Now that the indictment for Sean Diddy Combs has been unsealed, we're finally getting a look at the charges that the government is bringing against Diddy. And all of those charges that he's been slapped with come with mandatory sentences. And it's not something that a lot of people are talking about because obviously the 500 pound gorilla in the room is the RICO charges. But all this other stuff is bad news for him. And one thing that's really gonna come back and bite him in the ass and probably cause enhancers to kick in are those guns that have obliterated serial numbers. You can't run around with firearms with obliterated serial numbers. That's a 10 year stint right there just on the gun. So this dude's looking at serious time, folks, and he's in serious jeopardy of going to prison for the rest of his life. Today we have an article from Newsweek and the headline, sean Combs Case Compared to R. Kelly, Jeffrey Epstein and Diddy is screwed. This article was authored by Jenna Sundell. Well, I certainly can't disagree with the Diddy is screwed portion. And I think that if we're going to compare what's going on with Diddy to anyone, I think that R. Kelly is probably the right way to go. That's how this is going to be prosecuted. And my guess is that's the blueprint that they're going to use. Remember, this is the same office that went after R. Kelly as well. So I think that there are similarities obviously between the criminal enterprises of Diddy and Jeffrey Epstein. But we have to remember that Jeffrey Epstein and what he was doing was on an international level. He was bringing women in from Eastern Europe. He was bringing women in from God knows where. And these women were coming here and being put up at a building on East 66th street in Manhattan, all with the promise of a lucrative modeling career waiting for them in the United States. But that never materialized. Instead, they were sent out to go to different meetings with people to try and collect Kompromat. So while there are similarities, there's no doubt they're both criminal enterprises. They're both based on human trafficking. There are also some serious differences when it comes to Epstein and Diddy. And I think, in my opinion, anyway, the more apt description, the more apt comparison would be with R. Kelly. And I think that's what the prosecutors are going to do. When you look at the charges that they've hit Diddy with, I think they're going to use the blueprint that they built during that R. Kelly prosecution, especially considering the success they had with it. Right. They were able to nail him and send him to prison for the rest of his life with that game plan. So I don't see them deviating from that course and going a different way. I think they're going to pursue Diddy the same exact way they did R. Kelly. And I think when all is said and done, we'll going to have the same result. Legal experts are weighing in on disgraced rapper and music producer Sean Diddy Combs indictment on charges of sex trafficking and racketeering. Combs, 54, pleaded not guilty to the charges on Tuesday. The indictment alleges a criminal enterprise operating over a series of several years that involves coercing individuals to participate in various sexual acts. So one thing that we have to take from that is that them saying it's a criminal enterprise, there was definitely other people involved. So it's going to be real interesting to see who else gets indicted, who was around Diddy and who was working with him in forum, as opposed to the people who don't get indicted. Because those people have probably flipped, right? Because the only way to get yourself out of trouble here is to turn on whoever the boss is. And according to the government, the boss in this situation was Diddy. Diddy is screwed. Niama Rahmani, former federal prosecutor and president of West Coast Trial Lawyers, told Newsweek the big takeaways are obviously these are very serious charges. Everyone talks about the racketeering and how there's potential life sentence. But more importantly, some of these charges carry mandatory minimum sentences in prison. And that's what I was saying earlier. There's a lot in this indictment that's bad news for Diddy, and I think that the guns are really going to come back to bite him. I talked a little bit about this on Twitter last night, and I think that with the mandatory sentences that you see with these other charges, I think that Diddy is in gigantic trouble. And if things go the way that the prosecution thinks they're going to go. Diddy's going to end up going to prison for the rest of his life, just like R. Kelly. Kathy Fleming, a principal at the office of Kerman Litigation Practice Group, also emphasized the severity of the charges to Newsweek. They have alleged very serious crimes in a federal court alleging issues related to sex trafficking, meaning misusing the victims. And there is serious time consequences if someone is convicted of this. Fleming said to Newsweek. Yeah, no doubt about it. And we haven't even talked about the Mann act or anything else yet. And there's no way that this is the last iteration of this indictment. It's going to be superseded. They're going to add more to it. It's just a matter of time. Trey Lovell, an entertainment and civil attorney, spoke to Newsweek about the similarities between R. Kelly sex trafficking case and and Combs case. And I think this is the most important comparison. I know a lot of people want to compare it to Epstein and I understand why. Right. Epstein was one of the most disgusting, vile people in the history of the world. And then you look at what Diddy was up to and it's very similar. But when you really look at it, it's not the same. They weren't up to the same thing. It wasn't international, it wasn't for a kompromat. So there are a lot of differences. Does that make what Diddy was doing any less heinous or disgusting than what Epstein was up to? Of course not, especially to the people who were affected by it. So I'm not trying to say one's worse than the other. I'm just saying that they're different. And for me, I think the better comparison is the R. Kelly case. Now that doesn't mean that there aren't similarities. That doesn't mean that we shouldn't run them side by side. We're going to. But I think that when all is said and done and we see the way that this gets prosecuted and we see the evidence that's brought forward, it's going to resemble the R. Kelly case much closer than it did the Epstein or Maxwell case. R. Kelly and Al Diddy are representatives of high level, famous and in this case, in the music world, moguls who have chosen to live a lifestyle which the authorities question is illegal in many respects. Lovell said. And look, we all know that these depraved ass rich people live a different way than we do. They're up to a bunch of wild shit and they don't get off the way we do. When you're A billionaire, you don't get off the same way the working man does. I know that if I go to the casino and I blow a couple of hundred bucks, that's exhilarating, right? That's fun. You got a chance to maybe win a couple of bucks. Whatever you think that gets Diddy off? Of course it doesn't. For Diddy, it's something completely different. And that is something that he certainly had in common with Epstein. Once you get to this level, the depravity just increases. And it seems like all of these people that roll around in this so called elite society are up to the same bullshit. He said that both cases send a message about law and power. The government wants to make a statement that says no matter who you are, how much money you have, how powerful you are, we're not going to let you get away with stuff like this, Lovell said. Lovell also explained what has caused the shift in prosecuting these cases that have