Loretta Preska became one of the most important judicial figures connected to the Jeffrey Epstein and Ghislaine Maxwell saga through her oversight of major unsealing battles in federal court. Serving as a judge in the Southern District of New York,...

We have some news out of Judge Prescott's courtroom and it looks like it is exactly as we expected. It's going to be a long process for these documents to be unsealed. Now, Prescott already stated previously that she was going to do this in a rolling fashion, and she has now laid out the groundwork for the two sides and how things are going to proceed. As far as documents being unsealed now, there are a lot of things that she had to take into account.
Podcast Co-host/Interjector
Right.
Podcast Host Bobby Capucci
The fact that some people are going to be named and they have to be made aware that they're going to be named. You know, just a whole bunch of legal stuff. So it's going to take some time for this to happen. The article we're going to read tonight from Law and Crime will give us a better idea on just exactly what that process is going to be. Now, as you all know, I like to use law and crime whenever we can when it comes to this sort
Podcast Analyst Bobby Capucci
of a legal type situation, considering that's what they do.
Podcast Host Bobby Capucci
They always, this is what they report on. This is their bread and butter and they have done good work here on the Epstein case. So let's jump into the article and
Podcast Analyst Bobby Capucci
see if Law and Crime can add
Podcast Host Bobby Capucci
a little bit of meat to the bone and put a little context in this for us.

Judge reveals Process for Leasing for Releasing more Secret Jeffrey Epstein Files this is

going to take a while.

The author of this article is Colin Kalmbacher. A federal court in New York City
Podcast Host Bobby Capucci
determined the categories of people whose names
Podcast Analyst Bobby Capucci
will appear in the latest tranche of
Podcast Host Bobby Capucci
materials related to Jeff Epstein and how they will be able to object. The process is complicated and time consuming.
Podcast Co-host/Interjector
Yeah.
Podcast Host Bobby Capucci
Unfortunately, just about anything that goes on in federal court especially is going to be time consuming and complicated. And like usual, I am not a lawyer, Right. So I'm just muddling my way through this stuff just like you. And that's why, again, I'm, I use
Podcast Analyst Bobby Capucci
Law and Crime and not some other website where you just get a basic idea of what's going on.
Podcast Host Bobby Capucci
At least they give you a little bit of context here and Colin is somebody who obviously knows what they're talking about, so it makes it a little easier to understand.
Podcast Co-host/Interjector
Right.
Podcast Analyst Bobby Capucci
So that's what we're gonna try and do.
Podcast Host Bobby Capucci
But again, I most certainly am not
Podcast Analyst Bobby Capucci
a lawyer and some of this stuff
Podcast Host Bobby Capucci
just makes your, your head spin and your eyes roll back in your head.
Podcast Co-host/Interjector
Right?
Podcast Host Bobby Capucci
Just all the legalese nonsense.
Podcast Analyst Bobby Capucci
U.S. district Judge for the Southern District of New York, Loretta Presca outlined those
Podcast Host Bobby Capucci
categories in a 5 page order released Thursday afternoon.
Podcast Analyst Bobby Capucci
The names will include A. Persons who produced or answered discovery based upon the representation or understanding that the discovery would be subject to the protective order previously issued in this action. All right, so that sounds like whoever gave a discovery deposition and thought that it was going to be concealed under
Podcast Host Bobby Capucci
the protective order, they're going to be notified that their name is going to be released in these unsealed documents.
Podcast Analyst Bobby Capucci
B, Persons who are identified as having allegedly engaged in sexual acts or with Virginia Roberts or other alleged victims or allegedly facilitated such acts. All right, so that portion is people who are having the finger pointed at them by Virginia or other survivors, naming them directly as people who took part in the crimes or who helps facilitate those crimes. So those people who, who are named in the documents that are going to be released must also be made aware that their names are mentioned and that they are in jeopardy of having them, their, their information put on blast. So they will be notified and then they will be given, I think two weeks, I believe two weeks.
