Now, first off, before we get into the exchange you had on cnn, which we did, I don't know if you know or if you were able to listen in before, but we did play a good more than half of it, I'd say, on the air. I watched it and it was just, it was astonishing. But also I guess I expect it. So we'll get to that in a second. But can you just from the legal perspective, tell everybody we know this story about A.B. hernandez, biological male, competing against women. We know this stuff. What is the legal, what is legally at issue here? How does Title 9 come into play? What is Gavin Newsom of California doing? What's happening on the legal front?
Julie Hamill
Well, long story short, Title IX has been a federal statute since 1972, and it's very simple. It is sex based protections for you cannot discriminate against girls and women in educational programs, including sports. And so there is supposed to be equal opportunity for women and girls in educational programs, including sports. California back in 2013 passed this law, AB 1266, which is now education code section 221.5 F, that says schools must allow students to use the facilities and play on a sports team that aligns with their gender identity instead of sex. So that essentially turns Title IX on its head. And we've had that in place for over a decade in California now. It mirrors almost identically Biden's Title 9 Title IX rule that he put in place in 2024 that was enjoined by a number of federal district courts. So those courts said in their decisions, you cannot create a regulation or a rule that completely flies in the face of what the statute says. This completely subverts Title ix. It does the opposite of what Title IX was supposed to do by allowing males to into the female spaces, into female sports, into female academic programs. It's total nonsense. Any thinking sane human being can recognize it immediately, which is why I'm frankly shocked that this interview is getting so much attention because it was simply, it's just common sense. I was only saying things that most of America is thinking. And for what that is.

Well, yeah, it went, it went super viral, I think for the reason that and I'm glad that it did, Julie, over the weekend, because you are just, you are just saying in a very calm tone, and everyone heard it, we played it. Here's the reality. And the CNN anchor has this almost like otherworldly detached. But what about people who are assigned female at birth who uses this kind of language? Like, you know, we just had Mother's Day recently. You know, this is like the birthing People's Day phenomenon that we've heard. Like, no normal person thinks that this should be normal. And let me ask you this. Taking California's policy to, to its logical conclusion. Let's say I was an employee in the state of California and I wanted to claim discrimination as a woman because I say that I identify as a woman. On what grounds could California tell me that I couldn't sue for sex based discrimination against me as a woman? Like how, how is it legally codified what you identify as?
Julie Hamill
It is actually legally codified. It's freaking nonsense. So we, in addition to AB 1266, we also have the UNRU Civil Rights act, which defines discrimination based on gender identity as a violation of California civil rights law. So it's not just in school schools, it's not just adults or it's not just children. It's also adults. And California has literally legislated gender ideology into statute, which is so absolutely nuts. I don't think people really understand the consequences of what has been done here.

Wait, well then take me through this because, yeah, that is so nuts. I didn't even know that they had done that. How, how do you qualify as identifying as a different gender? What has to be done? Because it can't be sex change operation, because that's actually only, you know, a pretty small percentage of these individuals.
Julie Hamill
It's a feeling. It's a feeling. Do you feel like a woman today? You're a woman.
Buck Sexton
So then I'm right. So then I could, I could say I feel like a woman. I can't believe I'm saying this out loud. And I think I'm being discriminated against in my California job as a woman and I'm suing and they would have to try to prove that I'm not actually a woman.
Julie Hamill
Yes, yes. That's absolute bonkers nonsense.
Buck Sexton
I, you know, I said, what is now the next step on this? Right? Because I think the sit down that you had or the conversation you had on CNN was very illuminating. I mean, also just things like we need more study to see if biological males have a, an advantage in sports. This is, this is like members of the Communist Party or maybe even just like everyday people within the Soviet Union saying, yes, we're all starving, but the grain harvest this year was the best grain harvest in history. Like, this is that level of crazy. Because we all know that obviously the basis of men and women having segregated sports is that it wouldn't be fair if they didn't. Right. That's. Otherwise you would just have, you know, men and women, right, can apply to work in an investment bank. We don't have the men, the men position, the women position. It's different in sports because of the physical differences. So are you, are you going to bring suit? Is this going to get up to appeals? Is this going to go to scotus? Like, what happens now?
Julie Hamill
So there are lawsuits pending right now. The Advocates for Faith and Freedom group out of San Diego filed a lawsuit that is pending in the Central District right now. Our U.S. attorney, Bill Aseley has filed a statement of interest. And so the government is getting involved in that one that is challenging AB 1266. I hope it goes to SCOTUS. In the meantime, though, the Trump administration is very much motivated and acting very quickly here and they are coming in with the full weight of the Department of Justice. And I believe that we will see results soon, hopefully.

