In this episode, we're going to begin taking a look at a deposition given by Virginia Roberts in January of 2016. And this deposition has to do with a lawsuit filed by Brad Edwards and Paul Cassell against Alan Dershowitz. And in this deposition, we have Ms. Borja, who is a lawyer for Alan Dershowitz, asking the questions, and then Virginia is going to do the answering. And like usual, when I say question, that means Ms. Borgia has asked the question, and then obviously the answer is from Virginia, so let us dive in. So they swear in. And Ms. Borgia asks, we have noticed this examination for you as Virginia Roberts. I understand that you have a different married last name. Yeah. Could you pronounce that for me? Joffrey. If from time to time I call you Ms. Roberts, would that be okay with you today? Absolutely. I'm going to hand you a document that's been marked as VR Exhibit 1, which is a notice of taking video. Deuces teacum. Ms. Roberts, are you appearing here today pursuant to this notice of video deposition Duces Teekum? Answer yes. Question. Did you bring any documents with you today pursuant to the deuces? Teach them. Answer no. Question. Were you asked to bring any documents with you today? Answer no. Question. Are you aware of the action that your attorneys, Brad Edwards and Paul Cassell filed against the government? Yes. If I call that the federal action or the CVRA action, will you understand the action that I'm referring to? Yes. Question and you sought to join that action, Correct? Answer Yes. And. And you're aware, are you not, that there are allegations that you were sexually trafficked being made in that action? Correct Answer I'm aware that there are allegations that I was trafficked. Question if you turn to page four of this document, the numbers are on the bottom of the page in that first full paragraph. In the third line down it says Epstein required Jane Doe 3 to have sexual relations with Dershowitz on numerous occasions when she was a minor. McAuley. Feel free to look at the entire page. Mr. Scarola. It is a minor discrepancy, but I think you read it as when she was a minor and it's while she was a minor. Borgia Question. While she was a minor. Do you see where I'm reading starting in the third line? Answer. Yes. Question. Is that allegation true? Answer yes. Question. If you go to page six of the document, do you see paragraph that starts epstein also trafficked. Yes. Question. It says epstein also trafficked Jane Doe 3 for sexual purposes to many other powerful men, including numerous prominent American politicians, powerful business executives, foreign presidents, a well known prime minister and other world leaders. Do you see that? Yes. Is that allegation true? Yes. The reference there to foreign presidents, do you see that? Yes. You were sexually trafficked to foreign presidents? No. Question. So that's not true. You are not sexually trafficked to foreign presidents. I don't know what foreign president you're talking about. Have you ever been sexually trafficked to any foreign president? Ms. McCauley, I'm going to allow you to ask that question, but with respect to specific identification of an individual, we're not going to do that at this point. She has. Borgia Council, your objection has been made. No speaking. Objections, please. Let's move on. McAuley. I can make a record and my record is she's not going to be speaking with respect to individuals. As far as far as foreign presidents, I'm not too sure. I don't know. Question. Have you ever met any foreign presidents? Answer. Foreign presidents, as in overseas question. Sure. Okay. Overseas answer. No. Question. Have you ever met any foreign presidents from countries not overseas such as Canada or Mexico? No. So you are not sexually trafficked any foreign presidents, is that correct? As far as I know right now, yes. It's correct that you are not sexually trafficked to them? Right. You've asked me this three times and I'm telling you. Okay. A well known prime minister. Were you sexually trafficked to a well known prime minister? Yes. Question who is that? Ms. McCauley, I'm going to object to this line of questioning. This has to do with her safety concerns for her. Ms. Borgia Council, this is under seal. You can answer. No, she's not going to answer the Special Master pipes on. Hang on one second. McCawley. Let me make my objection. Special Master make your objection. McCauley Regardless of it being under seal, we've seen that in this case the client that you represent has violated confidentiality orders regularly. So we have no sense of security with a sense that this is confidential record at this point. We are doing that under the court's order with respect to naming individuals who can harm a victim of sexual trafficking. She's a non party in this action, not a plaintiff. She is not going to be revealing any names today of an individual who is going to harm her physically, period. If we have to go to Judge lynch on that, we will. I'm happy to do that. But she's not going to be naming individuals where there's a threat to her safety. Special Master response Borgia it's under seal. I'm shocked that council would suggest that a prime minister is threatening the physical safety of this witness. There's no foundation for that. The suggestion that a foreign minister is