Podcast Host Bobby Capucci
I'm sure it'll tell us in this
Podcast Analyst Bobby Capucci
article, I believe they have two weeks to answer the charges or answer the, the fact that their information is involved in these documents that are being unsealed. C, Persons whose intimate sexual or private conduct is described in the sealed materials. So obviously anyone who talks about any intimate situation they were involved in in
Podcast Host Bobby Capucci
regards to the Jeffrey Epstein criminal enterprise,
Podcast Analyst Bobby Capucci
those people will also be identified and not identified, but they will be contacted and they will be told that their names are going to be coming out as well. And if they object, then now is the time to do so. D, Persons who are alleged to have been victimized by Epstein and Ghislaine Maxwell. Again, same situation. If those names come up in documents that are going to be unsealed, then they must be contacted first, them and their lawyers, and told that their names are going to be brought up in
Podcast Host Bobby Capucci
these documents and they'll have a chance
Podcast Analyst Bobby Capucci
to object to that. The slate of names is being sourced from filings made by attorney for both Roberts and Maxwell. Each Side presumes that the people on their prospective lists are likely to suffer privacy, reputational or other damage when and if their names are revealed in the Epstein files. So this is where it gets a bit confusing, right? So both sides are saying that certain names shouldn't be released without those people being told first because they could suffer privacy, reputational or other damages. Now for me, I think the most
Podcast Host Bobby Capucci
interesting part is, and I guess for everybody probably is what, what those names
Podcast Analyst Bobby Capucci
are, who those people are, and if they object to their names being revealed in these documents that get unsealed, then I'm sure that there will be some sort of process for the judge to decide if she is going to keep their names private with redactions or if she will go through and just release the documents as I guess that will be up to Prescott and it will be at her discretion. I am not positive about that, but I believe that is how it works. Because the original parties, Roberts, Robertson, Maxwell, did not agree on one or more non parties to be included in the list. The court has resolved all such disagreements and shall issue to the original parties a court approved non parties list which shall be sealed. The order notes explaining that each non party will be identified by his or her name, which correlates to a unique pseudonym identifier that is Doe number one, Doe number two and Doe number three. So it looks like Virginia's lawyers and Maxwell's lawyers couldn't come to an agreement on one or more of the non parties that should be included in the list. So the court stepped in and they have resolved those disagreements and now the court is going to issue the original parties with the non parties list. So again, this is confusing stuff, right? This is definitely the kind of situation where we have to stay on top of it because it's a lot for those of us who are not lawyers to, you know, you know, manage to wait our way through because there's just, I mean, a bunch going on here. Right. So, but basically what is going on is the court had to step in because the lawyers couldn't come to an agreement. And now the court is going to facilitate the process. Presco plans to review several sealed filings at a time in order to facilitate the review on a rolling basis and in a manageable fashion that will take stock of each name as it appears in the secret Epstein files. Well, that's not really new. We knew that Judge Prescott planned on doing this on a rolling basis, that she planned on doing it in a. In increments. Right. Have one tranche of documents Released, go through the next, make sure everything's legit, release that tranche. And that's the way she has said from the beginning that this was going to occur. But now with the court having to facilitate all of this as well, it should get pretty interesting. And it's probably going to be a bit of a drawn out process. But again, when it comes to the federal court system, I expected nothing less. The order notes how this will work in real time. For example, for Doe number one, the court would review each sealed item that mentions doe number one and would do the same for dose number two, number three, etc. This will allow the court more easily to manage and review any objections from non parties.
Podcast Host Bobby Capucci
So again, remember, this doesn't mean that,
Podcast Analyst Bobby Capucci
that their names are going to be redacted and nobody's gonna know who they are. They have a chance to object to their names being released in these documents. And then it will be up to Judge Prescott ultimately to decide one way or the other. Robertson Maxwell will be alerted via judicial minute order notifications that any given person stands to have their name revealed in any given set of of documents. Both Roberts and Maxwell's attorneys will then be tasked with confidentially altering each of the people named in the materials. So if somebody has to get their name redacted, the court will let the attorneys know so that they can take the steps that are needed to be taken to make sure that things remain as confidential as the protective order demands that they remain. Service shall be affected via first class certified mail return receipt requested. The order notes after service the party causing the service. So the party who is sending the mail a certificate of service stating the date and method of service and identifying the non party by his or her pseudonymous identifier. So obviously not by name by pseudonym identifier. That's the key. It's about privacy. Here is what's going on. It's to make sure that people's privacy is respected in both areas. To make sure that people who are mentioned within these documents have their chance to object. And there is a good chance that
Podcast Host Bobby Capucci
a lot of these people will object.
Podcast Co-host/Interjector
Right?
Podcast Analyst Bobby Capucci
I mean you would think. And then it moves on to the next step where Presca ultimately will decide. Various timelines begin to toll once a named person is served notice of their presence in the Epstein files within 14 days of service of the non party notice, a non party identified by his or her pseudonym may submit to the court a request for excerpts of the sealed materials pertaining to him or her. The order notes given a named person two weeks from the date of service to request context about why they were included in the sealed materials. All right, so they have basically a month when they get noted, when they
Podcast Host Bobby Capucci
get noticed that they're going to be mentioned in this.
Podcast Analyst Bobby Capucci
And then it gives them the two weeks from the date of the service to request context.

So
Podcast Analyst Bobby Capucci
once they get served, once they get this information, they have the that two weeks from the date that they are served to request all the information that's involved that has to do with them and why they were included in this sealed materials. Upon receiving the ex excerpts, those people will then be granted an additional two week period to file objections or. All right, so that's a month, right? So that's how it's that, that's what it's going to be like. So I would guess that something like this will happen. We'll see a tranche of documents dumped one month, then we'll have a month or two off, a tranche dumped a month or two off, a trench dumped a month or two off until there are none left. That is the way I think it's going to break. But again, I don't have any inside information. That's just speculation on my part. That's already one month from notice of being served that they're mentioned in the Epstein files to mount a case against the public ever knowing of their affiliation with the Epstein saga. So that's where it gets dicey, right? These people are going to have a chance to keep their names off the record. That cannot occur. I mean there is no way that that should ever occur at this point. I don't want to hear no redactions. I don't want none of that bs, none of it at all. Because at this point, if you're named in those documents, my friend,
Podcast Host Bobby Capucci
you should
Podcast Analyst Bobby Capucci
not have been associating with Jeffrey Epstein. And if you're close enough to be named in these documents, well, you were probably pretty close to Epstein and Maxwell after filing their initial objection. There are three additional seven day Periods that allow one, attorneys for Robertson Maxwell to object to that. Objection. Two, attorneys for the named people to file an opposition, and three attorneys for Roberts and Maxwell to file additional support for their opposition. So it becomes even more convoluted.
Podcast Host Bobby Capucci
Right.
