I'd known you had health problems over the years and I appreciated your elaborating on some of the agony went through with that chronic pain because I've been dealing with it since the Vietnam thing, too. My second oldest brother missed out and then I was two years younger than him. Oh, good for you. Yeah, I thought, well, I might, I might be able to make out on this deal. No, you're not, Mike. If you can recall the starting five for the University of Cincinnati Bearcats and their run for a three peat in 60, 61 and 62. Okay, okay. Cincinnati Bearcats championship team, 1960, 61. I think Ed Jucker was the head coach. They had Bonham, Thacker, Yates, Hogue. I think they had a center Durking, Connie Durking's brother. I don't know if Wiesen Hahn was there yet.

There you go, Mike. Thanks for calling in, by the way. I played a pickup game with these guys who played for Cincinnati and won a national title in the 60s, and we played against them. They were probably in their late 40s and they were incredibly great. Still, you know, it was one of those all star teams traveling around Ohio playing high school alumni. He's Pablo Touring and he is a contributor to Pardon the Interruption. Of course, Pablo Torre finds out. Meadowlark Media podcast. He took time out from Bill Belichick to spend a little time with the NFL. And now I want you to dumb this down though, Pablo. Okay. And just so our audience knows exactly what the NFL are they guilty of or being accused of?

They are being accused of quite a bit. They are guilty. And that is. I'll use that word sort of conversationally here.

They were found by the arbitrator to have attempted to collude with the 32 NFL teams. We have extensive documentation now, by the way, hello. Thank you for having me. This is a 61 page document that has been suppressed by both the league, the owners and the union in which. There's a treasure trove, Dan. And there's just one bit of vocabulary that I want to do at the top, which is expedited discovery. What does this mean? It means that you get all of the texts, the emails, the documents, the private messages, the slideshows, all of the secret stuff from owners, players, agents, executives. It's the treasure trove. And so the question of there is a treasure trove. There's a finding that the NFL encouraged the owners to collude to prevent the next Deshaun Watson contract. You'll recall, that was fully guaranteed. Unprecedented. They wanted to stop Lamar Jackson, Russell Wilson, Kyler Murray. That same summer of 2022, they wanted to stop that from happening. So into all of this, I guess I walk in and I'm like, oh, man. I think I can get this document. And I now have a sense of why the union and the league, neither side wanted this out there. And that was the question. Why haven't we heard about this? Well, there's a. There's a lot deeper here that explains that, too.

Okay, but do you need to have a slideshow sent out, a memo to not be stupid like the Cleveland Browns were with Deshaun Watson?
Stacey Vanek Smith
Well, it's a great question. And so despite that, despite what seems obvious, Roger Goodell, in repeated emails with Jeff Pash as general counsel, had this exact conversation. We need to make sure that they don't do this. And so there's this thing called the NFL Management Council, Dan, and this is a shadowy entity that I didn't understand before I reported this story. But at the league annual meetings. All right, I'll set the scene. It's Palm Beach. It's a big conference room. Into this walk, the 32 owners and the representatives at the front of the room are the head and the. The executives in charge of the NFL mc. And there's a slideshow presentation. And in the slides, there is written off to the side for the presenters to see the results of these emails that Roger Goodell had written back and forth with Jeff Pash in which they wanted to spare no ambiguity as to the fact that this would be a problem if anybody else did this. So it's a great question. A horrible contract. We laughed at it at the time, and yet it's so symptomatic of the level of control and cohesion when it comes to why they didn't want to even allow the possibility that someone would be dumb enough to do this again.

Did teams collude or was the NFL asking them to collude?
Stacey Vanek Smith
That is the key distinction that the arbitrator drew, is that the NFL encouraged them to do it. Here are the documents. Here are the emails. But they didn't have admissions on the record. And certainly they had denials from the eight NFL owners that they had witness testimony from that they again, spoiler alert that they did not sign another Deshaun Watson style contract.

There were never guarantees like that again. But the arbitrator could not prove that that was because the NFL had encouraged them. What we did see, though, in these documents, it's just over and over again, private text messages between the owner of the Cardinals and the owner of the Chargers in which they are celebrating how Kyler Murray's contract was going to be not guaranteed and how, in fact, as Michael Bidwell, the Owner of the Cardinal says, and I'll just quote this, gets a text message from Dean Spanos. Dean Spano says, congratulations on signing Murray. Michael Bidwill says, thanks, Dino. These QB deals are expensive, but we limited the fully guaranteed money. Have some pretty good language, thankfully, of a QB that's worth paying. Spano says in response, your deal helps us for our quarterback next year. And so look everybody, Dan, the thing I'm struck by, right, as you go through all of this and there are so many examples like this where you have the Broncos owners deliberating internally their internal messages in which they are saying, we're not going to give Russell Wilson the guaranteed deal that he wants. Of course we're not. Even though he's demanding it. We have Lamar Jackson, the backstory of that deal, right? We have texts from Lamar, messages saying to the Ravens, I want a fully guaranteed deal in all caps. We now know, by the way, that thanks to this document, after they of course non exclusively franchise tagged him, that was their solution, that he got zero offers from other teams, zero. The mvp, zero. And so the question you ask yourself is, okay, why was any of the encouragement in that NFL MC meeting responsible for it? The arbitrator could not publicly, certainly publicly, but did not privately feel comfortable ruling. It was because of the, of the league's guidance. And so many things can be true.