been ongoing for many years. I think it was triggered by the MeToo movement, when the MeToo movement happened and it cast this light on the dark world of the entertainment industry, Lovell said. Rahmani drew comparisons between Combs case and the sex trafficking case against Jeffrey Epstein. R. Kelly didn't have a whole lot of rich and famous people participate in acts with him, but Diddy reportedly did. And we know Epstein did, at least according to some of the evidence. And even though a lot of those people haven't been prosecuted, well, that much is certainly true. And I will say that the similarities between Epstein and Diddy certainly have to do with the famous people that they were palling around with. There is zero doubt that Diddy had some powerful friends. But there's levels to this, right? It's one thing to have powerful friends, it's another thing to be an intelligence asset. And Diddy most certainly, in my opinion was not that. Was he a depraved sick bastard? Absolutely. Did he have a lot of high placed friends who are very powerful in the music industry and in business? Most certainly. And there's no doubt that a lot of those people were attending these parties. Does that mean they were taking part in all this? I don't know. I wasn't there. I haven't seen any video. I haven't heard anybody come out and talk about who else might have participated. But it's certainly something that's on the table and I'm not going to say it didn't happen. I don't know. We'll have to wait and see how much more Evidence makes itself available to us as this whole process continues to evolve. But I would say that there's a good possibility that other famous people are going to find themselves caught up in this. Rachmani also raised the possibility of other individuals being implicated in Diddy's alleged criminal scheme. Anyone who participated in the sex acts should be really worried, Rahmani said. There's a lot of rumors down here in la. I live a mile away from Diddy. There are a lot of rumors that a lot of other celebrities participated in these acts. I would certainly be worried if I were them, because they could easily be charged, especially if there is video evidence. If you're on video and you were over at Diddy's diddling somebody, you're going to be in big trouble, no doubt about it. The question is how many of these people were participating? So what we're going to do around these parts is we're going to take the same approach that we did with Epstein and we're going to look at all the evidence and we'll go from there because there's going to be a lot of disinformation, there's going to be a lot of BS surrounding what's going on with Diddy, what's going down with Diddy and who he might have been associated with. So we're going to take the same approach that we did with Epstein as we work our way through this. Fleming describes some of the difficulties the defense will face if Diddy does go to trial. You have to get a jury who says they're fair and impartial, which for the defense is a challenge, because a lot of people believe if you're charged, you must be guilty. Fleming said. That's an unfair concept and they shouldn't do that. Everyone's presumed innocent unless and until the government proves its case beyond a reasonable doubt. She said the media coverage could also pose a challenge for the defense. They also have a problem of pretrial publicity, that this is a big story and a lot of people are writing about it, and there's always a concern that potential jurors will read about it, make up their minds before they hear the evidence and in the courtroom, as opposed to what they read about it in the newspapers and particularly the Internet, because the Internet is not known for being accurate in lots of respects, Fleming said. Oh, but the media is. The media's been lying to us for how long? And all of a sudden the media should be the arbiter of truth still. Sorry, I don't buy that.

I don't buy that for a second and my guess is most of you listening to this podcast don't buy it either. Lovell said that the sheer amount of evidence in the case can also pose some difficulties. Yeah, you think? I would think that that's the most important thing. The evidence in the case and the evidence here seems to be pretty overwhelming when you have what prosecutors said is up to 50 witnesses and victims and you have video evidence and physical evidence they got from the houses and if indeed it corroborates each other, that's very compelling, lovell said. Prosecutors will also face some struggles as they argue their case, according to Fleming. They've got to convince all 12 jurors that the person they've charged is guilty beyond a reasonable doubt on all the elements of the crime, fleming said. And they also have the challenge of they've got a very famous defendant and that makes it highly watch proceeding. Well, that's true. But guess what? The evidence is what the evidence is and for me that's the most important thing. All the salacious bullshit, all the nonsense, that's fine and well, people are going to engage in that. But me, I'm trying to get to the meat and potatoes. What are the actual charges, what do they mean and who's involved? And then from there, well, we can see where the salaciousness takes us. Fleming spoke about her own experiences being part of high profile cases. There are differences. The first is that the press is out there and they do a lot of investigative work which can either help or hurt the depending on what the facts are, fleming said. Another part of it is that there's a lot of press in the courtroom. People in the courtroom at trials, including generally the judge as well as the participants behave differently. They're conscious of the press being in the room. Well, we have an open system here in America, so they better get used to it. Prosecutors must also face off against someone who can afford a lot of resources. Having a lot of resources can help a defendant significantly because they can afford to hire not only the best lawyers but they can afford to hire investigators and find out ways that they can help to attack the government's case at trial, Fleming said. Witnesses called in the case could also feel worried about facing the defendant, according to Rahmani. They may be afraid of him and he may intimidate the witnesses, rahmani said. While fame can often impact high profile cases, Lovell does not think that will benefit Diddy. I would think that based on the allegations and how serious they are, I don't really think his celebrity is going to help him, lovell said. And I don't think it's going to either. I think that Diddy's cooked, and I think right now we're just at the point where we're learning how cooked he is, right? Is he going to be well done or is he going to maybe escape with some lesser burns, if you will? But one thing's for damn sure, there's no way that he's just walking away from this, unless of course, he pleads guilty. But besides that, this is going to trial and we're going to be following along every step of the way as it makes its way through the system and eventually into the courtroom. And the reason I'm bringing him up is when you look at the cases that are in the news, there aren't many that fit the bill of the Jeffrey Epstein case. But when you look at the R. Why is there not a RICO charge hanging over the co conspirators of Jeffrey Epstein? If R. Kelly is hit with a leadership charge, if R. Kelly is said to be in charge of a criminal enterprise that's based around sexual assault of women and young girls, then don't you think that Jeffrey Epstein and Ghislaine Maxwell should be classified the same way? You have Keith Rainiery, racketeering, rico, all these other people, rico, racketeering, but not Ghislaine Maxwell. So again, it makes you ask yourself why.