Well, what do you think about the polling? Because this came up in your conversation. Let's, you know, what do you think about the pulling of federal funds of California does not comply with Title 9 rooted in an understanding of gender as a thing that is real, or rather men and women are things that are different and distinguishable under law.
Julie Hamill
Well, this is so crazy to me that the anchor with a straight face said to me that there are different interpretations of Title ix, that there are people who believe that gender identity is the thing that should be protected and not sex. So for that reason, we need to legislate this at the congressional level. We need a federal statute to clarify that Title IX is sex based, which does not include gender identity. It is your biological sex. The fact that we have to do that is absolutely, it's terrifying to me. We've reached Orwellian levels of insanity in this country. But in order to protect future generations, we have to have this spelled out in statute because as soon as we don't have a Republican administration, we're going to have this crazy leftist interpretation of Title 9 again and they're going to allow males to compete against girls, share facilities with girls, and there's nothing we can really do about it.

So how. It's just my problem with this is I still come back to if they say that, and as you pointed out that in California there is a gender identity protection law, how can you legally law, you know, if somebody said buck, how can you lawfully or legally Identify a man or woman. I'm like, well, we know what a man is, we know what a woman is, right? It's like you sit there, you go, that's a man, that's a woman. How could you identify, or rather, how could you codify gender identity without it excluding people who claim to be covered under gender identity? Or rather without it being so vague that it could be anything?
Julie Hamill
Well, the people at dfi, the Defense of Freedom Institute, have actually proposed model legislation for this. It's like the Protect Title 9 Act. You can go to their website and it's there. And they've done that. And they. And Bill Asale, when he was in our state legislature right before he got appointed to the U.S. attorney position, also introduced a bill called AB 844, which would have done the same thing.

But that's defining men and women in law, right?
Julie Hamill
Yes.
Buck Sexton
Yeah. No, what I'm saying is how could you define gender identity in law? Because it isn't a thing.
Julie Hamill
It's defined in various places in California statute. It's not consistent. It's always something different. And then if you look at school district policies, these different school districts throughout California have also taken a stab at trying to define it. But it is, it's a nebulous concept that is ever changing. It's not immutable. It's not going to be protected by the Supreme Court and equal protection cases because it's not an immutable characteristic like sex. You cannot change your sex.

Yes. So do you think this is. To me, it feels like this just has to go to the Supreme Court and there has to be some, you know, clarifying. It's amazing clarifying ruling from the Supreme Court that men and women are different and we can know the difference.
Julie Hamill
Why do we have to do this? Why can we not have people come to their senses and start speaking rationally and having.
Buck Sexton
Well, it feels like Democrats. Cuz you're asking a very important question, but it feels like Democrats to what you said before, they're just trying to ride this thing out until they're in power again. And then it's going to be the lunacy of. Yeah, this is the, you know, men and women's locker rooms met against women on the sports field, you know, men and women's prisons.
Julie Hamill
Well, in the really Orwellian part about it is that they're saying men are women, they are women. They're not.

Right.
Julie Hamill
Of course they're actually women now because they say they are. These are women. And you must accept that. And if you don't accept that you're a bigot.
Buck Sexton
Well, have you ever seen this is what I always tell everybody is the, is the true ultimate ends of this. There have been a few people who have tried this. You've seen like blogs or, you know, stuff on like HuffPo or the Nation or some of those, you know, communist loony bins online where they, they try to make the case that if you're a straight man who is not attracted to trans women, you're bigoted. Have you ever seen that? That, that bubbles up here and there. And as I point out to everybody, based on what you just said, which is that the real belief is that trans women are women indistinguishable from women. The ultimate logic of this is there's a problem with guys who aren't attracted to trans women.