Why would the Players association be in cahoots with this since they would want their players to be paid as much as possible?
Stacey Vanek Smith
That's the best question, right? So the NFLPA sources at the union have always, you know, they've dreamed of this, right? Because in this document, it's not merely the Mike Florios of the world who are yelling about this and saying this is how they're like backstage. Trust me, you see it in 4K quality. It's been described to me, this document as a holy grail for the union. And so why did they not want this out there? A couple of reasons. But I think the best summary to dumb it down for everybody, because there's a lot here, is that the NFL Players association has been the product of a regime change after Demora Smith, their executive director, in which J.C. treader, former Browns center, became the NFLPA president, two term president. But this same month of March 2022, by the way, he got cut from the Browns simultaneously. D. Smith, that same month, March 2022, says, okay, I guess I'm on the way out. JC Treader decides, I'm gonna run this search in a very confidential, secret way and going to Result in this new guy, Lloyd Howell, the new executive director of the union. Which is all to say that when it comes to why the union didn't act, you look to J.C. treader, you look to Lloyd Howell. There's a lot there in those two guys that's in this story, in this episode. But they did not want this released, in part because J.C. treader, in the document is referenced privately trashing Russell Wilson, blaming him, Russell Wilson, for not getting the fully guaranteed contract that everybody wanted him to. Get to your point, of course you want the full guarantees. J.C. tretter, president of the union, is privately insulting Russell Wilson, saying that he is the reason why we're never going to get the full guarantees again, effectively. And so if you're the president of the union who wants to be the next executive director of the union to replace the guy you handpicked to replace D. Smith, this is something that looks terrible, I have been told. And so, again, cover up. You could argue as much as these infractions, these, I won't say crimes for legal reasons, but as much as these missteps and embarrassing things are bad, the COVID up, damn, that's always worse, right? And the question of why didn't you hear? It's about self interest from individuals instead of the collective good of the players and the union. Which is why this is such an insanely interesting story to me.

I was hoping you would ask. Yeah, I continue to report that, too. It's funny. It's funny. I don't have anything to break with you exclusively other than to say that I got some stuff cooking. As much as people think that I've become a real journalist because of this NFLPA story, nope, I'm still in the mud. Dan, I look forward to calling you from the mud, hopefully sooner rather than later.

All right. Pablo. Tori. Pablo Torrey finds out. You can find that podcast. It's metal arc media. Yeah, I was going to set it at one and a half, but if that's the case, he's taken the under with. With Bill. Yeah. This stuff with the NFL is kind of fascinating that it was available to find out. That's how Florio and. And Pablo found this out. And I mean, it's clearly collusion. But why would you go to great detail as he talked about the ambiguity. We can't have any ambiguity here. This has to be any. They also point out that none of the networks that carry NFL games are covering this now. Everybody's kind of like nothing here. But why would you go to great detail to tell owners not to be stupid like Jimmy Haslam in Cleveland? Do you need to really tell these guys not to be stupid and don't do a paper trail? How about a face to face conversation, not a slideshow. But do I need to tell these guys, hey, I remember there was one owner livid with the Browns when Haslam signed up to Sean Watson. But as I told the owner, I said this guy had to. He had to bribe him to play for the Cleveland Browns, baggage and all. You gave him a $230 million guaranteed deal. But that's overlooking a whole lot. And you're hoping, hoping that somehow he's able to play like he did when he got to the Houston Texans, but he'll never play again. Certainly not for the Browns. But that's pretty wild, the COVID up. You know, I can go back to the commissioner and somebody in the office saying it wasn't what Tom Brady did, it was the COVID up and lying to the commissioner. You gotta, you know, do you have a cover up here and are you lying about this? I know they don't play by the same rules. Yes. Punk.

Four years ago he was a starter. He had 4,800 yards for Houston. 33 touchdowns, seven picks. He's 25 years old. He's entering his prime. And those are all pro stats. Like, where is he his last three seasons in Cleveland? Seven touchdowns, five picks, seven touchdowns, four picks, five touchdowns, three picks, nine and 10 as a starter.