As his career blossomed, prosecutors say, so did the enterprise, which allegedly used a mix of co conspirators to recruit girls for Kelly and help keep them under his control. Kelly got, the more money he got, the more powerful Jeffrey Epstein got. As as far as getting ins of these inner sanctums of the financial world, the more power, the more profile and the more sway he got. And they all had, both had lieutenants, they both had people running underneath them to keep this enterprise going, to bring these girls in and out. So what's the difference here? The evidence includes alleged acts as recent as 2018. As Kelly's career was crumbling amid the MeToo movement, it would soon implode when Lifetime's docuseries Surviving R. Kelly brought renewed attention to his alleged crimes. And if you haven't watched that series yet, it's heart wrenching, honestly, as soon as this Jeffrey Epstein case became something that I just was so locked into, I knew that I had to watch that R. Kelly series, even though I knew it was going to be disturbing. And it was disturbing, no doubt about it. It's such a sad state of things when you have people like this running around the world and how many of them are there that we don't even know about? In all, prosecutors planned to introduce evidence involving 19 women, including at least seven who were minors the time of the alleged misconduct. As well as additional allegations that Kelly sexually abused the 17 year old boy he met at McDonald's. I mean, really? So this guy's running around a prolific molester, according to the prosecution. Boys, girls, it doesn't matter. However, he can get his rocks off this sick fuck. So there, there should be a place underneath the prison for people like this, people like R. Kelly, people like Ghislaine Maxwell, people like Keith Ray Neary, and certainly people like Jeffrey Epstein. Jurors will hear evidence that Kelly knowingly passed a sexually transmitted disease to some victims, orchestrated hush payments to others, and employed a strict system of discipline and psychological manipulation with victims that in some cases spanned years, court records show. Boy, that all sounds familiar, huh? Now not the sexual transmitted disease, but all the other stuff. Psychological manipulation, strict system of discipline and abuse that lasted for years. Decades folks. Okay, 70s at least. Attorneys for Kelly meanwhile, will be tasked with poking holes in each of the alleged predicate acts that make up the racketeering charge. Challenging witnesses on their memories and motives and on the existence of any illegal enterprise to begin with, legal experts said. And that's would be the challenge for Maxwell and her team, right? How would they prove that there was no illegal enterprise? They can't prove that there certainly was. Right. And again, I'm the reason I am even introducing this right now. We're even talking about. This is so you can look at both cases and say to yourself, well, why would one get RICO and not the other? What's the difference here? Well, one has political connections and one doesn't point blank, period. Among the questions for jurors to sort out, were the alleged victims really coerced or were they merely fans of Kelly's who participated willingly? Did they have a reasonable fear of retaliation for leaving? And in the case of alleged minor victims, did Kelly actually know they were underage? And these are all questions that can come up in the Epstein case as well, right? Look, the parallels are uncanny. When you look at the two cases and you see how R. Kelly went about his business and how Jeffrey Epstein went about his business, you can see how the organizations are very similar. Now one of them was way higher up in the atmosphere, meaning Jeffrey Epstein's. But they had the same kind of operational motives, right? Said Kelly's lawyers will clearly have a much tougher time defending this case than at his last criminal trial in 2008, when a cook county jury decided they couldn't be sure Kelly was the man seen in a grainy videotape having sex with a 13 year old girl. Nah, it wasn't him. It was somebody who just looked like him. A grainy videotape, technicalities and loopholes, and yet he's let go and he continues on his way, continuing abusing people, hurting people, ruining lives. Just like, just like Jeffrey Epstein. The stakes couldn't be higher for Kelly, 54, who has been in federal custody since his arrest in July 2019 and could face decades in prison if convicted. The trial is scheduled to begin in earnest on August 18 with opening statements, and is expected to last more than a month. See, that's the thing with RICO cases too. They can go on forever. And to build a RICOH case takes years sometimes, like when you're building a RICOH case against somebody like, say, John Gotti, it takes years to build that case. Now, you add the political connections to it, and you can see how people like Epstein were able to operate almost with impunity. According to the indictment, at the height of Kelly's fame, it was standard practice for his entourage to issue wristbands to girls, some minors, attending his concerts that allowed them backstage access and direct interaction with Kelly. I can confirm that that happened at concerts. I mean, 100%. I'm not too sure. That underage stuff, I never seen anything like that, honestly. But