Yeah, it's okay. One of the most disturbing elements here is what they're doing to children. I'm laughing right now, but it's really dark. It's actually incredibly dark. And I'm on a school board out here in Palos Verdes and we had this book that we have fifth grade teachers like, these are ten year old kids. They're being read a book called Too Bright to See, which says, it literally says in the book, a trans woman is a woman full stop. And anything else is bigotry. And it's, that is what they're teaching little kids. It's all.

They are teaching kids the sky is green. They are teaching kids can see. They look at the sky, it's blue. And there are books that say the sky is green. And we're supposed to accept that.

Welcome back into play and box. Yeah, we're just talking about this story out of California a second ago with the person who just won the track and field championship is a biological male. And it's, it's pretty remarkable. The Democrats plan to stay on this issue and have not budged at all. It really gives you a sense as to how clear it is that this is really important to them. They view this as the new civil rights struggle. The Democrats really, as a party, they're attached to this. And one of the ways I tried to say this back on my Bill Maher appearance in October, I think I got talked over a little bit. But I was trying to say, even for the Democrats who know this is crazy and there are Democrats, I've spoken to Democrats who know this stuff is nuts, particularly else in my case, I've spoken to a number of offline, you know, not, not in public, but a number of black Democrats who do not agree with the trans agenda stuff, but they don't want to deal with the heat. I know people who are prominent in Democrats, you know, prominent Democrat commentators and, and they don't want to, you know, they don't want to deal with it. It's not that they agree with it, but they don't want to deal with the heat that they get from this one. And I think there's a lot of Democrats who fall into that category. They won't publicly go against this even if they're not on board. So whether it's a Chuck Schumer type or go down the list, they will not say, yeah, this is crazy, which tells you all you need to know. If it was damaging to their party and they disagreed with it, wouldn't they be willing to say, I don't think we should do this anymore? VIP email from David. He says maybe the state should try this, have a boys, girls and open classification. Trans female will compete with the girls, except they will be reward, awarded a medal in the open division. Girls will receive awards for placing events in the girls division. So everyone competes, but the rewards are divided into classifications. That is, David, that's not a bad idea. You know, it's an option. I would just say I think that the trans individuals, because it's always, it's always guys pretending to be girls. A girl pretends to be a guy is going to get no attention to this because all the guys are going to completely smoke her in all these athletic events. So they don't want to do a third event with other trans people. They want the glory of I'm the state champion. And they convince themselves that that's okay, that that's the problem is they want us to all go along with the delusion. The anti Semitism especially in the aftermath of this awful terrorist attack. As I said, this guy was married the, the terrorist here, married, five kids and just wanted to go and light a bunch of Jews on fire at a, at a vigil essentially at a, you know, raising awareness for the hostages gathering. This is, it is so evil. And everyone I know, you see that if you listen to this show as you do, you know what we stand for and you are a person who has, and I say this in all honesty and this is not even, this just, I think should be said because we should all allow ourselves to hear it. You are a person of moral clarity, knows right from wrong. So it can be befuddling, it can be confusing. How could anyone not see right from wrong on these issues? I don't just mean the terrorists, right? Of course. Even the most insane Democrats, for the most part, will publicly say, oh, but, you know, this is. That's