Podcast Analyst Bobby Capucci
That's why I said a month or two and then another dump. So you're looking at it could be another three weeks right there. So you're looking at about two months of time between each one of these tranches of information getting dumped. And that is after all of the legal wrangling. But again, folks, I told you, you have to set yourself up and be prepared for this to occur. We're, you know, this is a federal battle with high profile people and lawyers, and there's gonna be a lot of wrangling, there's gonna be a lot of dragging of the feet. These people are going to try and drag this out as long as possible. That's just what they do. Those multiple timelines already stake out at least two months worth of waiting for the next tranche of files related to Epstein's alleged global sex trafficking empire for the elite. But that's all essentially just the first step in the process. Per Judge Preska's order, after objections, responses and replies have been submitted and any evidentiary hearing held, the court will enter a minute order setting the date and time. It will decide in open court the objections lodged as to each set of motions. Well, that does sound like it could take a long time. I will say this Presca has been pretty solid with keeping to a schedule here and keeping things moving in a forthright, forthright manner because she has really unclog things here. So I would expect Prescott not to take too long going over these documents after all of the objections have been turned in. Appearance by any of the parties or non parties is optional. The court will determine whether each sealed item shall be one, unsealed in its entirety, two, unsealed in redacted form, or three, kept under seal. Thereafter, the court will issue a notification of the next set of sealed items to be decided. So again, look, let me just prepare you folks out there for the fact that some of this stuff might not end up breaking the way we want it to break.
Podcast Co-host/Interjector
Right?
Podcast Analyst Bobby Capucci
We have to expect that. We have to expect that these high profile lawyers are going to catch some W's along the way. They're going to get some victories along the way. And there might be some pieces of this information that are not brought to light right away. But there are the appeal, there's the appeals process, There are Several other steps. It doesn't mean that it will never be brought to light. It just means that this time around, for whatever reason, Prescott, the judge, has decided not to release it unredacted or
Podcast Host Bobby Capucci
to keep it sealed completely.
Podcast Analyst Bobby Capucci
So just prepare yourself for stuff like that to happen, because it's going to. In other words, the names that will be revealed, if they are revealed at all, shouldn't be expected anytime soon. And for us here on the podcast, we knew that. We knew that we shouldn't expect more documents anytime soon. Prescott has been very clear about how she's going to go about this, how these documents are going to roll out and how she plans on unsealing them and how she plans on having that process build, because there are a lot of documents, right? A ton of documents. So I think that the plan that she has is a good plan. Obviously, all of this red tape is a bunch of bs um, but at the end of the day, you know, like I always say, everybody's entitled to the same rules under the law. At least that's the way it should be.
Podcast Host Bobby Capucci
And if the law allows for this
Podcast Analyst Bobby Capucci
to be the case, well, then the. The defendant, which is Ghislaine Maxwell in this case, has every right to try and go down these roads. It's up to the prosecution to make sure that she is cut off at the knees every time she hits an intersection. And so far, so good for the prosecution in the criminal case.
Podcast Host Bobby Capucci
Right.
Podcast Analyst Bobby Capucci
And in the civil case, Presca has done a very good job here, and I expect her to continue to release these documents. Now, again, I'm not sure when it's going to happen, but in my opinion, we will see a majority of these documents released, but there will be some of them that will not see the light of day. So make sure you're prepared for that.
Podcast Host Bobby Capucci
You know, we talk about it all
Podcast Analyst Bobby Capucci
the time here about how when you're dealing with the federal court system and you're dealing with the federal government, it's a. A long process.
Podcast Co-host/Interjector
Right.
Podcast Analyst Bobby Capucci
And you're in a federal case like this and you have high profile lawyers, well, they're going to get a couple of victories along the way.
Podcast Co-host/Interjector
There is zero doubt about it.
Podcast Analyst Bobby Capucci
So just be prepared for that. And, you know, understand that this is going to be a very long process. There are still many ups and downs left on this roller coaster ride, but I think that things are moving in the right direction.

Podcast Co-host/Interjector
One, we have two articles we're gonna get into tonight, folks. And the first article has to do with the defamation case between Ghislaine Maxwell and Virginia Roberts and the ruling made by the judge overseeing that case, Loretta Presca. And the second article we're going to read is about our good buddy Nicholas Tartaglione and how his lawyer is now demanding that there is a hearing and an investigation into the missing footage.