they definitely did do that at concerts. You know, they'd go out and there'd be people who worked for the bands. Their job would be to wrangle up girls, you know, groupies. They'd go out to the crowd, they'd pick out some chicks and bring them backstage and whatever's. Whatever. But this is on a whole nother level, Going out looking for kids to bring back, giving kids wristbands. Fuck is wrong with you? When Kelly identified a girl he wished to see again, he'd ask for her contact information or direct his associates to obtain it. The girls were then invited to meet with Kelly at future shows, with some provided lodging, according to the charges. And that was all part of it, right? You know, now you're feeling special. Oh, R. Kelly wants me to come hang out with him. He's going to get a hotel room for me. He really likes me, you know? Famous guy, young, naive girls. You see the problem here? You see where this is going? They were to call him Daddy and were not allowed to leave their rooms unless instructed by Kelly to do so, including to eat or go to the bathroom, the indictment said. So this was on another level, right? This was like he had them enslaved, like they couldn't do shit without his approval. You can't Go eat. You can't go to the bathroom. You can't do anything unless you ask me. I. Oh, and by the way, you gotta call me daddy. Uh, hello? Creepy fucking Creeperton. And the people around him that let this occur. All of his close confidants. Bunch of sick fucks. Just like Jeffrey Epstein's people. Many survivors allegedly were videotaped by Kelly performing sex acts and were slapped, spanked, or otherwise physically assaulted. Some were told they had to look at the floor. Others were forced to write letters containing falsehoods and embarrassing allegations for Kelly to use at his discretion if and when the need arose, prosecutors have alleged. So he'd have some compromise on them. Where did we hear that before, huh? You have a little bit of. Of dirt on somebody, it's a lot easier to mold them to do what you want them to do, isn't it? So we know Epstein was the king of kompromat. And it looks like R. Kelly had himself some kompromat here as well. One of the survivors central to the indictment is Aaliyah Houghton, a one time phenom singer referred to the charges as Jane Doe number one, who died in a plane crash in the Bahamas in 2001. Jeez, I can't even imagine that you think about Aaliyah, right, and you know, her music and all of that, and then to think that R. Kelly sexually abused her. Fucking mind boggling. Aaliyah met Kelly when she was just 12. As his protege, she went on to become a teenage R B star. Her smash hit May 1994 debut album, Age Ain't Nothing but a Number, was produced and written by Kelly. Yikes. See, this is all stuff I didn't even really know. I've never. Honestly, I try not to delve too deep into this shit besides the Epstein case because it's all so disturbing to me. I mean, I. You know, we live in a very sick, sick, sick world filled with very sick people. Age ain't nothing but a number. And it was written by R. Kelly. Boy, that aged well, didn't it? When Your Manhood 1994, bribed a state employee to create a fake ID for Aaliyah, showing she was 18, when in fact she was only 15. The next day, Kelly, then 27, married Aaliyah in a secret ceremony with the falsified paperwork. The marriage was later annulled by a Michigan judge at the insistence of Aaliyah's family. Wow. Imagine this sick fuck taking advantage of this little girl. Oh, I'm gonna make you a superstar. I'm Gonna make you the greatest R and B singer of all time. Getting her a fake ID when she's 15 so he can marry her. I hope R. Kelly fucking rots at the bottom of the prison. Prosecutors have said a witness will testify that Kelly had secretly arranged the marriage after he got her pregnant and and wanted to shield himself from criminal charges. Oh, more arranged marriages, huh? Boy, there sure are a lot of parallels here. There sure are a lot of parallels. Meanwhile, Kelly's former tour manager, Demetrius Smith, said in the surviving R. Kelly documentary that he'd arranged the forged documents for Kelly and was one of a handful of people present at the small ceremony in the Chicago suburb of Rosemont. So basically what you're telling us, Demetrius Smith, that your job was more important than these young girls lives. Keeping your job was more important than calling out your bitch ass boss or serving them up that three piece with the soda. You were there and you didn't stop it. You knew this girl's 15. You're letting this motherfucker marry her. It was just a quick little ceremony. She didn't have on a white dress, he didn't have on a tux, said Smith, who later told media outlets he's been subpoenaed to testify in Kelly's criminal case. Just everyday wear. She looked worried and scared. Oh, that's nice. So you're at a wedding and you know, this is a little girl. She looks worried and scared, but you still take part. You, my friend, are a piece of shit as well. Another alleged survivor who met Kelly at a Mall in 2003 was when she was in her early 20s and working as a radio station intern is expected to testify that she was invited to interview Kelly at a Chicago music studio where she was forced to sign a non disclosure agreement before being locked in a room without sustenance for three days.