Yeah. I had somebody with the Browns saying that he was afraid to run again, like he. He wasn't going to be. What made him a really good quarterback in Houston? Yes, T. He's having like a similar.

Yeah, but. But Deshawn had a career like Ben Simmons did too. He won the. Yeah, okay. Yeah. Deshawn played at a really high level. Ben never played at a high level. He couldn't shoot, but he was a good passer and a really good defensive player.

Yeah. But Ben didn't do anything wrong. He just didn't want to play.

Yeah, Paulie, I see what Seaton's saying, though, because if you go back to 20. 20, 20, 21, same year as Deshaun Watson. Now, he wasn't a superstar, but Ben Simmons at age 24 was averaging 15 points, seven rebounds, and seven assists a game and two steals.

Yeah, I guess, when you lump him into Deshaun Watson. But, you know, Ben didn't do anything, you know, off the court.

But. But a career that was cooking, that just is not even close. Yeah, it's not like it cooled off. I mean, Ben Simmons last year played in 18 games. He started zero.

Yeah. Can you. This is where you're trying to understand if you really want to be great or you just get paid and then, you know. And I know he had injuries, but do you want to be great? You can still recover from these injuries. Hey, there have been some really serious injuries, and guys have at least tried to come back. I just don't know if Ben loves playing basketball. You know, I've said this before. There are people really good at certain things. That doesn't mean they love what they're really good at doing. Yes.

Marv, in basketball, more than any other sport, is a genetic sport. So if you're six, nine, man, somebody get him a basketball. Like, I'm not sure if he loves it. So, like, baseball. Baseball more so is you love the game. But if football, if you're a big guy, if you're 6, 3, 2, 4, 0, man, give him some shoulder pads. So it was probably a lot of those guys. I'm sure there's tons of guys that are seven feet tall that played Division 1, NBA even. Yeah, like, you know what? I'm tall. And let's make some money.

I think that for us as an organization, going into that second apron is not necessarily something that we're scared of. You know, we're very conscious of that pushing forward and, you know, providing the resources that we can when the moment arrives. But that second apron, is it a hard cap? There's certain franchises where you go, he's going to look really good in a Yankee uniform or a Dodger uniform. It's unfortunate, but baseball created this and there are markets that can keep up, try to keep up, and then there are other ones that just can't. They get high draft picks, they develop the player and then they ship them off. It's like, hey, we're going to put you through high school, but you're going to go to college and grad school and we're going to get your doctorate someplace else. Yeah, Paulie.

There was some tough negotiations. It wasn't an immediate decision.

Yes, but I. I had to kind of beg you to leave espn. I had to have you have a leap of faith. Seton. I got him at the right time. Before he moved up to ladder there, Paulie was kind of a free agent, and I was able to get him as well, but nobody wanted to join. I was in my attic for three years. We weren't on TV. McLovin came to kind of do blogging for Sports Illustrated. I didn't even invite him. He just said, hey, can I come up and blog about the show? And he came up. He drove up from Brooklyn. And then I said, do you want to stay? I get this wasn't really thought out. I mean, I knew what I wanted to do, and I wanted to have friends, and I wanted to be able to do it where I'm not doing a rundown of things that you got to check off a list at ESPN like I did. So it was three years. The only reason why we moved out of my attic was because in the association where I live, they said, you can't run a business. And we scrambled. I met my local bar guy who ran the bar goes, I got space upstairs. I'm with Paulie, drinking beer, crying in my beer. And then we went up, and it's an old dance studio, And I go, we'll take it, like. And we didn't have anything. So it's not like somebody's gonna go, man, I'd love to join you now. Have I thought about other women being involved? Julie Stewart Banks was somebody that I thought of great respect for her and her sense of humor and timing, and she would have fit right in. But I had to be fair to the people who were involved. Marvin was here. Like, why? Why should I look down outside when I should be fair to the people inside? And I was looking outside, and Seaton goes, why not, Marvin? And I go, yeah. And then that was it. Like, there wasn't any hey, we got to sit around. What do you guys think? Yeah or nay? It was just. Yes. And then we just put Marvin in. We knew he knew sports, he knew the show had a sense of humor, and he just fit right in. So that. That's. I mean, that's as far as we've gotten. We don't replace anybody here. This is. You know, McLovin left because he wanted to have a job closer to home with his two daughters, and Marvin was perfect now. So that's the beauty of this. Dylan answered phones now, you know, he's doing a variety of things here. Marvin help with the build of this building. Answered phones. Now he's doing this like, that's what I love. You earn that opportunity to move up. So have I considered it? Yes, I have, but that's as close as we got. All right, we'll take a break. You're still happy, aren't you, Marvin?