not right. But let's not let this overshadow the righteousness of the Palestinian cause. What is the Palestinian cause? They don't want a state that isn't Israel, so they just want to continue to exist to create agitation, strife, and bloodshed until they get their way, move on. A lot of countries have a lot of borders that shift over the centuries. People move around. My people were Irish, and then they were starving to death, and then they crossed an ocean. Like, things happen, really. I know that that seems like a simplification to some people, but this is just reality. Israel's not going anywhere. The people that are telling Palestinians, whether they're fellow Palestinians, you know, like Hamas or other, you know, Muslim entities or states in the region, oh, don't worry, we'll get rid of those Jews. No, you won't. It's not going to happen. Try to lead better lives, try to build something instead of trying to burn everything down. But somehow the. The righteous cause on campus for the imbeciles is Gaza. We need to make a Gaza, a place that is totalitarian, a place where no one has any actual rights, a place where the very people who are protesting in favor of this wouldn't last. Well, it's the war zone right now, but even before it was a war zone, wouldn't last a day, and would be lucky if they weren't tortured to death and murdered. And yet they still think that those are the good guys. I mean, this, to me, would be like, you know, protesting in favor of North Korea. You know, North Korea just wants South Korea back. What's the problem? You know, so what if they're going to have to shell Seoul and they're going to have to kill a few million South Koreans? The reunification of the Korean peninsula is North Koreans destiny. And I stand. You would know that's a crazy person, right? North Korea is an evil state, an evil regime to its own people, and to everyone else, Gaza is an evil regime. Rather, the Hamas regime of Gaza is evil. These are bad people. They have chosen the path of darkness, and they inflicted that darkness on Israel. And now there is a response. I don't know why this is so hard for some Americans in particular to get through their heads. But. But it is. And. And they sit here and they say, oh, you know, you're. You don't Understand? You know, it's, it's the, it's, it's not my. I don't have a problem with Jews. They say, I don't like the way they're fighting in Gaza. Oh, yeah. All the, all the tacticians, all the real frontline military minds that have a problem with what the Israelis are doing in Gaza. Sure. It's just, you know, they just wish it was a little bit different. I remember, I remember when they were saying there should be a cease fire days after the attack of October 7th, a cease fire. Now, if somebody was calling for a ceasefire 48 hours after Pearl Harbor, I think it would be pretty clear that they don't want to see the best for America. Right. I think we would all know that. Hey, hold on a second. Maybe Japan, you know, just wants to. Just wants to work it out, you know. Yeah, they got a little bit, you know, a little bit too feisty there with, you know, killing a few thousand Americans and bombing us. But, you know, they've had a tough go. You would know that person's insane. You would know that they actually just hate America. And yet the people that were calling for a ceasefire are the same people that have been marching on campuses for Palestine. Same people going in the media saying, oh, this is an evil war and a genocide. They were calling for a ceasefire right away. Ceasefire. If someone walked up to me in a bar and punched me in the face as hard as they could and I was, you know, gearing up to give them a nice shot and they said, hold on, ceasefire. Do I think that they're acting in good faith? We know that they're not acting in good faith when it comes to Israel. We can all see it. Scott Jennings over at cnn. It doesn't have to just. It doesn't have to be conservative or, you know, pro Trump only. Right. They could. They could have on all the Democrats they want, just have one show with somebody who is pro Trump on that network. They would never do it. They would never do it.