Prosecutors alleged. So did they give her something to make her pass out some kind of drug or something like that? Doesn't make any sense. But the fact of the matter is this. R. Kelly and the people around him were sick fucks, and they all deserve to be charged with rico. The only thing I'm wondering is, where's the RICO for? Say it with me in the back, folks. Epstein and his crew. Also expected to testify is an alleged male survivor of Kelly's, identified as John Doe number one, who says he was sexually abused as a teen. After meeting Kelly in December 2006 at an unspecified Chicago McDonald's. Prosecutors alleged in a recent court filing that Kelly invited the boy to a party at a Chicago residence. But when the boy brought his parents, Kelly advised him to come without them to the next gathering.

Perhaps the closest analog to the Kelly case, according to one expert, was the successful RICO prosecution of the upstate New York group nxivm, a cult like organization that purported to be a self help group. A federal jury in Brooklyn convicted leader Keith Raynery on charges including racketeering and sex trafficking. In June 2019, the month before the RICO indictment against Kelly was unveiled, Ray Neary was sentenced to 120 years in prison. Um, paging Maureen Comey. Hello Maureen Comey. You have precedent all over the place. What are you doing? When are we going to get a superseded indictment here? When is Maxwell going to get smacked with RICO charges? Randy D. Gordon, executive professor at Texas A and M University Law School who has extensively studied rico, said the Nexiv sex cult had a concrete organizational structure reporting to Ray Nary while the enterprise Kelly allegedly led appears far looser. 100%. And that's my point exactly. If you're gonna hit R. Kelly with rico, and you should, Jeffrey Epstein and his people should be slapped with it too. It's an ironclad RICO case folks. Ironclad. If Epstein's last name was Gambella, forget it. We're not even thinking about a traditional prostitution ring though. This is a sort of. This is sort of within that space of sex trafficking, Gordon said. From the defendant's perspective, I suppose he can argue that the alleged enterprise is too amorphous and ill defined, he said. I still think the government has the better argument on the issue of whether the alleged enterprise is just disguised allegation that Kelly is the enterprise. Look again, similarities in this case, no doubt. But what Epstein did was on such a larger scale and spanned intercontinentally. It was government officials involved, magnates of business involved. But he doesn't get slapped with rico. Okay, I guess we'll just accept it. That's a topic that that Kelly's Chicago based defense team, which has since been severed from the case, tried to raise in a motion to dismiss last year, arguing the charges failed to specifically name any co conspirators, which is unusual for a RICO case. See again, there is more for el RICO case in the Epstein situation than any of these other ones. That's why it makes me so mental. That's why I scream about it from mountaintops pretty much every day. Robert Kelly is not an enterprise, attorney Steven Greenberg wrote in a motion at the time. RICO was not designed as a means to punish a single individual for his own wrongful actions. That's exactly.

It's not. It was meant to punish people who had leadership roles at the top of these organizations. So your boy R. Kelly, Jeffrey Epstein, Ghislaine Maxwell, those people. U.S. district Judge Ann Donnelly denied the motion in May of 2020, saying it was up to the jurors to decide. G. Robert Blakey, who helped draft the RICO statutes decades ago, said a case like Kelly's was not quite what he pictured when writing the law. But over the years the statute has proven to be extraordinarily flexible. Yeah, that's one way of saying that they've used it to hamstring plenty of people in this country throughout the years. To prove their case, prosecutors must show that the enterprise went beyond just Kelly himself, said Blakey, now a professor emeritus at Notre Dame's law school. But they don't necessarily have to prove a sophisticated mafia like structure existed under him. Case law has held that the enterprise must only be as organized as a pickup basketball game, Blakey said. And Kelly's indictment more than meets the elements of a RICO case. Bing, bang, boom, case point. Everything's sold down the river. It's all over and done with. The guy who wrote the law even just told you what rico's supposed to be. Now if Jeffrey Epstein and his organization don't fit those parameters, I don't know what does. While they're playing the game, you know the center is, you know who the center is and you know who the guards are. Everybody knows where the basketball court is, everybody knows to play on that court and the game goes on even though the people playing it change over time. That's just like the mob, he said. Can you identify roles in the group that was around Kelly and did it have reasonable longitude?

Was it around for a reasonably long time? It's gotta be more than a weekend. It's gotta be years. Every parameter, every box mark checked, every thing ticked off. How in the fuck is Maxwell not slap with rico? Stephen Block, a former federal federal prosecutor in Chicago, said it's likely the government truly considered Kelly to be by far the most culpable person and that is who they wanted to focus their efforts on. It could be that other members of the enterprise are cooperating with law enforcement and we might find out at a later time. They were charged with indictments under seal, Block said. And again, that's something that is possibly happening in the Epstein case as well. We don't know what's happening under seal right now. We don't know who's getting indicted or anything like that. So that's all up in the air still. We'll find out later on, obviously. But right now, who the f. Who knows what's going on behind the scenes? Grell, the RICO expert from the University of Minnesota, agreed that while some of Kelly's alleged enablers could have faced federal charges of their own, the singer was the true target in this situation. The primary goal is to cut the head off of the snake, he said. Well, folks, there you go. R. Kelly facing some serious RICO charges. And the question remains, when is Epstein going to face the same kind, or I should say Epstein's remaining criminal remnants of his enterprise, namely Ghislaine Maxwell? Because when you look at the NXIVM case, when you look at R. Kelly's case and you put them side by side and compare them to the Epstein case, there is no way that both of those people should be charged with racketeering hearing. And Maxwell not so we'll see. It's almost November. We're getting closer to the trial and who knows if the government's going to hit them with rico. But I'll tell you what, all of the parameters are met. And now it seems to be just a matter of the government not having the spine to go all the way. Tonight we're going to talk about Nexium a little bit and just a quick Overview. NXIVM was this supposed self help group that was really a sex trafficking operation, a money laundering operation, and just basically a criminal enterprise. And it was led by Keith Raynery and the actress from the show Smallville, Allison Mack. Now they both ended up getting charged with racketeering charges, RICO charges, and these were the charges and the template that was used to go after nexivm and to eventually bring the whole entire operation to its knees. Now, Keith, Ray Neary was rich and had powerful friends, there's no doubt about it. But again, just like with Weinstein, he didn't have the protection from whatever, you know, intelligence agency you want to insert here. There's several that you can insert. Right. So he wasn't afforded that protection. So he was, you know, acting. Maybe the, the state prosecutors would look the other way because he was rich. Right. They wouldn't be so hard on him. But when it's apparent like what happened with Nexium and people start ratting on you, etc. Etc. There's no way for them to provide cover for you. Now in the Epstein case, what they were able to do was they were able to provide cover for the co conspirators with the immunity deal. Right. The very silly immunity deal that Epstein got that covered. Co conspirators as well. Well, Ray Nary was never going to get something like that. There was zero chance that Keith Raynery or Alison Mack or the Bronfmans were ever, ever going to be afforded the same sort of leniency that Epstein was. And that can only be for the one simple reason.