Podcast Host Bobby Capucci
He wants to have a hearing and
Podcast Co-host/Interjector
he wants to know why that footage went missing. Can't blame the guy, right? Well, we're gonna get into both of those articles tonight. We're gonna read about both of those and we're gonna see what motivated Judge Presca into making her decision. And we're gonna see what the lawyer over here in a our good buddy Nicholas Tartaglioni's case has to say. And you know, it's kind of, kind of sucks that Prescott decided to not release the documents. But as you'll see in the article, I'm sure she's. They're going to go into why she decided not to unseal those documents and also she talks about what could happen with those documents in the future. So let's read that article first. We'll jump into that one first because I think that one's a little bit more important. Right. We've been waiting for this ruling and I thought it was going to be on the 16th, but I, you know, guess not. Today's the 13th and that's when the ruling came down. So let's hop into this article. This article is from lawandcrime.com the author is Jerry Lam and it was published January 13, 2020 at 4:04pm make sure you hit the article too, folks. It's always a good idea to, you know, check out what they have going on, pictures and all that stuff as well. And there's always helpful hyperlinks so you can follow, you know, different things that were going on previously in the case. So it's always a good idea to click on the links as well. All right. To the article. A federal judge in New York on Monday ruled that that previously unreleased documents concerning dead pedophile Jeffrey Epstein would not be released as part of a defamation dispute involving Epstein's alleged madam, Ghislaine Maxwell, and alleged victim, Virginia Roberts. Now, we all knew that this was a possibility, right? We all knew that Maxwell's attorneys were working overtime to make sure that this didn't occur. And I'm guessing that it didn't fit the scope of what the judge saw as pertinent. Again, another judge who doesn't see things that should be released to the public as things that should be released to the public. Right? Though the case ended in 2015, Roberts attorneys have sought to unseal additional documents initially filed under seal. While Maxwell's legal team argued that documents do not fall under the definition of judicial documents and therefore are not subject to the presumption of access by the public. In an 11 page ruling, U.S. district Judge Loretta A. Presca, who in August ordered the release of more than 2,000 previously sealed documents, found that the remaining documents were not judicial in nature and therefore not subject to the presumption of public access. And I believe that that can be argued, folks, this is not the end of the conversation by any means. You know how these lawyers work. The lawyers for Virginia Roberts will kick it into the next gear now and they'll kick it up to the next, the next court or they'll have it before another judge or they'll bring more evidence. This is certainly not the last word we've heard of this, but it's still, it still sucks. I was hoping that these documents would be released and we'd get what I love, you know, what I love to always talk about, we'd get a little bit more context added. Right. And some more names. In order for a document to be considered judicial, it must be somehow relevant to the exercise of federal courts in determining actual controversies arrive arising between adverse litigants. In this case, the underlying litigation between Ms. Roberts and Ms. Maxwell has long since settled, Presco wrote. Accordingly, all disputes regarding the underlying merits of the action have been rendered moot by the settlement. There is thus no live controversy to which the judicial power can extend. The vast majority of the documents in question were motions filed by Roberts that the trial court judge did not rule on before the case settled. With respect to motions left undecided by the trial judge, there was never and now never can be a judicial decision making process that would trigger the public's right to access the undecided motions and the documents relevant to them, Presco wrote. But Presco also stressed that her ruling was narrow in scope, meaning it was tailored to the specific facts currently available and could be subject to change. And what that means, folks, is if more evidence comes forward and with the fact that Ghislaine Maxwell is under investigation as we speak, if more evidence is presented, the court and Judge Presca could change her mind.

Podcast Co-host/Interjector
The court is mindful of the, of the fact that there is a great deal of public intrigue surrounding the unsealing of the documents at issue here. With that in mind, the court emphasizes that this ruling is a narrow one. She wrote, and that's big. She's saying that it's by the slimmest of margins that these documents are saying sealed for now. And if the evidence is presented in the future, she is open to changing her mind and unsealing those documents. Notwithstanding the fact that the undecided motions in the papers associated with them are not judicial documents, they may eventually be unsealed because they are in some way relevant to the trial judge's actual decisions, which are numerous that are certainly subject to the presumption of public access. And if you click on this link that will be in the description box, you'll be able to give it a read and it has the whole entire 11 page ruling by the judge. So obviously, as I've stated several times, and as you all are pretty aware, I'm certainly not a lawyer, folks, right? But this does leave the door open. For this to move forward now, they'll have to provide more evidence to the court and specifically to Judge Presca. But she has not made up her mind. And by the, it's only by the slimmest of margins that these are, these files are staying sealed as of now, and that's the way I'm interpreting it. Anyway, I, I, like I said, I'm not a lawyer. Obviously to me that's what it looks like. It looks like she hasn't truly made up her mind. And the only reason that she's keeping them sealed at this point is because the law is, the law states that she must do so. And if they brought. If they bring more evidence here? Well, I think that she'll definitely change her mind and we could see a different outcome in some sort of appeal to this ruling. All right, our next article is about Nicholas Tartaglioni, and this article is from the Daily News. It's by John Anise, and it was published on January 13, 2020 at 11:19pm Lawyer for Jeffrey Epstein's cellmate wants hearing on why video of first suicide attempt was destroyed. Yeah, it's probably a good idea. I don't think it's a bad idea for there to be a hearing about that. But again, what are the investigators going to investigate? The investigators? I mean, it's a joke. We need some. I know I'm beating a dead horse here, folks. We need some sort of commission. The lawyer for Jeffrey Epstein's former cellmate wants to know who screwed up when video of the billionaire perv's first