Okay, the recorder is back on. It's 2:28pm Again, Ms. Noel, you're under oath and this is a voluntary interview. Thank you for your cooperation. Alright, so if you don't mind, just all the documents I have in front of you, can you just initial and date those just again so that we know what it is that you are looking at during the interview? Thank you very much for initialing and dating all of those. Alright, we're just going to talk briefly about the shoe layout. These are papers that have the shoe layout. Now are these just for your reference if you need to look at them? Are the COs assigned to the shoe located together on one social, one centralized location? So the officers that are working in the shoe, are you all together? You mentioned that there's a desk in the shape of an L. Noel Yes. Question Is everybody together at that location when you're not doing rounds and counts? Noel I mean not really. Somebody could go upstairs to the bathroom. Question okay, during your shift on the 10th, is that where you and aside from when you said you helped redact it out, is that where the two you and Thomas were located at that one central area? There's not another officer station though, correct? Noel no question. There's just one station. Noel there's one question. Okay? And approximately how many computers are there at that station? Noel. About three. Question Three. And you said no one had, like, an assigned computer? Noel. No question. OIC doesn't have a computer. Everyone just uses one computer. Noel huh. Question what can you see from the desk in the shoe? Can you just mark on there? Where is the actual L desk setup located? So it's the two floors, the two layers. I don't know if you're able to look at the L tier where Epstein was, that might give you like, what's the first and what's the second? Is it correct? He was on the second level? Noel. Yes. Question and was he in ltr? So that might help you out to be able to differentiate between. You see where the cells start with, like a letter and then a number? Noel. Yeah. Question so that will probably help you be able to decipher what the first level and what's the second level. The union rep pipes in. Do you know what you're looking? Noel huh? Okay. Question so can you figure out by looking at that, so if the one that begins with L, that would be the second level. Do you follow that? Noel yes. Question and then there's the first level. Is there actually almost like a third level where the officers sit? Is it like too different the way it's tiered? Noel no, it's on the main level. Question okay, so where the first set of inmates are? Noel See it? Stairs. You've got to go down and you've got to go up. Question Right. Okay. Noel so it's not where we're sitting. You've got to go down and you've got to go up to get to the cell. Question okay, so on that looking at, like the first level of inmates, can you just kind of identify where it is that L shape setup is? Noel over here. Question can you just mark it maybe like an X or a circle or something? Okay, thank you. And from where you're sitting, can you see all the cell doors from there? Noel. Not all. Question not all. Could you see the door to Epstein's cell from there? Noel yeah. Question all right. Can you mark on there where you recall Epstein to have been? All right, thank you. And does that have a cell number on it? Question I think those numbers correspond with this. Noel Foy kicks in because I'm thinking, is it because you have to be able to see in there? Again, we're talking about like that's where the shower was, what you were talking about. Approximately. How far was Epstein's cell from where you were seated? Noel like to where the chair is? Question 10 to 15ft? Noel Probably. Question okay. All right. So the reason why I'm asking that did you or anyone else ever go in or out of Epstein's cell on August 10, 2019? Noel. No. Question and would you have known if someone else did? Noel yeah. Okay. While you were physically present in the shoe? Of course. Noel yeah. Question and you said that the only times you weren't present in the shoe on August or let's talk from you said 10pm Is that the last time? Around 10pm Is the last time that you saw him? Noel yeah. Question from 10pm until approximately 6:33am what time did you. When did you leave the shoe? I know one time you said that you helped with the counts up in 10 South. And you may have said that you were gone in the bathroom. When would those times have occurred? Noel? 3 or right after 3? 