Well, for some reason, Jeffrey Epstein and his co conspirators, they were able to skate. They never had to worry about any of that. So in tonight's article, we're going to talk about NXIVM and their downfall. And obviously the most important aspect that has drawn me to this case and brought it, brought it to, you know, the, the forefront here on the Podcast is the racket angle. And that's what I want everybody to focus on here. I know we don't. We don't stray very often from the actual Epstein case, but I believe this provides a good blueprint for how the prosecution could deal with Jeffrey Epstein's remaining co conspirators going forward. So this article is from the Cut, and it was authored by Amanda Arnold, and the headline is, NXIVM founder Keith Rainiery found guilty on all Counts. And this article was produced on June 19th of 2019, just over a year after being arrested on suspicion of running a sex cult. NXIVM founder Keith Raynere has been convicted. On Wednesday, jurors in Federal District Court in Brooklyn found Raynere guilty on all seven criminal charges against him, including sex trafficking and racketeering. That's rico, my friends. The New York Times reports. While Nexium purported to be a self help organization, federal prosecutors say that it was instead a front for a sex cult they say manipulated women, subjected them to ritual humiliations, monitored their calorie intake, and branded them with Rainier's initials. He said of Rainiery, you might find a lot of things about him distasteful. Yeah, that's putting it lightly. But most of them aren't part of the charges. Yeah, right, bro. Give me a break. This guy was full on involved in laundering money, was full on involved in fraud, was full on involved in sex trafficking. You name it, this guy was involved in it. Just like our boy Jeffrey Epstein, but to a smaller degree. Right? This guy wasn't on Jeffrey Epstein's level when it comes to running in the power circles that Epstein ran in or at the levels of Jeffrey Epstein's trafficking ring. And yet they pulled out all the stops and slapped him with conspiracy charges, slapped him with racketeering charges. But no one in the Epstein enterprise, or the Epstein organization, as I like to call them at this point, were slapped with RICO charges. None of them got slapped with forfeiture and seizure of their property. Why? Just. That's the question that needs to be answered. And until somebody can give me a logical answer on why Epstein was given beneficial treatment as opposed to these other billionaires and other power players, there is only one answer, folks. And the evidence has led us there from the very beginning. Since early May, former high ranking Nexium member and sex slaves have taken the stand to deliver Harrowing testimonies against Ray Nary, with particular focus on dos, a hierarchical group comprised of masters and slaves. And you see, this is what I'm talking about. The low level folks in the organization were forced to turn on the higher level folks because of the RICO charges, the conspiracy charges, the racketeering charges. Once you're looking at 20, these racketeering charges, if they go all the way to the, you're looking at 20 years.