They'd rather have an anchor up there who's like, well, do we really know that men have. I think we need more study before we know that men have a biological advantage over women in athletics. We need more study. Oh, oh, because what about, what about women who were assigned women at birth but actually have been unassigned it. Because they say so. Ah, okay. Yeah, that makes a lot of sense. All right, back to CNN's Scott Jennings here. This is what he says about this. This is cut seven. Play it. This is horrific.

And what more do we need to see before we realize this Free Palestine movement is nothing more than a domestic terror organization right now? I mean, we had the killings in Washington a couple of weeks ago. We have this issue in Colorado. We've seen, you know, the activities on college campuses now for months and months and months and months, the rise of anti Semitism in America, the rise in the number of people who have come to America who hold anti American views, anti Western views and anti Semitic views and are now willing to act on it. It is absolutely outrageous. And I think as a society, we need to understand we are dealing with domestic terrorism. It's growing more violent by the day. And if we don't deal with it, these kinds of things are going to keep happening.

You see, this is. I'm going to let you in on a little secret that the Israeli people know and Americans who understand the Muslim world know. Here's the belief that's out there that the left will say to you, oh, it's our fault. And you can see this runs in parallel. This argument goes side by side. America in the Middle East, Israel in the Middle east. You'll hear the same version of this, the same argumentation, essentially. Here's how it goes. If we just did things differently, if we just left them alone, meaning the Muslim world, the Middle east really is what we're talking about here specifically, but the Muslim world more broadly, too, because technically, places like Afghanistan, Pakistan, that's not the Middle east, that's South Asia. But if you look at the Muslim world, the belief is if we leave them alone, everything would be better. They'll leave us. They'll leave us alone. History shows you that that's not true. That it's not as though if we just did things differently. And this is really gets to the heart of the debate here. If we just did things differently, all of the terrorism Bin Laden is or was. Thank you Seal Team 6. Bin Laden was blowback for US foreign policy. These people have no idea what they're talking about. They know nothing about the Hadith cited with the black banners of Khorasan making their way to Jerusalem to bring about the end of Days. They know nothing about the, the explicitly imperial history, meaning empire building history of the Islamic project. They know nothing about this. They just viewed in a post Ottoman, which really just means 20th century, a post Ottoman context of Muslim world and specifically Mideast decline. And so we are the oppressors, they are the oppressed. In fact, the Islamic world was just one giant jihad of ongoing conquest for centuries. For centuries. Right. So if we're really going to get into this history, we should have some baseline understanding of what is really going on here. But you will notice that wherever, wherever there has been the expansion of the Muslim world into the non Muslim world, guess what happens? Vicious and violent conflict. And this is without exception. Find me a place. Show me what it looks like in South Asia when Muslims and Hindus are coming together. Has there been tremendous bloodshed? Have there been wars? Of course. Show me this in East Asia. Show me this anywhere. Certainly the Balkans, Eastern Europe. Show me this anywhere. And there is conflict and there are problems. The notion that the only problems exist because of us is just a self hatred masquerading as some kind of erudite foreign policy. It's absurd. It is absurd. And now what you have to realize is that some of these countries, you look at a place like Iran, why do you think Iran spends all of its time saying that Israel is the little Satan and we're the great Satan and they have all this stuff. And yes, I know the Iranian people different than the Iranian regime. Why does the apparatus in control of Iran, the theocracy of Iran, spend so much time supporting terrorist groups and hating Israel and working against America? Well, if they weren't doing that, they might have to look around and say why does our society suck so much? Why are we so poor? Why do we have no rights? Why are we so behind the rest of the world? Why can't we be competitive? Why can't we create great literature? Why can't we create movies anybody wants to watch? Why aren't we curing diseases? Where are we on AI? How happy are our people? All of those metrics. And this isn't Just true in Iran. All of those metrics in some of these Muslim countries would just be devastating if people actually spent time thinking about them. But it is so much more easy to say, well, you know, there's. There's an Israeli hiding under my bed. He's the problem. America doing things that Israel wants them to do, that's the problem. I promise you. These countries, I mean, the perfect example is Gaza. Gaza itself. Israel said, fine, you know what, all of our settlers, and they, it was not, it was not a pleasant experience. They had to send in the military. They had to drag them out of Gaza. Those of you who actually know the history of the region know what I'm talking about. They said, fine, Gaza is yours. And then, then they spent the next 20 years building terror tunnel networks and firing rockets at their neighbors. It's their fault. They made choices. They made bad choices. It is their fault. Now you could say, oh, but you know, laws of war and what do we do? And it's so horrible. And there's civilian casualties. Yeah, war is a terrible thing. The Israelis try to mitigate the civilian casualties from the war that they are fighting, but that does not mean it is not a just war. Same way we went to Afghanistan. And they were trying to not just blow up the Pentagon and bring down the Twin Towers. They had many. And I worked on some of them in the CIA, CTC when they were active plots. I remember this. They were trying to bring down, you know, you know, multiple airliners over the Pacific or over the Atlantic or. They're trying to bring, I mean, they, they had plots aplenty, mass casualty plots still going and still based on Al Qaeda leadership, direct planning and. Yeah. Did we occasionally bomb a. Not even. Not even occasionally. I mean, we just had to bomb compounds where we thought the bad guys were. And were there people who were killed and is a terrible. Yes. But the alternative is we don't get to do anything and we just get to suffer and the terrorists win. The fighting against terrorism cannot be viewed as the root cause of terrorism because then you have created a philosophy of the bad guys win before the fight has even started. And that is what the American left does. That is what the Blame America first group does. And that is what the, you know, the, the Hamas lovers running around on campus.