suicide att was destroyed and how the snafu happened. Yeah, that's pretty much what everybody wants to know. Who was in charge of the chain of custody of the evidence? Who was in charge of the evidence? Who was in charge of the person who was in charge of the evidence? Where was the guard, the supervisor on duty when all of this was occurring? Nobody checked on their employees for eight hours. I don't know about you folks, but if you. If you've ever been a supervisor or a boss, you know you can't give your employees more than 30 or 40 minutes on the front line without checking on them to make sure they're doing the right thing. I'm sure it's the same here. Right? I'm sure if these. These guards have access to the Internet and they're hanging around and they think everything's just going to be just fine with Jeffrey Epstein, well, they should probably be checked on every once in a while, don't you think? Bruce Barkett, lawyer for quadruple murder suspect Nicholas Tartaglioni, is calling for a hearing to get to the bottom of the mind boggling drama surrounding the footage, including whether anyone acted in bad faith on the federal government's part. You think whether anyone acted in bad faith, huh? You think this was an accident? You think it was an accident that the wrong tier was being videotaped? You really think that was an accident? You think all of this stuff leading up to Jeffrey Epstein's death was just coincidence? It was just circumstance. It just happened to happen. You know, that's it. That's what they want you to. To believe. They want you to believe that it was just all coincidence. And the problem was. Well, the problem was the guards had to work overtime, so they were extra tired, so they weren't able to perform their duties. That's what they want you to believe when in reality, we've all seen the big picture now. We've had the curtain pulled back. We have stared directly into the room, and we have seen the deviousness. All right? So they can't put that back in the box now that the pin Pandora's box is opened, and the things that have escaped can never be put back in. At first, U.S. attorney Jason Swergold said the footage hadn't been preserved 20. Preserved. 24 hours later, he reversed himself and said the video had been archived. Last week, however, prosecutors said mcc staff preserved footage from outside the wrong cell and that the footage was destroyed after all, declaring the video no longer exists on the prison's backup system because of technical errors, prosecutors wrote. Technical errors? Were there technical errors with any of the other prisoners on the. On the line? No. Just Jeffrey Epstein. Huh? It just so happened that only the cameras that were supposed to be trained on Jeffrey Epstein and on his cell were the ones that malfunctioned it all. It's only Jeffrey Epstein's evidence that disappears. I wonder why, folks. I wonder why. Do you think it was because he was a great guy and everybody just loved having him around. He was just such a swell fella. Everybody just wanted to hang out with good old Jeffy Eppie. Or was it that he was greasing everybody's pants and he was making sure that he had his tentacles wrapped around everybody that you could possibly imagine in a place of power. That's how this man rolled. Aside from mentioning MCC staff, the government has not provided the name of a single individual responsible for the loss of the video. Barkett wrote on Monday's court filing. Yeah, I've been saying that for how long? You got these two guards, the. The two prison guards that were responsible for minding Epstein and checking on him. We know everything about them. We got their names, where they live, et cetera, et cetera. But the people that were in charge of the chain of custody of the video. Nah, we don't know anything about them. That's just staff. It's just staff, really? What are you, the. Oh, man, it makes me so mad. This makes me. This makes me so aggravated, folks. So aggravated that they could be this inept. And if it's not ineptitude. Right, if it's not ineptitude, then what is it? Straight up, Malfeasance Tartaglioni, a former Briarcliff Manor cop, is accused of murdering four men in an Orange county bar over a Mexican cartel linked drug deal gone bad and burying their bodies on his sprawling animal rescue farm. Well, kudos for the animal rescue stuff. Give you some props for that. But the rest of your life, you seem to be like a pretty despicable human being, sir. He could face the death penalty if he's convicted of the murders. And Barkett hopes the video will show he acted admirably by alerting the correction officers in time to save Epstein's life after the failed first suicide bid. Oh, yeah, I'm sure this guy is a pillar of the community, folks. He was so worried about Jeffrey Epstein living that he contacted the guards. You know, he stood up and was yelling, hey, Epstein's hurt here, folks. Whoa. Somebody come and help him. Stop it. All right, we all understand what occurred. This dude assaulted Jeffrey Epstein, all right? That's what Epstein said. Epstein said that he was assaulted. He didn't say he tried to commit suicide. And then he was put on suicide watch by the Keystone Cops here at the mcc, and somehow he still ends up dead. We're not looking to point fingers at anybody. We'd like to have a record of what took place with the video, Barkett told the Daily News Monday night. We want to be able to show that incarcerated, he's still acting appropriately and doing the right thing, as in Nicholas Tartaglioni. Epstein hanged himself in a different cell at the troubled jail Aug. 10, which he occupied alone, officials said. Barkett said he wants to know who the Federal Bureau of Prisons lawyer Adam Johnson spoke to when he advised prison staff to preserve the video and what was done in response. These are great questions. These are great questions from Mr. Barkett. Even though I believe his client is a scumbag, I think Mr. Barkett is on the right track here and he's asking the right questions. He listed the string of questions he hopes to ask at the hearing, including who actually viewed the footage prior to its destruction. Are there protocols in place at MCC with respect to evidence preservation? Were the digital records ever actually checked for accuracy? Who was the MCC staff member who initially confirmed that the video had been preserved? All fantastic questions, all very good questions that all need answers. Do you think we'll get those answers, folks? Do you think the federal government will be forthcoming? Do you think Mr. Barr is going to be forthcoming? Or are we gonna get some more yap about how he's seen the footage and we should believe him because he's telling us that nothing happened. What? No, I don't believe you. I don't believe any of them. I don't believe any elected. Elected official at this point. I don't believe any bureaucrat who has been appointed by elected officials, and I certainly do not believe anything that Nicholas Tartaglioni is talking about. This dude's a rogue cop who's on the hook for body and four dudes in a drug deal gone bad.

