whole different skin on you to take the people that are going to be haters. But it's horrible. I mean, I don't have kids, so a lot of people like, oh, you shouldn't even comment. But if you can see it, it's dangerous. It's bad.