going to physically harm has no evidence in this case and it's being under seal. Let's get the evidence out while the witness is here. As you pointed out, she's a non party. Let's make a record and move on. Ms. McCauley, you may be shocked by that, but Special Master interrupts Hang on a second. The reason why I'm here is. So we don't have the back and forth. McCauley sure. Special master. I'm going to rule on the objection. Your objection at this point is overruled. You can answer. And I want to admonish everybody here that this is a confidential and protection of this witness is a paramount importance under the confidentiality order. So Ms. Roberts, you can answer that question that's been asked. McAULEY at this point, we're going to need to take a break because I'm not going to allow her to answer the question that's going to threaten her physical safety. So we can take a break on that. Virginia if I can just say I personally know that, that this is not a good person to talk about and I'm not going to point blank, I'm not going to say his name. To the extent that you revealed something to me in work product circumstance or attorney client privilege, I don't want you revealing that. This case is about the defamation between Paul Cassell and Brad Edwards and. And Mr. Dershowitz. It's not about the individuals other than Mr. Dershowitz. Who's the individual here? Who? The judge said. We're here to talk about the issues in this case, not the litany of other individuals. Ms. Borgia. Council, we have limited time. Special master. Hang on one second. I'm handing you a document that's been marked as VR Exhibit 2, which is plaintiff Virginia. I apologize. Disclosure pursuant to Federal rule of of civil procedure number 26. This is a document that was entered in your lawsuit against Glenn Maxwell in the Southern District of New York. Have you ever seen this document before? No. If you look. Take a look. There's a list of witnesses starting at page one and continues on. Yes. I'm wondering whether this list might help you. Can you look at the names on this list and tell me who from these names you were sexually trafficked to? Answer Redacted. I wasn't trafficked to her. She was just part of some of the trafficking. Hold on. What part did she have in the trafficking? She was involved in some of the orgies. So she was a sexual participant in the orgies? Answer yeah. Question that you were a participant in as well? Answer yes. Were these the orgies that Redacted was involved in were with any of the individuals that you have named so far today? Answer not that I can remember right now. Question do you remember what gentleman you were involved in the orgies with? Answer as far as I can recall, Jeffrey Epstein. Question okay. Answer Redacted. I mean, you have to understand there was a lot, a lot, a lot of girls around to remember all of their names. Question My question is was redacted a participant in sexual activity with you? I don't know and I'm not going to speculate. Question I'm not asking you to speculate. I'm asking you under oath today, was she a participant, as far as you can recall, today, in sexual activity? McCauley Objection. Asked and answered. Borgia. Question with you. Answer I'm telling you under oath that I'm not sure about redacted being in sexual orgies with me, but the name does ring a bell. Question and redacted. Answer yeah, she was involved but not going to speak about her. She has the right to her own privacy. She's been hurt. She's a victim. So I'm not going there. Question did she participate in any of the sexual activity with others that you've named today? Answer yes. Question. With whom? Answer. I'm not answering that. Macaulay. We're going to object to the extent that you're concerned about the safety of one of these individuals. We're not going to testify. We can go to the judge and we can come back if he says you have to testimony regarding that. But she gets cut off by Borgia. We already have the names of the gentlemen. Special Master. Hang on one second. For purposes of the record, have you made your record? Macaulay? Well, let's make a record. So redacted. Was underage at the time this occurred. So she herself is a victim. So to the extent that, you know, if you want to bring her counsel in and have them present during something like this, that's fine. But this witness, who is a non party to this litigation, who's a victim herself, doesn't have to speak about other underage victims. Special Master Council. Borgia. Well, I'm entitled to know the names of witnesses who can either verify or discredit the allegations. McAuley, she's given you the name. Special Master Council. Let her make her record. Borgia. As to specific individuals. I do not want to bring up her name with individuals with whom she's not alleged to have sexual activity. That would be unfair to this witness. But what would be fair to my client, who is being sued in the case, is to be able to check the allegations with a neutral third party. And if this is a witness, McCauley cuts her off. Why don't you ask her if that's somebody who's involved with your client, which is what we're here on today. Alan Dershowitz. Not all these other individuals. Special Master. Okay. All right. So that will have to be dealt with in front of Judge lynch the for a subsequent time.