relying on for evidence. You know what George R.R. martin would call someone like that, folks? George R.R. martin would Call that an unreliable narrator. And that is what Nicholas Tartaglioni is, an unreliable narrator. Really, though, the real problem is, and the elephant in the room is why in the. The why in the world, okay, in the first place, was Jeffrey Epstein even in a cell with that big guy, that big roided out monster of a man who is charged with four murders? You don't put Jeffrey Epstein in with some sort of, you know, some embezzler or some computer criminal, and you send that computer criminal or embezzler in there or white collar crime person in there with the intent to try and work Epstein for information. Instead, you put him in with a guy facing four bodies. Why would you do that? Unless, of course, it would just be convenient for your problem to go away by Nicholas Tartaglioni taking care of it. Now, I'm not saying that that's, you know, that Tartaglioni was definitely going to do that, but the optics do not look good, folks. Right? Why would you put Epstein in this jail cell with a guy like Tartaglioni? This is a man that obviously has no problem with violence, charged with four murders and a drug deal gone bad. And if he was willing to murder four people, I'm pretty sure that it was not his first time. Okay, now you have him in jail, and who's to say who's reached out to him? Who's to say who he knows? So why would the prison, the jail, think it's a good idea for him to share a cell with Jeffrey Epstein? Nobody can answer that question for me either. Why wouldn't you have Epstein in with a. With a guy like the. The Mersky guy that we. That we talked about a few weeks back, the guy that was basically Epstein's quote, unquote companion, the old fella? Why wouldn't you have that guy as. As Epstein's cellmate, and he's a known, confident confidential informant as well? You have him work Epstein for information. Instead, you put him in with this Tartaglioni guy. And you know that Epstein was shitting his pants, right? This is a guy that comes from high crust. He's never had a big grease monkey like this ready to choke him out. A big gins alone dude like this, right? There ain't no way in hell he's ever been in a jail cell, a small confined area where he can't get away with a monster like Tartaglioni. That's a big. That's a big dude, folks. And. And willing to go to that length of violence of killing four people in a drug deal gone bad. I'm guessing Jeffrey Epstein was none too plussed about being in there with him. And is it too far of a stretch of the imagination to believe that Tartaglioni assaulted Jeffrey Epstein in that prison cell? He knows he's looking at life, Tartaglione, possibly the death sentence. So if he assaults this child molester, he gets some credibility when he goes and hits the main line, right? When he hits the yard. He might be an ex cop, but he was a dirty ex cop. And now he. Not only is he a dirty ex cop, and he has some street credibility that way. Well, he busted up this chomo, right? Hey, I busted up Jeffrey Epstein. What up? So, you know, prison's a whole different place, folks. And the rules are different, the politics are different. Everything is different. So if you think Tartaglioni is above assaulting Epstein this first time around, I got news for you. He is not. All right, folks, I'll be back tomorrow morning with the usual morning update, daily drop, and we might even do another evolution episode tomorrow afternoon. I want to do a couple more leading up to Santa Fe, a few more on Santa Fe. That way we have as much context as possible heading into the trip. And we talked about how that would impact her investigation, Denise George's investigation that she has initiated within the Virgin Islands. Well, this morning we have an article from Law and Crime that's going to add a little more context to that. The original article we read was from the Miami Herald, but like always, I like to add some context and prefer to use articles from Law and Crime or other sources that deal strictly in these sort of issues. So today we're going to revisit this whole situation with the depositions and Denise George being granted access to them. And we're going to get the perspective of Adam Klassfeld. This article is from lawandcrime.com the headline US Virgin Islands can Access Sealed Jeffrey Epstein Deposition and Other Secret Files. This article was authored by Adam Klassfeld. Now this is a pretty significant move, right? Like we talked about in the other segment when we were discussing this topic, it's a pretty significant move for Denise George to get access to these files as well. It's only going to bolster her case. And she already has a pretty strong case, folks. I mean, she has been dropping subpoenas like pigeons drop poop. She is not playing around and she is looking to get as many of these people on record and get as much information as possible in regards to Jeffrey Epstein and his behavior in the Virgin Islands at the very least. Now my question has, has been and will be what about her predecessors? What about the people who were there before her? What about the people who were working with Jeffrey Epstein who were part of the government? Are there going to be any sanctions on them? Are they going to face any penalties? Because they should, right? If they were the ones who gave Jeffrey Epstein these sweetheart deals and even common folk on the, on the island, regular old citizens, knew what Jeffrey Epstein was up to, how are we to believe that these elected officials or bureaucrats had no idea? So I think that it would be nice to see Denise George go after some of them as well and at least get Them on record, right? So there is a lot going on in the Virgin Islands, and we have these concurrent investigations running, and there is a lot to get to. So whenever we can add a little more context, especially when there's a bit of a lull in the news, then, you know, I like to do that, because the more we understand what's going on and the easier it is for
Podcast Analyst Bobby Capucci
us to put the pieces together, the
Podcast Host Bobby Capucci
more chance we're going to be able to see the big picture clearly and not be confused by all sorts of nonsense, right? And, folks, there is a lot of that. I, you know, I get. I'm tagged on some feeds, on Twitter sometimes, and I see posts from some people and I'm like, man, that's a big statement. What kind of evidence do you have to back that up? You see, you can't present things as fact without the evidence to back that stuff up, right? So I try to be very careful about what I present to you as factual, 100% locked in. And then what I think is happening. And I try to be very clear about that. And it seems like a lot of people don't do that. Like, I don't know anyway, for me, unless we have some strong circumstantial evidence, at the very least, I try to just steer clear of it, right? And now that doesn't mean I don't believe that, you know, some of that stuff is true and legit, because I do. But it's not about what I believe. It's about what we can prove, right? So it's always important to add as much context as possible and present you folks with as much information as possible so you can make your own choices and come to your own conclusions and form your own opinions. That's what I love about this, this group of listeners on this podcast, you folks, you get the information and then you form your own opinions, right? You don't let nobody dog walk you or gaslight you. And I think that's the most important part here because there is a lot. And when there is so much information, it's really important to try and get it all into context, right? And that is my goal when we talk about these stories, to try and get them into proper context so that we can have an understanding and a sense of a little bit of what's going on, right? And pull the shade back a little bit and get a better look, a clearer look behind the curtain. So that's what we're gonna do with this article this morning. And we're gonna see what Adam Klassfeld, excuse me, has to add to the story because his commentary when it comes to Ghislaine Maxwell and the way he breaks it down has been very, very, very good throughout this whole entire case. So the US Virgin Islands can access Jeffrey Epstein's sealed deposition and a secret list of other witnesses put on the hot seat for its enforcement action against the accused sex traffickers estate. A federal judge in New York ruled on Wednesday. So we talked about this, right? It's huge. The secret list of witnesses, I think, is a gigantic deal. Now, I'm sure that several of those secret witnesses have already received subpoenas by Denise George.
