Hi and welcome back. Welcome back to the Carol Markowitz show on iheartradio. My guest today is Molly Hemingway. Molly is editor in chief of the Federalist, senior journalism fellow at Hillsdale, a Fox News contributor, and the author of the excellent new book the justice who Reshaped the Supreme Court and Restored the Constitution. Hi, Molly. So nice to have you on.

It's great to be here with you, Carol.

[Carol Markowitz]

Molly's also one of my all time favorite people and I'm so thrilled to be doing this with her. We were just talking before the show that her husband Mark Hemingway had and you know, we want to make a complete Hemingway set here.

You get the lesser Hemingway this time.

[Carol Markowitz]

So tell me about Alito. I feel like he's a very understated member of the Supreme Court. And you writing a book about him was sort of almost surprising to me.

[Molly Hemingway]

Well, it's kind of why I wrote the book was because I feel like nobody knows anything about him. And I had previously co authored with Carrie Severino a book on Justice Kavanaugh. And when we wrote that, we interviewed tons of people, including people on the Supreme Court and Alito's own colleagues and other really influential, interesting people. They all wondered why nobody writes about him because he's so significant. And you see that even, you know, recently he authors this massive decision against racist gerrymandering. You know, he's the author of the Dobbs decision. He is the author of Hobby Lobby. Even when he's not authoring an opinion, he's considered the most effective, along with Elena Kagan at oral argument. You know, that's where the justices kind of try to make an argument about what the case should be decided on. But he's so quiet and he's so reserved, nobody knows about him. So I was like, well, I wanna know more about him. So decided to write the book. And I'm really Glad I did because I'm learning that a lot of other people wanted to know about him as well.

Did you get to know him pretty well?

[Molly Hemingway]

In writing this, I've had the opportunity to interview quite a few Supreme Court justices, including for this book. All of my conversations are always on background and I just keep it that way.

[Carol Markowitz]

I love that. Any interesting tidbits in the book that surprised you?

[Molly Hemingway]

Well, there were really big things that surprised me about how Elena Kagan handled herself after the Dobbs leak. But on a more personal level, I just loved, you know, I interviewed a lot of his former clerks, some of whom were like, you know, now judges or people in high positions, I should say. And they had these really touching stories about his very dry sense of humor, how thoughtful he was towards to his staff and clerks. Each year the clerks do like a review show at the end of the term where they kind of poke fun at different chambers. And one year the clerks did one for him that was making fun of how he's very expressive with his face. Like he'll get in trouble sometimes for rolling his eyes or he once mouthed the words that's not true or simply not true. At a State of the Union when President Obama mischaracterized a decision, the clerks always say they can tell how debates went among the justices. Cause when he returns from doing that, they can just see on him, was he happy or was he sad? But they did a World Series of Poker where the whole.

[Carol Markowitz]

I was gonna say I don't think that he's gonna be a great poker player.

[Molly Hemingway]

So the whole thing, they had someone playing Justice Alito and if he got a good hand, oh, he was beaming. And everybody else folds and if he got a bad hand, he would be glum and people would, you know, would go for more money. So he's, you know, just kind of getting those kinds of details and just seeing how the court is behind the scenes. Like, we know a lot of what happens at the court, but we don't know what it's like on a day to day basis. And getting to tell those, those behind the scenes stories was fun too.

[Carol Markowitz]

Has the court become your personal beat? Like, I feel like you're very into the Supreme Court and who they are and what they do and kind of the background stories about it.

[Molly Hemingway]

Yeah, no, definitely not. But I do, I do love covering the court and I do love reading. I'm one of those people who reads the opinions and the dissents. I have, you know, just like take delight in it. And I have loved covering the Court. And I love also, since most of the reporters who cover the court are from a left wing perspective, being able to not be from that perspective and cover the court, I think is important, particularly since the left wing is really just those three justices now. And that leaves a lot to be explored by reporting.

[Carol Markowitz]

A reporter at Reason magazine, Nick, yesterday was saying that he was gonna interview Gorsuch, and he said, you know, what should I ask? And I suggested asking, are you bitter that Molly Hemingway hasn't written a book about you yet? Do you think you will go down the line?