We're not talking about 20 years. Concurrently, each one of these charges is going to carry 20 years and they're going to go for the gusto. This is the federal government, they love to do that shit. So if you think that that's not a motivating factor in having these people start rolling over on each other and ratting each other out, you see it right here. These people are not built for this life. They're not from the streets. They don't live by the street code, if there is even that these days, right? But as far as being rats, they don't care about that. They're gonna rat on their friends and then they're gonna go right back to the marina or right back to Martha's Vineyard or wherever the hell these rich people are hiding in their hidey holes when they're sex offenders. But for normal people, you rat, there's going to be consequences, right? So these people were never built for this life. In the beginning, from the, from the jump, these people were, you know, brought in by promise of, of wealth, some of them just wanted to belong, etc. Etc. But when you start throwing the RICO charges around like they're, they did in this case at the lower level people involved, you're going to start racking up the arrests and not only the arrests, you're going to get the indictments and you're going to get a lot of plea deals. A lot of these low level people are going to get off for two, three, four years, right? And of course we want some of them to do a lot more time than that. But if their testimony helps nail people that were in charge in leadership positions, then it's always acceptable to trade, in my opinion, a low level operator for one of the big head honchos who were behind the leadership role, who were behind the decision making, who were, you know, the, basically the core four in Ghislaine Maxwell and Jean Luc Brunel at this point. So what you have to do is start rounding everybody up, slam everybody with the RICO charges and you get the results that we see. Here, In one testimony, a former slave claimed that Raynere blindfolded her and permitted another woman to sexually assault her. Just like Jeffrey Epstein with Nadia Marcinkova. Right? We've, we've seen this MO From Epstein as well. Another woman testified that Rainier, he took photos of her that mostly featured her vagina. Again, just like Jeffrey Epstein, all of the pictures, the. He has to take a trophy. He has to have a trophy from every one of his conquests. That's how, that's how these sick people operate. Even before Rainiers trial started, the five other people charged for their alleged involvement in nxivm, including Smallville actress Allison Mack, who admitted in court to being a leader in the secret master slave sorority, pleaded guilty to the racketeering charges against them. Look, I'm telling you right now, folks, I am telling you, as sure as we're sitting here right now, when you start getting racketeering charges thrown at you, it is the end for you. R. Kelly got RICO charges thrown at him as well. So again, if it's good for, if it's good enough for R. Kelly, why is it not good enough for Jeffrey Epstein? Now you see, as I just pointed out here, that Allison Mack right away pleaded guilty to the racketeering charges because each of them hold a 20 year sentence. And she wants not, she wanted nothing to do with that. She's hoping that her cooperation against Ray Neri will get her a lesser sentence. And look again, that's a situation where I don't believe that either of them should get a light sentence. I look at Alison Mack and Keith Rainiery, kind of like Epstein and Ghislaine, right? The two heads of the organization, both in leadership roles and both people must pay for what they have done. But you'll, you see, once you see the racketeering charges come out, you start seeing plea deals across the board and people start cooperating because nobody is built for that 20 year life in federal prison. I'm very sorry for the victims of this case, Max said during her plea, or her guilty plea. I'm very sorry for who I have hurt through my misguided adherence to Keith Ray near his teachings. Now Rayner awaits this, this sentencing which is scheduled for September. He faces life in prison. So look, that's the blueprint right there. I'm telling you right now that the RICO angle is the way to go after these people. And if you use that RICO angle properly, you're going to be able to get not only arrests in this case, you're gonna get convictions. Because there's no way, zero chance any of these people, Vickers or, or Groff or Adriana Ross or any of these girls or Marcin Kova are going to be able to stand up tall and not rat on their friends when they're looking at these, these sort of racketeering charges. Because this is, this is serious business. We're talking about 20 years per charge. And you see how quickly Allison Mack was willing to just say, you know what? I'm going to just plea. I'm going to take the plea deal and I'm going to cooperate against Keith Raynery and hope that, you know, things work out in the way I hope they work out. Because at the, at this point, when you're somebody like Mac in a leadership role, you're up against it, right? You have no, you don't have a pot to piss in, as they say. You're really up against it. And you're going to be the one that's going down, especially in these leadership roles, because all of your little henchmen are going to start rolling over on you on a regular basis, one after the other, because they don't want to do that federal time. It's pretty obvious, right? Look, these people are quick to roll over on each other, even in criminal enterprise these days. I'm talking about hardened criminals. So if you think that these girls aren't going to start singing like mockingbirds, I have news for you. They're going to. Because there is, there is the blueprint. The blueprint is right here. Here is the blueprint right here on how to go after Jeffrey Epstein and his co conspirators as well. Because I'm telling you right now, they will start ratting on each other the second they get these racketeering charges thrown their way. All right, so there's also another article from a publication called Art Voice, and this was published on June 16th of 2018. And it's by an attorney from Albany that goes by a pseudonym. All right, so the headline is let's get facts straight about RICO as it relates to Allison Mack and Keith Raynery's case. So what this does is it's going to show you how RICO is useful in a case like nxivm and in the Jeffrey Epstein case as well. Let's get a few facts straight about rico. The overall purpose of the RICO statute is to allow for the prosecution of criminal acts that are committed as part of an ongoing criminal organization. Check. We know that that was occurring in the Jeffrey Epstein case, right? We know for a Fact that that was occurring. We had all the money laundering going on. We had the actual human trafficking aspect, we had the tampering with witnesses, we had the paying off of witnesses, et cetera, et cetera. In practice, a RICO prosecution usually focuses on the leaders of a criminal organization who order illegal acts to be committed and allows those leaders to be prosecuted for those illegal acts. If the leader of a criminal organization orders a member to murder someone else and the murder is carried out, the leader, along with the member who actually committed the crime, can be prosecuted for murder. And that's what RICO does. It bypasses all of the defenses put into place for people like Jeffrey Epstein, and it allows the prosecution to manhandle him and to go in