Podcast Analyst Bobby Capucci
Right.
Podcast Host Bobby Capucci
Leon Black, Glenn, do. But I'm sure a couple of those guys are part of this witness list, you would think, right? Again, I don't have that information, you know, given to me by anyone with any inside info of the story. But you would think that on those lists would be a couple of those people that have been named in the defamation case and people who played a role within Jeffrey Epstein's criminal enterprise. The United States Virgin Islands may use these materials solely in connection with the USVI's pending Virgin Islands Criminally Influenced and Corrupt Organization act enforcement action against the estate of Jeffrey Epstein and and several Epstein controlled entities. So again, I think it's an incredibly awesome occurrence here in the case that we even see this Criminally Influenced and Corrupt Organizations act enforcement in these articles. And the fact that Denise George has initiated the, the SECO investigation is a huge deal. I think it, it provides precedent for it to move from the criminal, I mean, excuse me, from the civil realm into the criminal realm. And with the precedent set and there being a civilly motivated RICO case going on, I think that it will not be long before a criminal RICO case is announced. I am almost positive, 100% positive, that they are pursuing this case behind the scenes as a RICO case. And I think once we see one or two more arrests, then that's gonna open up the floodgates, folks. U.S. district Judge Loretta Presco wrote in a 17 page order advancing a probe where Epstein had a home on what locals there called Pedophile Island. And I was talking about that in the opening here of the podcast, how even all the locals knew the deal, right? The locals knew that this was Pedophile Island. You mean to tell me that the politicians that set him up with these tax havens, with these breaks, with these, these different sorts of benefits down on the island, that they had no idea what Jeffrey Epstein was up to? I'm sorry, but I don't buy it. So I really think that Denise George should be going after some of these people and at the very least getting witness statements from them. The US territory moved to intervene in an open records case involving Epstein's accused accomplice, co conspirator, general all around scuzz bag, child abuser and bipedal serpent, Ghislaine Maxwell and their alleged survivor, Virginia Roberts. In which an effort to bring transparency to the docket has been underway for more than a year. And we know that that all started in Prescott's court, right? She got the ball moving, she got everything in motion and she's been pretty steadfast in releasing of these doc, in the releasing of these documents. She hasn't been playing games, she hasn't been getting bullied and she's faced some high profile people, right? We know that Alan Dershowitz isn't coming to the party without some high profile attorneys. We know that Ghislaine Maxwell's attorneys are high profile and we know that Presca has handled herself and them very well. One of the depositions unsealed recently showed Epstein's former house manager, John Alessi, claiming that Maxwell constantly took photos of topless young women visiting Epstein's pool and kept them in an album. And you see, this is an interesting thing here. The album stuff has been something that I've been asking about and I've not been able to find any proper answers for it. Where is this album or these albums? Does the government have them? Were they stashed somewhere? Does Borgerson have them? Does the CIA have them? Where are the albums? And I think that would be a decent question to ask the prosecutors at one of these, you know, press conferences, if we ever get to have one of them ever again. Um, you know, look, it's obvious that there were mountains of evidence as far as Jeffrey Epstein and Ghislaine Maxwell's documentation of these topless girls and other racy rated X type pictures of minors. We know that they exist. Now my question is, where are they and are they going to come into play during the trial? You would think so, right? And if they go the route that I think they're going to go and supersede the indictment and add RICO charges, then for sure that those, those albums and those pictures and the videos, all
Podcast Analyst Bobby Capucci
of that will be added to evidence.
Podcast Host Bobby Capucci
But again, I'm very, I, I don't really trust the government and their procedures at this point. We see the way they handle the whole entire Epstein ordeal. We see what happened with their internal to the Department of Justice. So forgive me if I don't have too much faith in them doing their jobs correctly. So while I will continue to hope
Podcast Analyst Bobby Capucci
that they pursue this the right way,
Podcast Host Bobby Capucci
I'm not gonna let my guard down and think that the federal government is just magically going to do the right thing. They have to be coaxed into it.
Podcast Co-host/Interjector
Right.
Podcast Host Bobby Capucci
We have to keep on them, and we have to let them know that this is important to the, the, the populace, this is important to the citizenry, and this is important to establishing a little bit of trust in the justice system. Once again, the US Virgin Islands government wanted the files for an enforcement action against Epstein's estate and several entities under his control pending before a superior court there. And I think that this puts Indyke and Khan into a lot of jeopardy folks. That's an aspect that isn't being talked
Podcast Analyst Bobby Capucci
about a lot here.