5 or around after 5? Going to the bathroom? I don't remember the time. Question okay, so around 3am around 5am and then 1 other time to use the restroom. Noel yeah. Question and where is the restroom located in the shoe? Noel. Upstairs, where I go to count. Okay. But Thomas was present any time that you Were there? Noel yeah Question Although he may have been sleeping? Noel yeah Question okay, and if you or the people that we've talked about you said that the lieutenant visited the shoe approximately at 4am that was. Lieutenant redacted. Noel yes. Question who else from 10pm until 6:33am were in the shoe? Noel Indiscernible. Question well so redacted left around 10. Noelle huh. Question redacted left around 12 anyone else? Noelle no Question what about when redacted came to the shoe? So I just want to make sure I know we've discussed some of this stuff. Noel oh you're talking about the people that's working there. Question Everybody that's been in the shoe. So there's you, there's Thomas. Who else was actually in the shoe from 10pm the last time you saw Epstein until about 6:30pm when he was discovered? Question and you're confident positive about that? Noel yes. Question all right. And did any of those other individuals that visited the shoe go near Epstein's cell? Do you mind just initialing and dating that and are you aware I guess the other thing that I will ask is is I know I asked you when you were there but when you were gone to do the counts in 10 south as well as use the restroom, are you aware of anyone visiting the shoe during those times? Noel no Question no okay. Question by somebody else I have a follow up question. When you left to go assist, did you take the keys with you? Noel yeah Question So so could Mr. Thomas have let anyone in or out? Noel no Question so he wouldn't have had the ability to let anyone in based upon you having the keys the whole time? Noel yeah Question and did you have the keys because you were shoe officer number one? Noel I guess. I mean I just had them question okay There wasn't a discussion like I'm shoe one I get the keys. Noel no question do you know that shoe one is supposed to be the one that has the keys? Do you know that? Noel I think so. Question okay. Do you know if you had any conversation with Thomas about if you had the keys or if he had the keys? Noel no question. Okay. Anyone that entered or exited the shoe that day, are you the one that let them in or out? Noel yeah. Question. Thomas didn't let anybody in or out? Noel no question. Okay. Are you aware of any cameras that were not recording within the shoe on August 9th or 10th, 2019? Noel no question. You're not aware. Are you aware at this point? Not just at the time, but are you aware now if any cameras were not recording? Noel I mean, I'm aware now. Question. That's what I mean. What are you aware of now? Noel I don't know. Like what specifically? I I just heard that some of the cameras were not working. As far as which ones she's cut off. But do you know which ones? Noel no question. Okay. And at the time you didn't know? Noelle no question. So you don't know if they weren't working when they stopped working? Noelle no question. Are there any like do you have the ability to monitor cameras from the shoe? Noelle no question. So if you're sitting in there, there is not like camera downrange that you can like you can see what's going on in each range? Noel no question. No. Do you know if someone is live monitoring either anywhere in the shoe or during operations? Noel I don't know. Question. You don't know if you are being monitored or if the inmates are being monitored? Noelle I don't know. I know there's cameras on the tears. Question. Right. But do you know if anyone's watching them live? Noel oh, I don't know. Question. You don't. And you don't know if there is any camera pointed at you at the desk area? Noel oh, I don't know. Question. And you don't know if anybody is watching those either? Noel I don't know. Question. I think it'll be fine. So are you not. We can just skip the rest of those questions. You're not aware of the cameras at the time not working? Noel no question. So no one reported to you and you didn't report it to anyone else? Noel no, I didn't know anything about cameras. Question. Alright. And we talked a little bit about sleeping on duty. So it sounds like Thomas was asleep pretty much the entire shift then.

She called the lieutenant, verified with the lieutenant, and then Mr. Thomas went up to relieve him. Question okay, and around what time was that? Noel after five. Question okay, so basically from 12 to about five, he was sleeping. Noel I mean in intervals, like I tapped him, he kinda woke up. Question Right. Noel but he went back to sleep. Question okay, but he wasn't doing his duties. He was sleeping. Noel Correct. Did you sleep during your shift? Noelle no. Question you didn't sleep at all? Noelle no. Question for the period that you were sitting at the desk for like two hours without moving, were you awake? Noelle yeah. On my computer. You were on the computer. Were you on Thomas Seated next to each other? Noel no. We were seated next to each other. But not facing each other like he was faced that way. I was faced the other way. Question okay. Close proximity to one another? Well, yeah, like he's there and I'm here. Question so about three or four feet from each other? Noel yeah, but the back is turned because he's that way and I was this way. Question okay, but you are not asleep. Noel no. Question now, are you guys authorized to sleep in the shoe? Noelle no. Question