there and really start slapping people around. And I'm telling you right now, this is a huge deal, a huge weapon. It's a bazooka. It is a bazooka and they need to use it. RICO prosecution or prosecutions are based on alleged illegal acts that constitute at least one of a list of 27 federal crimes or eight state crimes. These are called predicate offenses and of relevance to Nexium and its leaders, they include such things as blackmail. Check for us. And Epstein. Right. Bribery. Another check for the Epstein case. Extortion. Check for the Epstein case. Fraud. Whoa, what do you know? Another check for the Epstein case. Money laundering. Ding, ding, ding. We have a winner. Another check for the Epstein case. Slavery. Oh, well, there you go. Another one in the, in the, in the column of. Yep, that happened in the Jeffrey Epstein case. Theft. Yeah, we got that too. Bringing in aliens to the U.S. you know, how about some, you know, 14 year old triplets or Nadia Marcinkova or etc. Etc. Got that as well. Huh? Or, or. And bringing in aliens to the US or helping them enter for financial gain. Ding, ding, ding, ding, ding, ding, ding. We have a winner. You get a car. You get a car. Everybody gets a car. I mean, are you kidding me? This is, this is. Everything that they slapped Nexium with applies to Jeffrey Epstein as well. In order for RICO to be invoked, the defendant must have participated in at least two qualifying criminal acts within a 10 year period. And the acts must be related to one another. So that would mean the money laundering as well as bringing people in from a foreign country and have it connected. And that's very easy for the investigators to do, for the prosecution to do. All you need is a couple of competent forensic accountants. And it's money in the bank in this case for Jeffrey Epstein. Zero doubt about that. When A RICO case is initiated, the prosecution can seek a pretrial restraining order or injunction that temporarily freezes a defendant's assets. Well, what do you know how. What have I been talking about for months now. And. Or seek to have the defendant post a substantial performance bond. Either of those actions can make it difficult for a defendant to access the funds they need to hire a defense attorney. Looks like Claire has already gotten around this by establishing trust to pay defense attorneys for her and others. But you see how that's important, right? It's one another tool for the government to make life difficult for people that are getting slapped with RICO charges. And again, everything that that they used against Nexium applies to the Epstein criminal operation as well as. So make sure you're asking yourself as we're going through this, never keep the question far from mind. Why was Epstein afforded protection that nobody else was afforded? Anyone convicted under RICO can be fined up to $25,000 and sentenced to 20 years in federal prison per count. Now you see why it's such a dangerous law. Per count. Boy, oh boy. In addition, they can also be ordered to forfeit all ill gotten gains and pay treble damages. All ill gotten gains. And that again is where the forensic accountant would come in. That's definitely above my pay grade. I wouldn't know how to chase that money down. But I sure as shit can tell you that's how it all works. That's how these people go after it. That's how they do it. And remember what I told you earlier. If you follow the drugs, you're going to end up at a drug dealer's house. If you follow the money, you're going to end up at the distributor's house. Hey everybody.

RICO also has a civil component that allows individuals to bring RICO actions against the leaders of criminal organizations. Successful plaintiffs may also be awarded treble damages. You can pretty much count on this happening after the criminal trials are over. So again, not only do they have the survivors have RICO at their fingertips, when it comes to these people being prosecuted afterwards, they can use the RICO civil statutes as well and go after them civilly. In addition to the federal RICO statute, a majority of states has also enacted their own RICO statutes. New York is one of those states. These state statutes generally expand the list of underlying crimes that can be used as the basis of for bringing a RICO prosecution. They're making it real damn easy to bring RICO charges, and yet we don't have any. And yet Berman has nobody brought in. They're not shaking any trees, not kicking over any ants, any. Any bees, Hives? Nope. Nothing. Just running around acting like, you know, they're calling Prince Andrew out, acting like they're actually doing something, but in reality, there's no movement. Right, let's go. Let's get busy, Mr. Berman. Or are you going to get undercut by Denise George in the Virgin Islands? Because at this point, she seems like the more likely of the two to really pursue this and to really go after these people. So are RICO prosecutions a possibility as regards to the leaders of nexivm? Of course. Will the Feds go that route? We'll have to wait to find out. And we know that they did go that route. We know that they did get charged and found guilty on the counts of racketeering. They pled guilty, et cetera, et cetera. If the Feds decide to indict Claire and or Sarah Bronfman, they might attempt to level the playing field by couching the case as a RICO prosecution and seek to freeze at least some of their assets. But they could just as easily charge them under a variety of federal criminal statutes and, or make referrals to state prosecutions. The latter probably won't happen until there's a district attorney in Albany county or Saratoga county that hasn't been compromised or corrupted by nxivm. And that ends today's overview on rico. There you have it, folks. Now, I, I'm, I'm not a legal professional, certainly not a lawyer. You know, I don't even pretend to know the, you know, the statutes and all of the laws or anything like that, but one law I do know is rico. I've seen it wielded by the federal government on people that I care about. I know exactly how they roll. And the fact that they're not using the RICO statutes to go after Epstein's co conspirators, it just, again, it leaves a stench of, of stink hanging over the case. Because if they were serious about justice, if they were serious about bringing these people down, then they would slap them with these RICO charges. And the ball would get rolling and it would be game on. So I wanted to, like I said, I wanted to talk about this Nexium a little bit tonight. That way we could see the parallels between the two and see how RICO is applicable in the Epstein case as well as this Nexium case. So hopefully this gave you a little bit more of an idea, a bit of an overview about what RICO is and how it can be used. And I know there's been some confusion and some people, you know, not too sure what the laws are or what they can do or, you know, how they work and how they're administered. Well, this gives you, like I said, a blueprint, in my opinion, and a template on how the government should conduct themselves going, going after Epstein. But in the Epstein case, they should be even more aggressive considering how many people were involved, how it was young children and how many decades this spanned. This should be an all out full court press by the government slapping everybody ever involved. Wexner, Dubin, et cetera, et cetera. Name them all in the rico, the RICO case and then let the forensic accountants and the investigators sort it all out. There's just no reason for this not to be RICO at this point. So.