Podcast Host Bobby Capucci
But they have been named by their actual names, by Denise George in court documents and elsewhere as co conspirators with Jeffrey Epstein and people who are under the scope.
Podcast Analyst Bobby Capucci
Right.
Podcast Host Bobby Capucci
They're people that are being looked at by this investigation as co conspirators. Not just enablers, not just employees, but co conspirators. She has called them that. So Indyke and Khan are in a lot of peril here, in my opinion. The USVI asserts in its SECO action that Epstein ran a criminal sex trafficking operation in the Virgin Islands, wherein he used his vast wealth and property holdings and a deliberately opaque web of corporations and companies to transport young women and girls to his privately owned islands, where they were held captive and subject to severe and extensive sexual abuse. Judge Prescott summarized, and now you see right there in her summary, why I talk about the FinCEN files and we talk about the shell companies, et cetera, et cetera, for those of you who might be new listeners. And you caught that FinCEN Files episode and you were wondering what the hell I was talking about in the financial world. Well, it all ties in together very nicely here, and it's been part of our ongoing narrative on the podcast since pretty much the beginning. One of the first shows was about RICO and about these sorts of these criminal companies, these offshore companies, these shell companies, and how they're used by people like Epstein. So that's why the Finson files coming out when they did it was like perfect timing because we were able to add that to our conversation, and we were able to use it to add a little bit of context to the overall theme of how corrupt these rich
Podcast Analyst Bobby Capucci
people are and how they use these
Podcast Host Bobby Capucci
sort of offshore companies to hide vast amounts of wealth and to engage in criminal operations. Epstein dodged deposition questions by repeatedly invoking his Fifth Amendment right against self incrimination. And Maxwell argued that this was a reason to deny the Virgin Islands access to that file. Yeah, that's, that's really a great reason. You know, again, look folks, I've said it a million times and it just, it becomes more apparent as the days go by. They realize that they don't have a leg to stand on Maxwell's defense team and they know that she is not an innocent person. So they continue to try and go hard on these technicalities and loopholes, hoping that one of them pops, hoping that one of them provides some relief for the bipedal serpent. Disagreeing, Prescott noted that the government can draw an adverse inference from the fact in civil litigation. So you see, this is why, again, why we're reading this article and adding to the original Miami Herald article. Because there's always little nuggets, right? Clasveld goes into a little bit more detail here than we got from the Miami Herald article.

Second, the substance of the deposition questions may on their own be fruitful, a jumping off point for the USVI's significant investigatory power. She added. So she is saying that the substance of the deposition questions on their own, not the answers, but the questions on their own, can jumpstart and help the USVI's investigation.
Podcast Analyst Bobby Capucci
So Presca is very,
Podcast Host Bobby Capucci
very forthright with how she's putting this to them, right? She's letting them know that their attacks on the technicalities and trying to use these loopholes. She's going to stymie them at every chance possible because this is not about the loopholes that you can find. This isn't about your relationship with the prosecutors. This is about justice being served. Finally, after decades of this bipedal serpent allegedly getting off on it. The judge agreed, however, that the the survivors may have privacy interests that deserve protection, which is why she denied a previous request. A Harvard professor, Alan I kept my underpants on Dershowitz. Now she didn't let Dershowitz get any of this, but she did give it to the Virgin Islands. And Denise George, considering that they are an investigatory body, they have power of subpoena and they could be put under sanctions by the court if they leak this information. Whereas those safeguards aren't in place when you're dealing with Douchewitz. And you know for a fact old boy is going to leak whatever information he has if he feels like it's going to provide him a, a good look.
Podcast Co-host/Interjector
Right.
Podcast Host Bobby Capucci
In order to make crystal clear to the USVI the significance of the privacy interests here, the court will prove will provide separately to the USVI a copy of the sealed order explaining why it excluded from its prior production to Mr. Dershowitz materials related to a certain non party Doe with particularly weighty privacy interests in the sealed materials at issue in this case, her ruling states. So again, there is still a doe here, a big, a big fish, it would seem, who does not want their name to be made public. And we see the wrangling going back and forth and hopefully moving forward we'll find out who this person is who wants their name kept secret. My guess is that it's Alan Dershowitz. He'll say that. No, no way. It's not me. I want all of this stuff made public, but I have a sneaking suspicion it's Dershowitz. Do I have any evidence to back that up? I don't. But it would be my guess that it's Dershowitz. If not Dershowitz, maybe Bill Clinton or perhaps Glenn Dubin, I don't know. One of, one of those type of folks though, is probably the person that is trying to keep their name from the public sphere here. The last thing they want is that sort of egg on their face. Rumor and innuendo are one thing. Seeing it on paper and taking a look at it for yourself in a court document, that is something else entirely. This “mega edition” episode is an in-depth, analytic walkthrough of the evolving legal drama surrounding the sealed Epstein files. With recent court orders, high-profile individuals now face the threat—and opportunity—of transparency. The release will not be immediate, and many legal battles (and potential redactions) remain, but Bobby sees the process as ultimately heading toward partial public exposure of those previously protected by secrecy.
Meanwhile, other legal fronts—such as the missing prison footage and the USVI’s energetic legal pursuit—are heating up, promising even more revelations down the line. Bobby closes by urging listeners to stay vigilant, skeptical, and ready for a slow, but possibly seismic, shift in the Epstein saga.