no. And have you ever fallen asleep previously while on duty at the mcc? Noelle not in the shoe. Question not in the shoe, but other places. Noel yeah. Question where would you where did you sleep at other places? Noel where did I fall asleep? Question huh? Noel On a regular housing unit. Question the regular housing unit no. Noel yeah. Question can you just give me a little more information on that? What do you mean? Were you allowed to sleep there? Noel no Question and where were indiscernible? Noel Like I work consecutively, like five days of overtime and I would like those off caught myself like, but not sleep. Question okay, so you've fallen asleep in other housing units? Noel like dozed off. Question Right. Because you were overworked. Noel yeah. When I work like three or four days of 16 hours, yeah. Question and how often would that happen? Noel how often would I fall asleep? Question yeah. How often would you fall asleep? Noel oh, that was like four, I don't know, two times. Question I understand, but in the shoe, you had never fallen asleep before? Noel no. Because I don't work that graveyard shift. Question no. Well, I just mean even during your regular shifts because it sounds like you guys were working a lot. NOELLE yeah. Question so but in the shoe, you didn't fall asleep that night and never before in the shoe? Noelle on the shoe? No, because it's daytime. You said that was your first time working with Thomas. Noelle yeah. Was that ever with Thomas or just in the shoe? Did you ever work with Thomas outside of the shoe? Noelle no. Question have you ever, like, met with him or interacted with him? Noelle yes. Question Prior to this, just socially or. Question he brings inmates to the units to give out stuff. So we've spoke and said hello. Question okay, do you know of Thomas, have you ever heard of Thomas sleeping on the job previous to this incident? Noel I don't know. Question no. You said you did try to wake him up a couple of times, but. Noel yeah. Question but he said he was just tired. Noel yeah. Question and you said you didn't report the matter to the lieutenant because he actually fell asleep in front of the lieutenant? Noel yes. Question and at that time she hit him with a piece of paper and he woke up? Noel yes. Question and how did he respond to that? Noel he woke up. Question Was there a conversation at all? The did he say, like, oh, I'm exhausted? Noel well, he didn't say that, but she said that. She was like, that's the problem in here. The overwork and the under staff. Question so with them falling asleep, that's how she responded? Noel Lieutenant Redacted QUESTION yeah. Noel yeah, but she didn't respond like that to him. She was saying that to me. That's the problem in mcc. Everybody's overworked and understaffed. Question okay. After she left, did he fall back asleep? Noel yes. All right, folks, we're gonna wrap up right here. And did you conduct Internet queries when you were assigned to the Shu on August 10, 2019? Noel? What do you mean? Like Internet searches? Did you like Google things or look things up when you were in there? Noelle. Yeah. Question. Well, just tell me what did you search for? Noelle. Well yeah, that's what I. I was looking at on benefit page for something. I was checking for one of my benefits and she gets cut off by Foy. Continue with it. I've just got to go. This is a jail call. Question. Okay, so Attorney Foy is stepping out, however. Attorney. Is it Saraga? Ms. Mr. Saraga. Yeah. Question. Saga is still present? Noel. Yes. And when I think I looked at. I think it's furniture. Okay. Did you do any. Do you remember conducting any Internet queries related to Epstein? Noel? No, I don't remember doing that. So you don't remember actually conducting queries on EPSTEIN at around 4 or 5am Noel. Hmm? Question. On August 10th? No. Okay. Does that surprise you for me to ask you that question? Noel? If I don't remember doing that? Question. I don't know. Had you queried him before? Had you looked up Epstein previously? Noel? I don't recall looking them up. Question. No. Noel. Like when you click on the browser, you know, like if you open it Emerson or Google, like how it has all the little news pieces. Like one time he was there. Question. And Was that on August 10th? Noel? No, I don't recall that being on August 10th. I don't remember. But I don't recall it being on August 10th. Question. So as in like maybe somebody else was looking them up and it just populated when you turned on the computer? No, well, I don't think it does that. Like on the searches, like the current news will be there. So he's in the current news. So he'll be there. Question. Oh, all right. Noel. It won't look like the load page. Like when you click on like the Internet Explorer or you click on like Firefox or whatever. When the page loads the news is there. Weather Question. Okay, so if you pre populated something and then you searched on that day Epstein at the mcc, that possibly could have been something that was like on a newsfeed. Well, when you say pre