[Molly Hemingway]

I don't know. I always write books only when I think they're necessary. So when Carrie and I wrote the Kavanaugh book, we knew what was gonna happen because we, you know, she clerked for Clarence Thomas. And when Clarence Thomas went through what he went through, most people came out of that believing Clarence Thomas. But the left, they always, you know, they write books, they do documentaries. They just keep going at a narrative until they convince people. And we knew we needed to get the history down. And so that was like, just, you gotta do it. And I love doing that. That's where I really got into covering the court. And then for my book on election administration, again, I was like, what happened? I need to know. And so on this Alito, I do feel very strongly that the country does not recognize him like they should. And I wanted to tell his story, get into his biography, explain his jurisprudence, and also put him up as a model for the right. Right now, like Carol, you see these people who are. They just say, like, you gotta win at all costs. You gotta have power and you gotta deploy it, and that's all that matters. And then you have people who are like, all that matters is that I discuss philosophy in my quiet library. And he really blends those two. He says, you know, yeah, we have principles, we have values, we have this philosophy. And also we're serving people here. And so showing how you can balance those things instead of viewing them as in conflict, I think that's something the right could definitely learn. But also just Americans in general, that these are both important things to have.

[Carol Markowitz]

I think you blend those two things very well also.

[Molly Hemingway]

You have a really natural curiosity about you. You always seem to want to know more about different topics, and I think that makes you a natural journalist. But what would you be doing instead if it wasn't this?

[Molly Hemingway]

Oh, well. So I will say, when you asked, is the Supreme Court your beat? I did always want to go to law school and didn't do that writing this book was awesome because I'd be interviewing a federal judge and he'd make a reference to some that I'd never heard of that obviously everybody should have heard of if they went to law school. And I would say, oh, I don't know what you're talking about. And then I would have a respected federal judge or justice or law school dean explain it to me like I was their private student. And I'm like, this is amazing and much cheaper and more efficient than going to law school. Yeah, definitely better. But I think that's the wonderful thing about being a journalist is you can go from topic to topic and rather than having just one thing for your whole life. So I've loved covering intelligence agencies. I, I actually loved covering election administration, which has to be one of the more boring topics out there. But you know, I enjoyed it and I love covering the courts and the Supreme Court.

When I first started reading you, you were a mommy blogger. Yeah, I feel like a lot of people don't know that about you. Molly Hemingway, you are actually a f blogger. You were a beautiful writer. I mean obviously you still are. And I thought that you had very interesting takes on parenting and that sort of thing. Do you miss writing about that kind of stuff?

[Molly Hemingway]

Well, I try to still keep a foot in that. I think that the most important work I do is my family work. So I also don't like a lot of the talk that's out there about being a wife and mother. So I try to, you know, point out that there are healthier ways of approaching these things. And I've always been a non feminist, which is kind of unique among people who are in D.C. or New York. And so I've just had a different perspective, and I like to share it. So I do miss it, though, because I actually think it's really important that women have a proper understanding of the joys of family life and that they be recognized properly.

[Carol Markowitz]

I think that's a book in and of itself. I could definitely see that being a future book of yours. You have a lot of range. That's what I was trying to say. I wasn't trying to block the mommy blogging.

[Molly Hemingway]

Carolyn, did you know I used to be a sex columnist too?

[Carol Markowitz]

No.

[Molly Hemingway]

I mean, you want range.

[Carol Markowitz]

Where did you write about sex?

[Molly Hemingway]

Oh, I'm, like, totally forgetting it was this publication. I'll send you some of my, I think, very good comments.

[Carol Markowitz]

You're forgetting I once gave a conservative. A speech to a conservative organization about how sex is the most important thing in a marriage. And, you know, I also. I love mentioning that my husband was sort of liberal when we met. And, ladies, you can change them, you know.

[Molly Hemingway]

Exactly right.

[Carol Markowitz]

So if the next step is not doing another biography on another Supreme Court justice, if Alito is, you know, the one that you stop the biographies with, what would you write about next?

[Molly Hemingway]

I mean, I have thought about taking some of the work that I've done on Russia, collusion or the corruption of the FBI. You know, when that was going on, when I was reporting on that with my colleagues at the Federalist, I kept on thinking, it needs to end somehow. You know, how do you write while you're in the middle of it? And with so much of the stuff that came out in the last year, I long ago gave up hope that there would be actual accountability. I mean, I still hope for it, but I don't really think it's. You know, nothing will happen at the level it should. But I think we actually understand how everything happened now. And having been so in the weeds on that, I kind of wanna put it together. But I am.

[Carol Markowitz]

You also, you tell good stories. And I think that that is a story that a lot of people. I have to include myself somehow. I mean, I know what happened with the Russia collusion, but I don't know everything that happened. And I think that would be a story that would be great to tell.

[Molly Hemingway]

What is it that you're most proud of in your own life?