populated like that, as soon as you click it, like it was there. Not like you said a search question. So you weren't. Yeah, like a search. Like you were actually looking at it or if like it was a news feed. Well, yeah, like I'm looking at it because it's there but not like typing it in. Question. So you're not like actually going to Google or Yahoo or some kind of search engine and saying Epstein. Well, no question. All right, so do you remember reviewing news articles on Epstein? Noel? Yeah. Question on August 10th. Noel. On August 10th. I don't recall if it was August 10th, but I remember when I saw it I like scrolled and read it. Question. Okay, and what was the purpose of that? So you're just trying to learn about the inmates he gets cut off by? Noel. And I read it because remember I was asked like do I know who that was? And I was like, no. And there was like, he's always in the news. So when I saw it, I just briefly skimmed to see like if he was in the news for she gets cut off. Okay. And you don't recall at 5:42-5:52 on August 10, 2019, looking at articles related to Jeffrey Epstein? Noel no question. You do not recall that? Noel. No question. Do you remember searching for him? Noel no question or having anything to do with when you're on the Internet? Noel no question With Epstein indiscernible? Noel no question@552 Noel no question no does it surprise you to hear that, you know Internet searches would show that that's what you were doing but from 5:42 to 5:52am on August 10, 2019 Noel yeah. Question that does surprise you? Noel huh? Question so you don't think that would be accurate then? Noel yes Question. You think it would be accurate or not accurate? Noel. Oh no it wouldn't be accurate. Question it wouldn't be accurate. You do not believe that you actually conducted those searches? Noel no Question okay. And since you had the keys no one else could have visited the shoe without you knowing correct? Noel Correct. And the individual on 10 south or anyone else are they able to access the shoe without someone in the shoe allowing them in? Can they get out of 10 south and enter the SHU by themselves? Or does someone from the shoe like you and Thomas need to authorize them entry? Noel he needs to call like I have to call Control the pop that door Question so he has to call control. Noel because there's a door that lets you into 10, you have to call Control. Question and then is it like the entrance, Is there like a second door that you have to use a key for? Noel yeah Question So there's also two into 10 South? Noel yes question and that second door, is that the one that he gets cut off by? Noel don't have the key for so he would also have keys or is it just redacted? Noel no, I don't have the key for upstairs. Question alright. So he needs to open his own. Noel Right Question and then Control pops it Noel Pops it Question to then allow him into the shoe. Noel yeah Question so he could theoretically get into the shoe without your knowledge? Noelle no I have to call Control to pop me into the shoe Question yeah yeah I'm saying redacted's ability to get into the shoe where you and Thomas were. Noel he can't do that because he can't leave unless because remember Thomas has to go up to relieve him so Thomas is getting the door popped but he can't just come out and get the door popped because he would have to leave the unit with nobody up there. Question Right. What I'm saying is like hoodie does he have the ability to not policy dictates that he can't do it. I'm saying would he be able to if he wanted to take policy out of the way. Noel. Call for them to pop the door. Question. Right. So like point being, could have he access the shoe theoretically without you and Thomas knowledge? Noelle. Yeah. Because he could go and pop that door. Question. Right. But he would have had to call control in order to do so. Noel. Yes. Question. All right. And does anything allow control to know if that door was never locked or closed or anything behind them? Noel. I don't know. Question. You're not sure. Would an alarm sound if the door wasn't closed or anything? Noel. I don't know. Question. You're not sure. Who was the last person to see Epstein Alive prior to August 10, 2019 at 6:33am? Noel. The last person to see him alive. I would guess me because I got. She gets cut off. You were. Noel. Because I counted at 10 or after 10. Question. And on that occasion you didn't actually enter his cell. You said? Noel. No. Question. Who was the last person to have physical contact with Epstein? Noel. Thomas. Question. Thomas would have. And when would that have been? Noel. When he was feeding. No. No. Noel. You mean like a time? Question. Thomas had physical contact with Epstein during his shift on August 10th prior to 6:30pm or 6:30am Noel. No, not prior to 6:30am I'm talking about at the 6:30 question. Right. So you're the last person to see him? Noel. Yeah. Question. Who was the last person to have physical contact with him? Noel. Oh, whoever put him in the cell when I went to the bathroom. Question. Okay, so you're not sure? Noel. No. Question. All right. When you saw him, please explain in detail like. Or I guess you already did. You said when you saw him he just put his hands up. Noel. Yeah. Yes. Question. Yep. Did he seem. Did anything seem unusual with him? Noel. No. See there's exceptions being made for Epstein because it's Epstein. You're not supposed to have a CPAP machine. It has a long cord. So other inmates don't have a CPAP machine in the shoe. Like, you're not supposed to have that. Who authorized it? Who gave it to him? I don't know. Question okay, and that's kind of what I was asking earlier, and this is much earlier about, like, where did Epstein, why was he treated differently than the others? Noel I mean, she gets cut off. Were there other instances that you can think of, like, people said pay him special attention because he's different from the other inmates? Noel no, just a CPAP machine. And one time he wanted two mattresses. He wanted two mattresses? Noel yes. Was he provided two mattresses? Noel no. Question so he just had the one mattress? Noel huh? QUESTION so the only thing you can think of is that. Noel Is that. Question Is that the cpap? Noel that's the CPAP question okay. Is that the one with, like, the mask that's attached to your face? Noel yeah. Question and there's actually, like, a cord that goes with that? Noel yeah, the cord has to be plugged in. Question now, do you consider that, like a safety issue or anything like that? Noel but see, that's the thing. I don't authorize those things. Question sure. Noel that's why I said when a person, you see how the question was asked when somebody comes back from suicide watch, like, is there, like, something, like, special being said? Like, no, because he's cleared. Because if there was, like, he would be allowed to have that in his room. So once he's cleared, you come back, you're okay. Question okay, Were they, Were there any other issues with any inmates or. On August 10, from 12am to 6:33am Noel no. Question no. So there was no disturbances? Noel no question were there any inmates complaining about the lights being left on or anything like that? Do you recall? Noel not that I know of. Question no. And do you recall if any other inmates were on or came from suicide watch? Noel no. Question so you don't remember any other inmates being handled differently than others? Noel no. Question no. Or like, special instructions with regard to this inmate or that inmate? Noel no. I don't know. Question and you don't remember inmates complaining about the lights, you said? Noel no Question how do the lights work? Do they stay on on the range at all times, 24, 7 in each tier? Noel I don't know. But the light is in the hallway for the room. Question so for an interior room, what about the down the hallway to each of the tier? Noel oh yeah, it stays on. Question were they on 24 7? Noel yeah. Question do they ever turn those lights off? Was there a medical emergency in the shoe on the morning of August 10, 2019? Noel yeah. Question why was the medical emergency called? No. Noel because when I opened the grill and Thomas went to go feed, he knocked on the door. He got no response and he opened the door and then he started saying, get the cutter. And I heard I was on the grill, I heard when he ripped something and he started cpr. Question okay, when was the medical emergency called? Noel at that time. Question how soon after Thomas entering, he gets cut off by Noel when he opened the door, he yelled, get the cutter. Noel I had the audio on. And from the time he was discovered to the time of your call about how much time passed from him saying entering the cell and the time that the medical emergency was called by you? Noel she goes to answer, but she gets cut off by the lawyer. Are we talking about like five seconds? Noel yeah. Noel is second as soon as he said it, I did it. Question oh, so like there's a button you just hit? Noel yeah. Because the button is on my radio. Question and did you call it in at that time? Noel no. Once you hit it, everybody's coming. Noel yeah. Question did he say anything about what he saw? Noel when he got when he entered the room and he said to get the cutter. Before I got the cutter, I heard him tear something and then he lowered him to the floor. That's when I saw him and he started cpr. Question all right, so he never said, like, Epstein hung himself or what he saw. He just said, get the cutter. Well, he said, get the cutter. And then I started cpr. And he kept saying, breathe, Epstein, breathe. And he was like, we're going to be in so much trouble. Question and where were you when he was doing that? Noel on the grill. Question Were you in the position to be able to see anything in there? Noel no. Question at any time did you see anything in there? Noel no. Question did you ever see Epstein in the cell? Noel no. When everybody's coming, I have to let them in. So I never went in. Question okay, so after he made the call, did you go get the cutter and bring it back to him?