[Molly Hemingway]

So, actually, I have to tell you, Carol, that that word pride, kind of sets me off. My brother had told me once that in his Bible study that the pastor had pointed out that pride is never used as a good word in scripture. It's viewed as a negative thing. So I'll go with pleased maybe, like what I'm most pleased with. Okay. You know, I already mentioned my family, but I think maybe that I was able to put together a career that balanced these things. I did put forward and work into it at the front end. I remember getting in trouble for it, that I was thinking that I wanted to be a wife and mother before I became. Long before I became a wife and mother. But I tried to figure out things I could do that would match well with raising my own children. And I love that I was able to do that, am able to do that, and have a husband who also believes in raising our children and prioritizing our home life.

[Carol Markowitz]

You have two of the greatest kids ever. Like, I love your daughters. Every time I see them, I'm so impressed. They're just. I mean, they're beyond. They're really wonderful, wonderful kids. How do you do it? What's the secret?

[Molly Hemingway]

Well, I think you know from your amazing children that you try to do good things, but that doesn't mean you kind of know. It's not. It's beyond you. They just come out the way that they are.

[Carol Markowitz]

They are who they are. Yeah.

[Molly Hemingway]

But we definitely invested a lot in education and we are totally comfortable being stricter parents than our friends and neighbors are. And in fact, I have a, like a mother who's German, you know, so she. I think she took it as a compliment if you said she was being too strict. So I kind of have a little bit of that too. I'm sure my children would cringe if they heard me, you know, acknowledge that I actually like being strict with them. But I don't know. Yeah, we have a happy home life. It's just fun.

[Carol Markowitz]

Okay, so five years out 2031. I've been thinking about this recently. This is related to my absolute hatred of AI slop. And it enrages me when people share it on Facebook or Twitter. To me, it's so obvious that that picture is. It just looks fake. Or that. Oh, that tweet that's going viral from that account. That clear? Like, if you can't get it in 140, 280 characters, like, just. It's just probably AI. I mean, I don't even like to deal with it, but I think there will become a market for non AI stuff. And that people will be willing to pay for the. For interacting with actual human thought.

[Carol Markowitz]

Interesting. How are they going to know that it's actual human thought?

[Molly Hemingway]

Well, I don't know exactly. I'll let the market figure that out. But, you know, in the same way that, like, a boutique has done the work of selecting things rather than going to the, you know, the big department store where there's just so much that's overwhelming, I think there will be some type of boutique aspect of. Okay, this was actually written by a real person or this movie was made without AI.

Right.

[Molly Hemingway]

I already see it a little bit in the kids. They're like, oh, that's AI. And it's not a positive ever. It's always like, oh, that's AI. This looks too AI, you know.

But the older set, I think almost can't tell a lot of the time. And it's sort of. I know, I know. I would say I don't think I've fallen for very many. I fell for one recently that bugged me. But, you know, it happens. But the people, the generation older than us, I think are, you know, fall for it on a regular basis.

It'll keep getting better. Quote, unquote. Like, my own personal thing is I don't know what I think think until I write it. So I can't use AI. I have to do it myself or else it's like it didn't happen. And I. So I'm very strongly, like, very strongly opposed to.

[Carol Markowitz]

You don't know where you're going. When you sit down to write, you're just like, yeah.

[Molly Hemingway]

Or you might think you're going to

see where we end up.

[Molly Hemingway]

You know, frequently I'll think I'm gonna write this. And then what ends up being written is not quite that. And it's an important part of the whole thinking process. And why would you take that away from yourself? It's a joy to read people's thoughts and have them challenge you.

[Carol Markowitz]

And so I've never used AI to write. And I've seen people suggest that there are, like, all these apps, they can monitor how you wrote a piece. And I was like, if anybody sees how I write my pieces, they're going to think I'm a complete lunatic. I'll have, like, a random word that I want to use in a sentence and, like, build a sentence around it. And I don't need anybody looking at how I know how I get there.

Oh, man. It would be embarrassing. Yeah. But that's everyone's process is their own and that's how they get to the final product. And obviously your final product are awesome. So it works well.

[Carol Markowitz]

Thank you very much. But yeah, I just can't have the security of the biting AI find out how I do it because that just can't work for me. Molly, you are just one of my all time favorites in every way. Oh, okay. Well, that's all very good too, I would say, you know, from my perspective as a Christian, go to church, like become part of that community. Have things that are beyond the temporal, that you are focused on higher things and it keeps everything in perspective and it also helps provide structure. You know, in your marriage when you have trouble or with your kids when you have tr, you have these systems that can help you think through how to be appropriate.
